Rules for the Application of the Law of the Protection of Public Facilities related to roads under the supervision of the Ministry of Transport and Logistic Services

Section 1: Industrial Works Related to Roads and Their Reserves

Article 1

  • The industrial works referred to in Article Seven of the Public Utilities Protection System include all that is constructed above, below, or alongside public roads, such as bridges, culverts, pipes, overhead and underground passages, fences, barriers, retaining walls, coverings, cables, poles, and other facilities related to the roads.

Article 2

  • The term "road reserve" refers to the full width of the asphalt road itself, including the medians, shoulders, and sides, calculated according to the road design and the distances stipulated in the decisions and orders issued in this regard.

Section 2: Extension of Public Services

  • It is prohibited to carry out any works on public roads that have been implemented and their restrictions, or on designed road paths or their restrictions, such as extensions for water, electricity, and telephone, as well as rainwater drainage and sewage pipes, except after coordinating with the Ministry of Transport and obtaining the necessary permit from them.

Article 4

Previous Amendments
  • A) The special services [for water, electricity, telephone, etc.] shall be extended outside the right-of-way of the roads overseen by the Ministry of Transportation due to the possibility of future expansion, and there is no possibility of carrying out maintenance work as required. If this is not feasible due to the presence of owned lands or natural conditions, coordination shall be made with the Ministry of Transportation to study alternative solutions for the required extension route.

  • In the event of any violations or observations regarding the execution that have not been rectified within the timeframe specified by the Ministry for the contractor, the Ministry shall deduct an amount equivalent to the value of these observations from the value of the guarantee and rectify them at the contractor's expense, and return the remaining guarantee to the issuing bank.

Article 6

  • Application regarding the extensions of public utilities implemented on public roads and their sanctity, conditions, and specifications - Extension of services on public roads attached to these regulations.

Section 3: Investigation of Violations

Article 7

Previous Amendments
  • The investigation into violations that cause damage to roads and the industrial works executed therein shall be conducted according to the substantive procedures by the committee formed by representatives from the Ministries of Interior, Transport, Municipal and Rural Affairs, Agriculture, Water, Industry, Electricity, Telecommunication, and Postal Services, as approved by the decision of His Royal Highness the Minister of Interior No. 94 dated 5/1/1407 AH attached to these regulations.
