Regulations of Real Estate Announcements

First

  • The following phrases and terms are defined as follows:

    • 1- The Authority: Real Estate General Authority.

    • 2- Real Estate Announcement: The visual, written, or audio announcement; for the purpose of taking action regarding the real estate by any means.

    • 3- The Advertiser: The party requesting the publication of the real estate announcement, whether the announcement is for themselves or for others by any means.

    • 4- The Electronic Real Estate Platform: The application or website and similar entities specialized in marketing the real estate announcement.

Secondly

  • Without prejudice to the competencies of the relevant authorities and the competencies of the General Commission for Audiovisual Media, the following must be adhered to in real estate announcements:

    • 1- To seek truthfulness and integrity.

    • 2- To avoid anything that may cause confusion or mislead the public.

    • 3- To comply with what is issued by the general evidence for the controls of advertising content.

    • 4- To comply with what is issued by the competent authorities regarding the regulation of ethical and media content in all its informational mediums (traditional and electronic).

    • 5- To adhere to the official names of cities, neighborhoods, streets, and types of real estate, and it is permissible to add commonly known names in addition to them.

    • 6- It must contain the following data:

      • A- A statement indicating that it is an announcement.

      • B- Specification of its purpose (sale, rent, investment, etc.).

      • C- Specification of the type of real estate.

      • D- The name of the advertiser and their status (owner, authorized representative).

      • E- The advertiser's license number if they are an office, real estate marketer, or holder of a freelance work document.

      • F- The location of the real estate, which must include -at a minimum- (city – neighborhood – plot number if available).

      • G- An effective means of communication with the advertiser.

      • H- Disclosure of real estate data as follows:

      • Area of the real estate.

      • Existing disputes regarding it – if any-.

      • Mortgage or encumbrance that prevents or limits the action or benefit from the real estate.

      • Rights and obligations on the real estate not documented in the real estate document.

      • Services related to the real estate.

      • Information that may affect the real estate, whether by reducing its value or influencing the decision of the target audience of the announcement, such as guarantees and their durations, compliance with the Saudi building code, the age of the existing real estate, and others.

      • I- If the announcement is about a real estate auction, it must – in addition to what is issued by the relevant authorities – include the auction license number, its location, conditions, the specified date for its holding, its duration, and the final date -if any- for applying to the auction.

Thirdly

The real estate announcement on the electronic real estate platform – in addition to what is stated in item (Second) – must include the following data:
1- A description of the real estate, including its type, age, contents, and any significant description, such as: the street view it is located on, the façade of the real estate, and others.
2- The boundaries and dimensions of the real estate.
3- The price of the real estate.

Fourthly

Without prejudice to the competencies of the relevant authorities, it is prohibited to include in the real estate announcement any of the following:
1- Violations of Islamic instructions or the laws and regulations in the Kingdom or prevailing customs.
2- Indecent content.
3- Violations of intellectual property rights.
4- Negative exposure towards competitors, private sector establishments, or others.
5- Phrases or indications that imply discrimination against anyone.
6- Misleading images, data, locations, or perspectives that do not pertain to the announced real estate.
7- The logo of the authority, its name, or any other government entities without prior permission from them.

Fifthly

It is prohibited to publish fraudulent real estate announcements for the purpose of collecting data from recipients, the public, or for any other purpose.

Sixthly

The real estate announcement must be removed within a period not exceeding (two days) from the date of completion or termination of its purpose.

Seventhly

The Authority supervises compliance with the provisions of these regulations and refers any violations to the competent authorities to take the necessary legal procedures regarding them.

Eighth

The following are exempt from the application of the provisions of the regulations:
1- Real estate announcements from government entities.
2- Announcements of sale or lease on the map.

Ninth

The regulations shall be published in the official gazette and shall come into effect after (90) days from the date of their publication.
