  • The Minister of Industry and Mineral Resources

  • Based on the powers granted to him by law

  • And pursuant to Royal Decree No. (M/108)dated 1447/6/3 AH, which stipulates in clause (First) the approval ofthe Unified Industrial Regulation Law for the GCC countries, and paragraph (2)of clause (Fifth) that the Minister of Industry and Mineral Resources shall issue the decision approving the Implementing Regulation of the aforementioned law referred to in clause (First), as approved by the Industrial Cooperation Committee in its (Fifty-first) meeting held in the Sultanate of Oman on 1445/2/29 AH, in accordance with the provisions ofArticle (Twenty-five) of the law.

  • Decides the following:

    • First: Approval of the Implementing Regulation of the Unified Industrial Regulation Law for the GCC countries in the attached form.

    • Second: This decision shall repeal any provisions that conflict with it.

    • Third: This decision shall be published in the Official Gazette and shall come into effect ninety (90) days after its publication.

    • And God is the Grantor of success.

Preamble

  • Industrial Cooperation Committee:

  • After reviewing the Charter of the Cooperation Council for the Arab States of the Gulf, the Economic Agreement between the GCC countries approved by the Supreme Council in its twenty-second session in 2001, especially Article Eight thereof, and the Unified Industrial Regulation Law for the GCC countries approved by the Supreme Council in its 43rd session in 2022.

  • And the Implementing Regulation of the Unified Industrial Regulation Law for the GCC countries approved by the Industrial Cooperation Committee in 2009.

  • The Industrial Cooperation Committee approved in its fifty-first meeting held on Thursday29Safar 1445 AH corresponding to 14 September2023in the city of Salalah in the Sultanate of Oman, the Implementing Regulation of the Unified Industrial Regulation Law for the GCC countries, the text of which is as follows:

Chapter 1: General Provisions

Article 1: Definitions

The words and phrases contained in this Regulation shall have the meanings set forth in the Unified Industrial Regulation Law for the GCC countries.

Article 2: Scope of Application

  • Subject to the provisions of Article Two of the Law, the following industrial projects are exempted from its provisions:

    • 1- Projects operating in the field of oil exploration and extraction.

    • 2- Projects operating in the field of extracting mineral ores without altering their content or form.

Chapter 2: Industrial License

Article 3: Data Required to Obtain Preliminary Approval

  • The applicant for the industrial license must obtain the preliminary approval for the industrial project from the administration, and the administration may require the applicant to include the following data in his application:

    • 1- The trade name of the project.

    • 2- The name of the project owner and his nationality.

    • 3- The legal form of the industrial project.

    • 4- The intended industrial activity to be established, its production capacity, and a statement about the industrial product.

    • 5- The capital invested in the project.

    • 6- Any other data or documents requested by the administration.

Article 4: Approval of the Request for Preliminary Approval

  • The administration shall decide on preliminary approval requests within a maximum period of thirty days from the date of submission, provided that all data and documents are complete. The applicant shall be notified of the response within thirty days from the date of issuance of the decision. If the decision is to reject the request, it must be justified. The expiration of sixty days from the date of submission of the request without a response shall be considered an implicit rejection.

Article 5: Submission of the Industrial License Application and Related Matters

  • The license application for establishing an industrial project, changing its production, expanding it, developing it, merging it with another, dividing it, changing its location, or disposing of it wholly or partially shall be submitted by the owner of the industrial project using the forms prepared for this purpose by the administration.

  • The Council's countries have adopted electronic systems and forms for submitting license applications.

Article 6: Registration of Industrial License Applications

The administration shall maintain a special register for recording industrial license applications with serial numbers according to the order of their receipt, in accordance with the regulations and procedures of the competent authority. Each entry shall indicate the date of application submission, the date of registration in the register, the name of the industrial project owner, the trade name, address, and the type of industrial activity.
