Executive Rules of the Law of the Protection of Public Facilities

  • Based on the powers vested in him by law

  • After reviewing paragraph (B) of Article Thirteen of theLaw of the Protection of Public Facilities, issued byRoyal Decree No. (M/62) dated 20/12/1405 AH, which stipulates (Compensations shall be estimated, fines imposed, procedures for their regulation determined, and the amount of the fine for each violation set within its maximum limit stipulated in this law according to rules issued by the competent minister), and Article Fourteen of the law which stipulates (The concerned ministers responsible for implementing this law shall each, within their jurisdiction, issue the necessary decisions for its implementation).

  • After reviewing the Violations and Fines Regulation for Water, Sewage, and Flood Facilities and the Rules for their Regulation Procedures, issued by Ministerial Decision No. 52240 dated 21/12/1419 AH

  • It is decided as follows:

  • First: Approval of the executive rules for the Law of the Protection of Public Facilities in the attached form to this decision.

  • Second: This decision repeals the Violations and Fines Regulation for Water, Sewage, and Flood Facilities and the Rules for their Regulation Procedures, issued by Ministerial Decision No. 52240 dated 21/12/1419 AH

  • Third: This decision shall be communicated to whoever is necessary for its implementation.

Article 1: Definitions

  • The following terms - wherever they appear in these regulations - shall have the meanings specified next to each of them, unless the context of the text requires otherwise:

    • Law: Law for the Protection of Public Facilities.

    • Ministry: Ministry of Municipalities and Housing.

    • Minister: Minister of Municipalities and Housing.

    • Competent Authority: The municipality or the secretariat according to the territorial jurisdiction of each entity, or the relevant authorities according to the jurisdiction.

    • Head of the Competent Authority: The trustee or the mayor.

    • Road: All components of the road (within the urban area), including road reserves, asphalt, medians, shoulders, parking areas, sidewalks, lighting, directional signs, signals, and kilometer markers, as well as everything that is constructed above, below, or alongside public roads, including bridges, culverts, pipes, overpasses, underpasses, fences, barriers, walls, coverings, cables, poles, and others.

    • Stormwater Drainage Channels: All related to stormwater, including channels, drainage lines, openings, covers, and pumps designated for stormwater drainage, among others.

    • Violator: A natural or legal person who commits any violation of the provisions of the law and its executive regulations.

    • Flooding: The inundation of public roads or their reserves to an extent that causes their disruption or prevents the full or partial benefit from them.

Article 2

  • The violator is required to compensate for all damages incurred by the facility or others, including the costs of repairing the damage caused, and compensation for the benefit lost by the facility or others. The competent authority may require the violator to repair what results from their violation, or to carry out the repairs at the violator's expense, and the violator shall be liable for all expenses and costs necessary to remove the trespassing and repair the damages resulting from it. If the violator does not pay, the amounts will be collected according to the State Revenue System.

Article 3

  • The relevant authorities, departments, and companies responsible for managing any public facilities are obligated to provide the facility plans and the instructions prepared for its protection to those who request them from the concerned parties, and they shall be responsible for the accuracy of the instructions and plans they provide.

Article 4

  • The damages caused to the road or its facilities as a result of traffic accidents require the violator to pay the costs of repairs and the damages resulting from the violation in proportion to their responsibility for the accident according to the report of the relevant authority.

Article 5

  • Anyone who intentionally damages, cuts, or disrupts the road or drainage channels shall be punished with a fine of (75%) seventy-five percent of the cost of repairing the damage, provided that the fine does not exceed one hundred thousand Riyals, whether the perpetrator is the principal or an accomplice.

  • This does not prevent the completion of the legal procedures to refer the responsible party to the competent court.

Article 6

  • Anyone who causes damage, cutting, or disruption to road extensions or stormwater drainage channels as a result of carrying out other works related to any public utilities without prior coordination with the competent authority and obtaining a license for that shall be punished with a fine of (10%) ten percent of the repair costs, provided that the fine does not exceed (100,000) one hundred thousand Riyals.

  • If coordination has been made with the competent authority and the necessary license has been obtained, the fine shall be (5%) five percent of the repair costs, provided that it does not exceed (100,000) one hundred thousand Riyals.

Article 7

  • Anyone who trespasses on any road or drainage channels with the intent to unlawfully benefit from their services, or causes cuts or excavations in them, or takes soil from them, or damages them, shall be punished with a fine equivalent to the costs of removing the trespass and restoring the situation to its previous state, provided that the fine does not exceed (50,000) fifty thousand Riyals.

Article 8

  • Anyone who encroaches upon the road by flooding it with water or otherwise, or who performs an act that results in its obstruction or prevents its full or partial use, such as dropping dirt or stones onto it from vehicles or otherwise, shall be punished with a fine of (3000) three thousand Riyals.

Article 9

  • Anyone who facilitates for others to unlawfully benefit from the road or drainage channels shall be punished with a fine of (2000) two thousand Riyals.
