Implementing Regulation for Regulating and Organizing Labor Inspection Activities

Chapter 1: Labor Inspection

Article 1

  • The terms and expressions mentioned in this regulation mean the meanings specified in front of each, unless the context requires otherwise:

  • Minister: Minister of Human Resources and Social Development.

  • Ministry: Ministry of Human Resources and Social Development.

  • Law: Labor Law issued by Royal Decree No. (M/51) dated 23/8/1426H, and its amendments.

  • Regulation: Implementing Regulation for the Control and Organization of Labor Inspection Activities.

  • Agency: Agency for Control and Development of Work Environment.

  • Agent: Agent of the Ministry for Control and Development of Work Environment.

  • Regional Control Administration: Administrations concerned with inspection activities in the Ministry's regional branches.

  • Labor Inspectors: Ministry employees, or other Saudis, designated by the Minister or his delegate to carry out inspection activities, and they have the powers and competencies stipulated in the Labor Law and its regulations.

  • Labor Inspection: Monitoring the application of the provisions of the Labor Law and its regulations and the decisions issued in implementation thereof in establishments subject to labor inspection; either in the field or electronically, and taking legal actions against violating establishments.

  • Electronic Inspection: Monitoring the compliance of establishments and detecting and recording violations through electronic records and data.

Article 3

  • The labor inspector must meet the following conditions:

    • 1- Must be Saudi.

    • 2- Must hold an academic qualification not less than a university degree or have at least two years of experience in inspection work.

    • 3- Must complete a sufficient training period before practicing inspection work.

Article 4

Labor inspectors are obligated - before commencing their duties - to sign a commitment according to the form prepared by the agency, which includes their commitment to perform their work with complete honesty, dedication, and impartiality, and to maintain the confidentiality of all information, data, industrial and commercial secrets, and work methods they become aware of by virtue of their work, even after leaving it, except within the scope officially requested by the Ministry.

Article 5

  • Inspectors of labor may not be replaced or excluded, nor assigned additional duties outside of supervisory work except under the following conditions:

    • A- The replacement or exclusion must be by a decision from the agent or his delegate.

    • B- The additional duties must not conflict with the inspectors' main duties.

    • C- This must not, in any way, compromise the competence and impartiality that inspectors must maintain in their relations with employers and workers.

Article 6

The labor inspector carries an accreditation card proving his work in inspection issued by the Ministry or the entity authorized by it for inspection, and he is obligated to present it when performing his duties to prove his official status as an inspector. The inspector must return the card to the agency upon leaving his inspection work.

Article 7

  • The Ministry shall make the necessary arrangements to ensure the following:

    • A- That the number of labor inspectors is sufficient to ensure the effective performance of labor inspection duties.

    • B- Providing labor inspectors with all that is necessary to perform their tasks as required.

Article 8

  • The agency undertakes the following tasks regarding inspection activities:

    • 1- Building the strategic framework for labor inspection, setting goals and indicators, and establishing the general inspection plan, its priorities, and procedures.

    • 2- Supervising and directing the inspectors' activities, and following up on inspection activities, plans, and programs.

    • 3- Preparing decisions and instructions related to labor inspection.

    • 4- Training labor inspectors, or coordinating with relevant authorities to provide them with adequate training to qualify them to perform their duties.

    • 5- Conducting tours to inspect the progress of inspection activities in the Kingdom's regions, ensuring that the ministry's branches carry out the tasks assigned to them in this regard, and taking necessary measures to ensure the achievement of objectives.

    • 6- Issuing an annual general report on the achievements of inspection in the Kingdom, specifically addressing the following topics: (employees in labor inspection, statistics on establishments subject to inspection, statistics on inspection visits, violations, and imposed penalties).

    • 7- Encouraging effective cooperation and coordination with government departments and public or private institutions that may participate in or support inspection.

    • 8- Participating in committees and meetings related to inspection.

    • 9- Performing other tasks deemed necessary by the agency.
