Pursuant to Article (Seventy) of the Basic Law of Governance, issued by Royal Order No. (A/90) dated 27/8/1412 AH.
Pursuant to Article (Twenty) of the Council of Ministers Law, issued by Royal Order No. (A/13) dated 3/3/1414 AH.
Pursuant to Article (Eighteen) of the Shura Council Law, issued by Royal Order No. (A/91) dated 27/8/1412 AH.
Having reviewed the Shura Council Resolutions No. (32/117) dated 20/7/1440 AH and No. (4/188) dated 21/10/1440 AH.
Having reviewed Council of Ministers Resolution No. (649) dated 13/11/1440 AH.
We have decreed as follows:
First: Approval of the Government Tenders and Procurement Law, in the form attached hereto.
Second: The continued application of Articles (Sixty-One, Sixty-Two, and Sixty-Three) of the Government Tenders and Procurement Law, issued by Royal Decree No. (M/58) dated 4/9/1427 AH, and Chapter (Nineteen) of its Implementing Regulations, concerning the regulation of the rules for leasing and investing government real estate and the provisions related thereto, until the issuance and entry into force of the law governing the leasing and investment of real estate.
Third: The Committee formed pursuant to Article (Seventy-Eight) of the Government Tenders and Procurement Law, issued by Royal Decree No. (M/58) dated 4/9/1427 AH, shall continue to consider contractors’ and suppliers’ claims for compensation and requests to prohibit dealings with them, registered with the Committee before the Law enters into force, until such claims and requests are finally determined.
Fourth: Requests for the extension of contracts and the handling of cases of delay in the implementation of matters preceding the issuance of the Law shall be considered in accordance with its provisions. The Ministry of Finance shall complete the processing of requests submitted before the issuance of the Law in accordance with the procedures previously in force.
Fifth: Without prejudice to the provisions of Item (Fourth) of this Decree, the Law shall apply to works and procurements tendered before its entry into force in accordance with a mechanism established by the Minister of Finance, without prejudice to the procedures taken regarding such works and procurements before its entry into force.
Sixth: The Minister of Finance is delegated the following powers:
- 1- To approve a mechanism for making available and applying the contracting and procurement mechanisms and methods, the forms of tender documents, and the standards stipulated in the Law. The Minister of Finance shall have the authority to extend the period for one additional year based on his assessment of the readiness of government entities for implementation by the end of the initial period.
- 2- To approve the continuation of applying the exemptions, with respect to Vision Realization Programs, from the application of the Law, for a period ending at the end of the next fiscal year, provided that the Minister of Finance, in agreement with the Strategic Management Office of the Council of Economic and Development Affairs, submits to the Council of Ministers, six (6) months before the end of the aforementioned period, a proposal regarding the continued application of the Regulations after the expiry of that period.
Seventh: By way of exception to the provision of Article (Ninety-Nine) of the Law, the provisions of Paragraph (4) of Article (Seventeen) of the Law shall apply as of the date of its issuance.
Eighth: His Royal Highness the Deputy Prime Minister, the ministers, and the heads of the relevant independent entities—each within his respective jurisdiction—shall implement this Decree.
