Statute on the Periodic Technical Inspection of Vehicles

  • The Council of Ministers

  • Having reviewed the submission received from the Royal Court under No. 49929 dated 1441/8/27 AH, which includes the telegram of His Royal Highness the Minister of Interior No. 143997 dated 1439/6/18 AH, concerning the draft Statute of Periodic Technical Inspection of Vehicles.

  • Having reviewed the aforementioned draft Statute.

  • Having reviewed the Statute of the Saudi Standards, Metrology and Quality Organization, issued by Council of Ministers Decision No. (216) dated 1431/6/17 AH.

  • Having reviewed Minutes Nos. (12) dated 1440/1/6 AH, (193) dated 1440/2/5 AH, (827) dated 1440/5/9 AH, and (680) dated 1441/5/17 AH, and Memoranda Nos. (88) dated 1442/1/19 AH and (800) dated 1442/5/16 AH, prepared by the Bureau of Experts at the Council of Ministers.

  • Having considered Shura Council Decisions Nos. (52/202) dated 1440/11/6 AH and (36/176) dated 1441/8/22 AH.

  • Having reviewed the recommendation prepared by the Council of Economic and Development Affairs No. (10 - 42/22 /D) dated 1442/6/1 AH.

  • Having reviewed the recommendation of the General Committee of the Council of Ministers No. (4124) dated 1442/6/22 AH.

  • Hereby decides as follows:

    • First: Approval of the Statute of Periodic Technical Inspection of Vehicles, in the accompanying form.

    • Second:

      • 1- Without prejudice to the powers of the Board of Directors of the Saudi Standards, Metrology and Quality Organization and its Chairman, the Board of Directors of the Saudi Standards, Metrology and Quality Organization shall assign the duties entrusted to the Organization under the provisions of the Statute of Periodic Technical Inspection of Vehicles to a permanent executive committee formed within the Organization for this purpose, chaired by the Governor of the Saudi Standards, Metrology and Quality Organization or his delegate, with the membership of the Director General of the General Department of Traffic at the Ministry of Interior or his delegate (as Vice Chairman), and other members—designated by the Board—whose number shall not be fewer than (two) from the government entities represented on the Board of Directors of the Organization.
      • 2- The Board of Directors of the Saudi Standards, Metrology and Quality Organization shall issue the rules governing the work of the permanent executive committee, the convening of its meetings, and the adoption of its decisions.
      • 3- The permanent executive committee shall undertake any other task assigned to it by the Board of Directors of the Saudi Standards, Metrology and Quality Organization relating to its duties, provided that this does not conflict with the provisions of the Statute of Periodic Technical Inspection of Vehicles, its Implementing Regulations, or the relevant statutory provisions.
      • 4- The Board of Directors of the Saudi Standards, Metrology and Quality Organization may, for reasons it deems appropriate and to the extent necessary, authorize any other entity to undertake some of the duties entrusted to the permanent executive committee for the implementation of the provisions of the Statute of Periodic Technical Inspection of Vehicles and its Implementing Regulations.
      • 5- Government entities concerned with the periodic technical inspection system shall cooperate with the permanent executive committee in carrying out its duties.
    • Third: The Chairman of the Board of Directors of the Saudi Standards, Metrology and Quality Organization shall submit a report to the Council of Ministers three (3) years after the Statute of Periodic Technical Inspection of Vehicles enters into force, including the results of the implementation of the provisions of the Statute and its Implementing Regulations, and the number of licenses granted throughout the Kingdom to specialized and qualified inspection entities, including companies, establishments, and technical workshops, to conduct periodic technical inspection activities.

Article 1

  • The following words and phrases, wherever they appear in this Statute, shall have the meanings set forth opposite each of them, unless the context requires otherwise:

    • 1. Statute: Statute for Periodic Technical Inspection of Vehicles.
    • 2. Regulation: Implementing Regulation of the Statute.
    • 3. President: President of the Board of Directors of the Saudi Standards, Metrology and Quality Organization.
    • **4. Governor: **Governor of the Saudi Standards, Metrology and Quality Organization.
    • 5. Organization: Saudi Standards, Metrology and Quality Organization.
    • 6. Periodic Technical Inspection: The process of subjecting a vehicle, tractor, trailer, and semi-trailer to periodic technical inspection in accordance with specific requirements and specifications on a technical basis.
    • 7. Vehicle: A means of transport traveling on the road network.
    • 8. Tractor: A vehicle connected to a trailer, together constituting one unit.
    • 9. Trailer: A vehicle without an engine that is towed by another motor vehicle.
    • 10. Semi-trailer: A trailer a substantial portion of whose weight rests on the tractor.
    • **11. Inspection Entity: **A station, center, or workshop licensed to conduct periodic technical inspection.
    • **12. Station: **A technical inspection entity licensed pursuant to the Statute to inspect vehicles, tractors, trailers, and semi-trailers, including those carrying hazardous materials, and comprising five or more lanes.
    • 13. Center: A technical inspection entity licensed pursuant to the Statute to inspect vehicles, tractors, trailers, and semi-trailers, except those carrying hazardous materials, and comprising four or fewer lanes or five or more inspection units.
    • **14. Workshop: **A technical inspection entity licensed pursuant to the Statute to inspect vehicles only, and comprising two or fewer lanes or two or fewer units.
    • **15. Lane: **A lane equipped with periodic technical inspection equipment and devices.
    • **16. Unit: **A fixed location where periodic technical inspection is conducted.
    • 17. Hazardous Materials: Solid, liquid, or gaseous materials with properties harmful to human health or that adversely affect the environment due to their chemical, physical, or biological properties.
    • 18. Program: An electronic program for periodic technical inspection.
    • 19. Acceptance: An assessment conducted by the Organization regarding the adequacy of an inspection entity in the field of providing periodic technical inspection services, based on the administrative and technical provisions specified in the Regulation for the Acceptance of Conformity Assessment Bodies issued by a resolution of the Organization’s Board of Directors.
    • **20. Mobile Periodic Technical Inspection: **An inspection entity possessing a mobile system that conducts periodic technical inspection of moving vehicles, tractors, trailers, and semi-trailers by means of specialized technical devices.

Article: 2

  • The Authority shall license the inspection entity to engage in the activity of periodic technical inspection, in accordance with the geographical areas specified by the Authority within the Kingdom and according to the classification it deems appropriate, after the following requirements have been met:

    • A- A commercial register for the provision of periodic technical inspection services.
      B- Approval from the Authority.
      C- A municipal license in accordance with the conditions governing the same.
      D- A safety license from the General Directorate of Civil Defense, in accordance with the conditions governing the same.
      E- Fulfillment of the requirements and regulations that must be met at the inspection entity’s premises, in accordance with the Regulation.

Article: 3

  • The Authority shall grant the necessary licenses to inspection entities wishing to provide mobile periodic technical inspection services, and the Regulation shall specify the provisions necessary for this purpose.

Article 4

    1. The Authority shall take the necessary measures to technically link the issuance of the License with the National Information Center.
    1. The Authority shall issue a separate License for each inspection entity.

Article 5

  • The activities of the inspection entity must be limited to detecting technical defects in the vehicle, tractor, trailer, and semi-trailer, and any malfunctions that may occur therein. The inspection entity must not engage in any maintenance or repair activities or in the sale or purchase of spare parts.

Article 6

  • The periodic technical inspection of the vehicle, tractor, trailer, and semi-trailer shall be conducted in accordance with the instructions, technical regulations, and relevant standard specifications issued by the Authority.

Article: 7

    1. The program shall adopt the modern concept of the technical inspection of vehicles, tractors, trailers, and semi-trailers, particularly as follows:
    • A- The technical and administrative integration of the inspection entity’s program within an electronic environment.
    • B- The inspection entity shall comply with modern computer technologies to technically link all periodic technical inspection procedures in order to ensure quality and speed of performance.
    • C- Advanced training programs that interact with developments.
    1. The electronic system -used in the program- shall ensure effectiveness and practicality in providing services throughout all inspection stages, while providing a technical connectivity service with the Authority and the relevant entities.

Article 8

  • The Inspection Entity shall provide the Program with comprehensive preventive maintenance, including equipment and device calibration programs at various levels, to support all devices of the Periodic Technical Inspection Entity and maintain their readiness and accuracy. The Authority shall monitor the Inspection Entity’s compliance with this requirement.

Article 9

  • The Authority’s Board of Directors shall propose the fee collected by the inspection entity for conducting the periodic technical inspection, and the President shall submit it to the Council of Ministers for approval.
