Regulations for Contracting, Purchasing, and Quantities of Subsistence Services for Military and Security Sectors

Introduction

  • Reference to paragraph (1) of Article (Four) of the Statute of the Expenditure and Projects Efficiency Authority issued pursuant to Council of Ministers Decision No. (389) dated 1442/7/11 AH, which includes that it is within the Authority’s jurisdiction to set policies, strategies, plans, programs, standards, and guidelines related to the Authority’s competencies in coordination with the concerned entities, and to follow up on their implementation after approval.
  • Reference to paragraph (3) of the same Article, which includes that it is within the Authority’s jurisdiction to study the details of expenditure and operational and capital practices in government agencies, in planning and operation, provide recommendations thereon, identify opportunities to enhance expenditure efficiency resulting therefrom, determine their impact on the budget of those entities, and report what needs to be reported in accordance with the regulatory procedures.
  • Reference to paragraph (2) of Article (Thirteen) of the Government Tenders and Procurement Law, and in implementation of the provisions of the Law, the Minister approves the models of tender documents, pre-qualification documents, contract templates, contractor performance evaluation forms, and any other document required by the nature of the work or procurement.
  • Based on the governmental direction towards expenditure efficiency by maximizing impact relative to spending; through optimal resource utilization and addressing various types of waste without affecting the quality of the provided service, a committee was formed of specialists in catering services and contract management, and through the combined efforts of the military and security sectors; work was undertaken to review and improve the current situation and issue contracting, purchasing, and quantity controls for catering services for the military and security sectors.
  • Based on the foregoing; the necessary considerations were set to issue controls consistent with the Government Tenders and Procurement Law issued by Royal Decree No. (M/128) dated 1440/11/13 AH and its Executive Regulations issued by the Minister of Finance Decision No. (1242) dated 1441/3/21 AH and its updated Executive Regulations issued by Ministerial Decision No. (1090) dated 1445/9/21 AH, as well as in line with the Ministry of Finance’s directions regarding the approved models for the terms of reference and specifications, which are considered a prerequisite for accepting the tendering of catering contracts through the (Etimad) platform.
  • These controls were prepared guided by a number of local and international standard criteria, including: controls on health conditions and good food practices.
  • These controls apply as complementary to the provisions of the Government Tenders and Procurement Law and its Executive Regulations and other provisions, and these controls shall not be interpreted or applied in a manner that contradicts any provision contained in the Law or the Regulations. Also, the absence of a specific provision in these controls does not exempt the entity or the contractor from complying with any legally established requirements or provisions.
  • The content of these controls does not replace any systems or legislations in force in the Kingdom of Saudi Arabia, and in case of any conflict between what is stated in these controls and any of those legislations, the latter shall prevail, and the beneficiary entities bear the responsibility for their implementation. In case of any updates to the regulations and systems, the beneficiary entities must follow up on any amendments or updates thereto.

Objectives of the Regulations

1- Improving and enhancing the quality of the beneficiary's nutritional assessment.

2- Improving and raising the quality level of preparation and operation of catering services.

3- Unifying the conditions, specifications, and purchase models among entities.

4- Enhancing competitiveness and transparency.

5- Achieving the best value for public money.

Scope of the Regulations

The scope of these regulations includes the requirements and procedures for the tendering and execution of catering contracts for the military and security sectors in the Kingdom of Saudi Arabia, and serves as a reference for all entitled parties.

Execution and Obligation

These regulations are considered a mandatory reference for military and security government entities and their affiliated and related bodies, as well as for the Expenditure and Projects Efficiency Authority to update the level of compliance with them and to announce that.

Review and Update

The Expenditure and Projects Efficiency Authority, in coordination with the military and security sectors, shall undertake the updating of these regulations and review them periodically according to relevant developments. It shall also be responsible for announcing the updated issuance of the regulations for implementation and compliance, after completing the statutory procedures.

Risks

Notice

In the event of any task for which responsibility has not been determined, the supervising authority shall determine the reference of responsibility, and in the event of any conflicting responsibilities between internal entities, the reference shall be to the supervising authority.
