Regulations of Public Tourist Places

Chapter 1: Definitions

Article 1

The words and phrases mentioned below, wherever they appear in this Regulation, shall have the meanings specified next to them, unless the context requires otherwise:
Law: Tourism Law.
Regulation: Regulation of public tourist places issued in implementation of the Law, and any related issuances.
Authority: General Authority for Tourism and National Heritage.
Board of Directors: Board of Directors of the Authority.
Chairman of the Board: Chairman of the Board of Directors.
President: President of the Authority.
Public tourist places: Public natural places (not privately owned) such as beaches and similar locations, as well as places proposed by the Authority in accordance with the Regulation, and approved by the Council of Ministers.
Tourism development sites: Sites proposed by the Authority according to standards and controls it establishes, and are prepared for approval as public tourist places.
Government lands: State lands not designated for tourism exploitation, and are not considered public tourist places, which the Authority proposes to be utilized for tourism purposes.
Technical Committee: Responsible for studying the feasibility of proposing sites to be approved as public tourist places.
Competent Administration: General Administration for the Development of Tourist Sites.
Relevant Authorities: Government entities that have powers or regulatory authorities over public tourist places or government lands.
Investment Committee: Responsible for studying the feasibility of tourism investment in certain government lands, and providing opinions regarding the investment of relevant authorities in public tourist places.
Tourism activity: Any work, service, commercial, recreational, artisanal, or cultural heritage activity with a tourism character practiced in public tourist places, government lands, or privately owned sites.
Investment model: The investment method agreed upon between the entity to which the government lands belong and the Authority, for the tourism investment of those lands by the private sector.

Chapter 2: Public Tourist Attractions

Chapter 3: Rules for Proposing Public Tourist Locations

Article 3

The authority shall take into account when determining the relevant entities to coordinate with in the event of proposing locations as public tourist sites the following:
1- The authorities and powers granted to each entity in accordance with the applicable regulations, orders, and decisions.
2- The approval of the relevant entities regarding security or environmental aspects for the use and exploitation of these locations.
3- The affiliation of the neighboring or nearby locations to these sites.

Article 4

1- A Committee or several Technical Committees shall be formed by a decision of the President, consisting of representatives from the Authority and relevant entities, as follows:
A) (4) Four members from the Authority with expertise and experience.
B) (3) Three members from the relevant entities.
2- The decision shall specify the Chairperson of the Committee, its Vice-Chairperson, and the duration of its work.

Article 5

The Committee is responsible for studying the proposed sites as public tourist locations, according to the standards and regulations set by the Authority. Its responsibilities include the following:
1- Determining the suitability of the proposed sites to be public tourist locations in accordance with the regulations established by the Authority.
2- Studying the proposed tourism activities to be established, and any standards or regulations for tourism development that affect the sustainability of public tourist locations and their preservation.
3- Addressing the conditions of the proposed sites as public tourist locations in the event they are invested in a manner that does not comply with the provisions of the Law and the Regulation.

Article 6

1- The Committee holds its meetings in the presence of the majority of its members, including the President of the Committee. Its recommendations are issued by a majority of the votes of the attending members, and in the event of a tie, the side that the President of the Committee voted with shall prevail.
2- The Committee may seek assistance from whomever it deems necessary to help it perform its duties, and invite them to attend its meetings without having the right to vote.
3- The Committee submits its recommendations to the President for consideration and to take the necessary actions.

Article 7

The recommendations of the Specialist Committee are presented, through the President, to the Board of Directors, and in the event of approval
by them, the Authority submits a list to the Council of Ministers regarding the proposed sites as public tourist locations for their endorsement.
