Rules for Forming Work Committees

  • After reviewing the correspondence received from the Diwan of the Presidency of the Council of Ministers No. 8/326 dated 13-04-1421 AH, which includes the telegram of His Royal Highness the Minister of Interior No. 2/1793/35Sh dated 25-07-1416 AH, attached with the minutes of the committee formed from the Ministry of Interior, Ministry of Labor and Social Affairs, the Experts Authority, and the General Secretariat of the Labor Force Council regarding the proposal of rules for forming labor advisory committees in main establishments.

  • After reviewing the Labor Law issued by Royal Decree No. (M/21) dated 09-06-1389 AH.

  • After considering the Shura Council decision No. (6/9) dated 23-03-1421 AH.

  • After reviewing the two minutes prepared by the Experts Authority No. (18) dated 23-01-1420 AH, and No. (277) dated 17-08-1421 AH.

  • After reviewing the recommendation of the General Committee of the Council of Ministers No. (6) dated 08-01-1422 AH.

  • Approval of the rules for forming labor committees in the attached format.

Article 1

Previous Amendments

For the application of the provisions of these rules, the following words and phrases shall have the meanings indicated before them: 
‏Ministry: Ministry of Labor and Social Affairs.
Minister: Minister of Labor and Social Affairs.
Committee: Labor Committee.
Council: Advisory Council for Labor.
Establishment: Any project managed by a natural or legal person employing one hundred Saudi workers or more for any type of wage.

Article 2

A single work committee may be formed in each establishment, and the formation of the committee and the naming of its members shall be approved by a decision of the Minister in accordance with what is specified in the Implementing Regulation.

Article 3

The Committee consists of a number of members not less than three and not more than nine, and the term of membership in the Committee is three years.

Article 4

The following conditions must be met for a Committee member:
1. Must be among the Saudi Employees in the establishment.
2. Must be at least twenty-five years old.
3. Must have served in the establishment for no less than two years.

Article 5

The Committee provides recommendations to the management of the establishment regarding the following:
1. Improving working conditions and terms.
2. Increasing production and ensuring its quality, and enhancing the productivity of workers, in a way that achieves a balance between the interests of workers and the establishment, and ensures the stability of labor relations.
3. Improving health standards.
4. Providing occupational health safety measures.
5. Developing administrative vocational training programs, and raising the cultural and social level.

Article 6

The Committee holds its meetings at the establishment's headquarters, and it elects a Chairperson and a Rapporteur from among its members at its first meeting. The Implementing Regulation specifies how it conducts its meetings and makes its recommendations.

Article 7

Committee members are granted the necessary time to attend Committee meetings without any reduction in their salaries and benefits, and in a manner that does not affect the effective operation of the establishment. Committee members shall not be harmed due to their membership in the Committee.

Article 8

The establishment provides the Committee with the necessary facilities and information to enable it to perform its tasks, and the Chair of the Committee may contact the management of the establishment to obtain what the Committee may need to carry out its work.

Article 9

The minister may assign anyone he deems appropriate to attend the meetings held by those committees, to verify their compliance with these rules and what is stipulated in their executive regulations. Additionally, the establishment may appoint a representative to present what the establishment wishes to submit to the committee.
