Statute of the National Center for Performance Measurement

Article 1

The following words and phrases - wherever they appear in this regulation - shall have the meanings specified next to them unless the context requires otherwise:
Center: National Center for Performance Measurement.
Council: Board of Directors of the Center.
President: President of the Council.
Director: General Director of the Center.
Entities: Government entities, ministries, public authorities, funds, and entities with independent public legal personality.
Regulation: Regulation of the Center.

Article 2

1- The center enjoys legal personality and financial and administrative independence, and it serves as the reference for measuring the performance of the agencies, and it is organizationally linked to the President of the Council of Ministers.
2- The main headquarters of the center shall be in the city of Riyadh, and it has the authority to establish branches and offices within the Kingdom.

Article 3

The center aims to measure the performance of the devices by applying standardized and mandatory models, methodologies, and tools to support their efficiency and effectiveness, and to prepare periodic reports on the results of their performance.

Article 4

The center undertakes the following tasks:
1 - Building performance indicators and measurement tools for agencies, approving and continuously developing them.
2 - Supporting the processes of improving and developing government services by measuring service quality and beneficiary satisfaction.
3 - Assisting agencies in implementing their goals and strategic plans according to indicators that contribute to ensuring the achievement of their objectives, initiatives, and approved projects.
4 - Identifying and analyzing risks and challenges faced by agencies in their pursuit of achieving their goals and proposing appropriate solutions to address them.
5 - Preparing reports on the performance results of agencies, which can be utilized in reviewing and improving government performance.
6 - Promoting a culture of measuring, reviewing, and improving the performance of agencies, and enhancing their capabilities in this area.

Article 5

For the center to achieve its tasks, it may use the following means:
1 - Communicating with relevant entities to introduce the center, its objectives, and the services it provides.
2 - Conducting field visits, and preparing and organizing workshops and specialized training courses in the field of performance measurement.
3 - Engaging experts, specialists, and consultants with the required competencies in areas related to performance measurement.
4 - Establishing partnerships and cooperation agreements with relevant entities to exchange experiences and enhance the application of performance measurement systems.
5 - Adopting the best software and technological applications in the field of performance measurement.
6 - Holding meetings, seminars, and conferences specialized in the center's activities.
7 - Providing administrative consultations to entities in the field of performance measurement.
8 - Preparing studies and scientific research in the field of performance measurement and publishing them.
9 - Collaborating with universities, research centers, and specialized institutions in performance measurement at both local and international levels.
10 - Encouraging entities towards institutional excellence by providing incentives for that.
11 - Any other means that assist in achieving its objectives.

Article 6

Previous Amendments
  • 1- The center shall have a Board of Directors consisting of five members from the public or private sector, appointed by a Decision of the Council of Ministers, which shall designate the President from among them:

    • A- President of the Council of Economic and Development Affairs                                      President

    • B- Minister of Economy and Planning                                                     Member and Secretary

    • C- Minister of Civil Service                                                           Member

    • D- Minister of Finance                                                                     Member

    • E- Two Ministers of State shall be appointed by a Decision of the Council of Ministers         Members

    • F- Two members with expertise or experience shall be appointed by a Decision of the Council of Ministers.

    •  

  • 2- The President shall appoint a Deputy from among the members.

  • 3- The remuneration of the members of the Council shall be determined by a Decision of the Council of Ministers.

Article 7

1- The Council shall meet at the invitation of its President once every three months, or whenever necessary as deemed by the President of the Council, or if requested by at least one-third of its members. The invitation must be sent in writing at least seven days prior to the meeting and must include the agenda.
2 - The meetings of the Council shall be held in the presence of the majority of the members, including the President or his Deputy.
3 - Each member of the Council shall have one vote, and decisions shall be made by a majority of the votes of the Council members. In the event of a tie, the side that the President of the meeting votes for shall prevail.
4 - No member may abstain from voting or delegate another person to vote on their behalf in their absence.
5 - The discussions and decisions of the Council shall be recorded in minutes signed by the President of the meeting and the attending members. A member who objects to any decision may record their objection with justification in the minutes.
6 - The Council may invite individuals whose information and expertise are deemed beneficial to attend its sessions without having the right to vote.

Article 8

  • 1- The Council is the supreme authority of the center, responsible for supervising it and managing its affairs. It has the authority to make all necessary decisions to achieve its objectives within the framework of this regulation, and it specifically has the following powers:

    • A- Approving the general policies and strategies of the center, as well as the plans and programs necessary for their implementation.

    • B- Approving the organizational structure, administrative and financial regulations, and the regulations necessary for implementing this regulation.

    • C- Proposing draft laws related to performance measurement and submitting them according to the procedures.

    • D- Approving periodic reports on the performance results of the agencies and submitting them to the Council of Ministers.

    • E- Approving the methodologies, methods, and tools used to apply performance measurement in the agencies.

    • F- Approving the draft budget of the center, its final accounts, the auditor's report, and the annual report, and submitting what is necessary to complete the legal procedures in this regard.

    • G- Determining the financial compensation for the services provided by the center within its jurisdiction.

    • H- Approving the organization of meetings, seminars, and scientific conferences related to the center's tasks, in accordance with the organized procedures for that.

    • I- Approving the controls for the center's reliance on local and foreign expertise and consulting offices for studies and research.

    • J- Approving the rules for conducting field surveys and the necessary partnerships with other parties to support the center.

    • K- Accepting what is offered to the center in terms of gifts, aids, grants, bequests, donations, and endowments, provided that it does not conflict with the regulations governing that.

    • L- Approving the annual work plan and the operational plans of the center.

    • M- Appointing an accredited external auditor and appointing an internal financial controller.

    • N- Appointing a General Director for the center who possesses the necessary qualifications and expertise.

  • 2 - The Council may form permanent or temporary committees from among its members or others, assigning them tasks as it sees fit. The decision to form each committee specifies its chairperson, members, and responsibilities, as well as the compensation for its members.

  • 3 - The Council may delegate its chairman or any member it deems appropriate or its director some of its powers.

Article 9

The General Director of the Center shall be the executive responsible for managing the affairs of the Center, conducting its operations and responsibilities within the limits set by this regulation and the regulations issued thereunder, as well as what is decided by the Council. He shall exercise the following competencies:
1 - Supervising the workflow in the Center through the approved regulations, plans, and programs.
2 - Proposing the general policies and strategies for the Center, along with the necessary plans and programs for their implementation, and submitting them to the Council.
3 - Proposing the methodologies, methods, and tools used to apply performance measurement in the devices.
4 - Preparing the draft annual budget for the Center and the draft final account, and submitting them to the Council.
5 - Representing the Center before the judiciary, and before government entities, institutions, and other relevant bodies, as well as other entities inside and outside the Kingdom.
6 - Proposing the organizational structure and the administrative and financial regulations necessary for conducting the work in the Center, presenting them to the Council, supervising their implementation after approval, and adopting the work procedures based on the regulations and decisions issued by the Council.
7 - Issuing orders for the Center's expenditures from the annual budget, and taking financial actions in accordance with the approved systems and regulations and the powers delegated to him by the Council.
8 - Preparing reports on the implementation of the Center's plans and programs, and presenting them to the Council.
9 - Preparing the annual report for the Center, and submitting it to the Council for consideration and elevation according to the procedures followed.
10 - Signing agreements and contracts after the Council's approval, or according to the powers granted to him by the Council.
11 - Appointing employees in the Center in accordance with the powers granted to him.
12 - Supervising the Center's staff in accordance with the powers granted to him.
13 - Organizing the Center's participation in local, regional, and international conferences and events.
14 - Issuing the necessary decisions to implement the provisions of the regulation and the regulations issued based on it, as well as the approved rules and procedures, according to the powers granted to him.
15 - Approving the plans and programs necessary for training, scholarship, and sending the Center's staff in all areas of its work, and following up on their implementation.
16 - Exercising the powers granted to him by the Council's decisions and the regulations specific to the Center.
17 - The Director may delegate some of his powers to whom he sees fit among the Center's staff in accordance with the regulations.

Article 10

The exchange of device data with the center shall be conducted electronically - as much as possible - in accordance with the applicable regulations and instructions.
