General Technical Regulation for Energy Consumption Efficiency

Preamble

  • In line with the Kingdom of Saudi Arabia's accession to the World Trade Organization according to the Council of Ministers decision No. 244 dated 1426/9/21 AH regarding the approval of the Kingdom's accession documents to the World Trade Organization, and what is required by the order for the Kingdom to align its related laws with the principles of the organization's agreements, especially the Agreement on Technical Barriers to Trade (TBT) which stipulates not to impose unnecessary technical requirements on the flow of goods between member states, and not to discriminate between products of different origins in terms of technical requirements and conformity assessment methods by issuing technical regulations that include legitimate essential requirements and unify work procedures.

  • Based on Article Three (Paragraph - 1) of the Statute of the Saudi Standards, Metrology and Quality Organization issued by the Council of Ministers decision No. 216 dated 1431/6/17 AH corresponding to 2010/5/31AD, whereby the organization shall "issue Saudi standards, quality systems, and conformity assessment guides, in line with international standards and guides, fulfilling the requirements of the WTO and compatible with Islamic law and serving the interests of the Kingdom."

  • Pursuant to Article Four (Paragraph - 2) of the Statute of the Saudi Standards, Metrology and Quality Organization issued by the Council of Ministers decision No. 216 dated 1431/6/17 AH corresponding to 2010/5/31AD, whereby the organization shall "issue conformity assessment procedures regulations for goods, products, and services according to the standards it adopts."

  • Based on Article Four (Paragraph - 14) of the Statute of the Saudi Standards, Metrology and Quality Organization issued by the Council of Ministers decision No. 216 dated 1431/6/17 AH corresponding to 2010/5/31 AD, whereby the organization shall "review the regulatory systems and regulations related to the organization's fields of work, develop them, propose necessary amendments to them, to keep pace with quality and safety requirements, and refer them to the competent authorities for study and issuance according to legal procedures."

  • Based on Article Six (Paragraph -1) of the Statute of the Saudi Standards, Metrology and Quality Organization issued by the Council of Ministers decision No. 216 dated 1431/6/17 AH corresponding to 5/31/ 2010AD, whereby the organization shall "with due regard to what is stated in Article Four of this statute, the organization is the reference in the Kingdom for all matters related to standards, conformity assessment procedures, granting the quality mark, measurement, and calibration. All government and private sectors must adhere to Saudi standards in all their purchases."

  • Since the standards for products included in one of the regulations are considered the basis for the conformity of those products to the essential safety requirements in the specified regulation.

  • The organization has prepared this technical regulation.

  • Note: This preamble and all annexes to this regulation are an integral part of it.

Article 1: Terms and Definitions

  • 1/1The titles and phrases below - when applying the provisions of this regulation - have the meanings and indications shown opposite them, unless the context requires otherwise:

  • Authority: Saudi Standards, Metrology and Quality Organization.

  • Council: Board of Directors of the Authority.

  • Kingdom: Kingdom of Saudi Arabia.

  • Granting Authority: The competent authority within the Authority or any conformity assessment body accepted by the Authority.

  • Regulatory Authorities: The governmental authority/authorities with regulatory tasks according to their jurisdiction and responsible for implementing or monitoring the implementation of technical regulations, whether at customs ports, markets, or factories.

  • Accepted Authorities: Conformity assessment bodies accepted by the Authority according to the regulation for accepting conformity assessment bodies.

  • Technical Regulation: A document approved by the Board of Directors that sets the characteristics of products and related processes and production methods, including applicable administrative provisions that must be adhered to. It may include or specifically address terms, definitions, packaging, and requirements for placing marks or labels on products, services, processes, or production methods.

  • Standard Specification: A document that specifies the characteristics of a commodity, material, service, or anything subject to measurement, or their descriptions, properties, quality level, dimensions, and measurements, or safety and security requirements. It also includes terms, symbols, test methods, sampling, packaging, data labels, and marks.

  • Essential Requirements: Requirements specific to products that may affect safety, health, and the environment, which must be adhered to.

  • Market Surveillance Authorities: The governmental authority/authorities responsible for conducting market surveillance operations.

  • Market Surveillance: Activities and measures taken by market surveillance authorities to verify that products meet the requirements stipulated in the relevant technical regulations and do not pose a risk to health, safety, the environment, or any other aspect related to protecting the public interest.

  • Hazard(sHazard(s: A potential source of harm.

  • Risks(s)Risk: The likelihood of a hazard causing harm associated with the severity of the harm.

  • Supplier: Refers to the following:

    • - The manufacturer of the product, if residing in the Kingdom, or any person presenting their identity as the manufacturer of the product by naming the product in their name or any related commercial description, as well as any person renewing the product.

    • - The manufacturer's agent in the Kingdom if the manufacturer resides outside the Kingdom, or the importer if there is no manufacturer's agent in the Kingdom.

    • - Any person in the supply chain whose activity may affect the characteristics of the product.

  • Supplier's Declaration of Conformity: A declaration by the supplier themselves that their product complies with the applicable legislation, without any mandatory third-party intervention - neither in the design phase nor in the production phase of the manufacturing process. The declaration may rely on product tests according to the relevant legislation.

  • Saudi Quality Mark: A mark approved by the Authority indicating that the establishment has an effective management system ensuring the production of a commodity in compliance with the general regulation for the quality mark and its specific Saudi standard specification.

  • Placing on the Market: The first placement of the product in the Kingdom's market, for which the manufacturer or importer is responsible.

  • Offering on the Market: Means any supply of the product for distribution, consumption, or use in the Kingdom within a commercial activity, whether for monetary compensation or free of charge.

  • Withdrawal: Any action aimed at preventing products from being offered in the market and in the supply chain.

  • Recall: Any action aimed at retrieving products that have been made available to the end user.

  • Energy Efficiency Specifications: A Saudi standard specification approved by the Board of Directors, aimed at rationalizing the electrical energy consumption of a product or category of products to preserve the national economy and its gains, as well as reducing consumption for the average consumer, by providing scientific and practical means based on international standard specifications and benefiting from outstanding international practices in this field.

  • Products: Devices, tools, and equipment that the Board of Directors of the Authority decides to mandatorily apply this regulation to, as specified in Annex (1).

  • Label: A label affixed to products indicating the efficiency of devices and tools in energy consumption according to the model specified in this regulation and the energy efficiency specifications specific to the product, or any other standard specification determined by the Authority.

  • Energy Efficiency Certificate for the Model: A certificate issued by the Authority or an authorized body indicating that the concerned product meets the relevant energy efficiency specifications.

  • License to Use the Label: A license issued by the Authority or an authorized body to use and affix the label on products that meet the requirements of this regulation.

  • Model: A category of the product with the same physical properties (shape, capacity, size...) and specific technical properties, with a special number used as a reference for each product granted the license to use the label.

  • Related Systems: Systems approved by the state or the Board of Directors of the Authority to combat fraud, deceit, misleading, or misuse of the license, or systems that regulate the commercial exchange of products, or any other systems.

  • Registered Laboratory: A laboratory accredited according to ISO 17025 by a recognized accreditation body in the field of energy efficiency, registered by the Authority to accept reports issued by it in the procedures for licensing the use of the energy efficiency label.

  • Test Report: A test report issued by a registered laboratory, provided that no more than six months have passed since its issuance when applying for the license.

  • 2/1 Other words and phrases mentioned in this regulation have the meanings provided in the systems, regulations, and decisions in force at the Authority.

Article 2: Scope

This regulation applies to all products for which a decision is issued by the Board of Directors mandating the application of the Energy Efficiency Program, in accordance with the definitions and terms mentioned in Article (1) and the energy consumption efficiency specifications of the product.

It should be noted that fulfilling the requirements of this regulation does not exempt from the obligation to comply with the technical regulations/standard specifications related to safety that define the essential requirements for the concerned product.

Article 3: Objectives

This regulation aims to rationalize energy consumption to preserve resources and the national economy and its gains, in addition to reducing costs for the ordinary consumer, alongside the application of product-specific technical regulations that define the essential requirements and conformity assessment procedures that suppliers must adhere to, to ensure the compliance of these products, and to maintain the safety and health of the consumer and the safety of the environment, and to facilitate market survey procedures.

Article 4: Requirements for Obtaining an Energy Efficiency Certificate for the Model

  • The authority grants the Energy Consumption Efficiency Certificate for the model, when the following conditions are met:

    • A) The supplier must be officially registered with the competent official authority and hold a commercial registration number.

    • B) The product must have completed all conformity assessment procedures that prove its compliance with the technical regulations related to product safety.

    • C) The product listed under the scope of this regulation must meet its requirements and the related energy consumption efficiency specifications.related.

    • D) The manufacturer must have an effective quality management system, and obtaining the ISO certificate9001 covers the requirement of this clause.

    • E) The supplier must provide a declaration of conformity as stated in Annex (3) and a test report according to the related energy efficiency specifications.

    • F) The supplier must cooperate with regulatory bodies and market surveillance authorities, such as providing technical file documents, test reports, and any other documented information proving compliance with the Energy Consumption Efficiency Certificate requirements for the model, whenever requested.

    • G) In case the energy consumption efficiency specifications of the product indicate the necessity of affixing the label on the product and/or its packaging, it must be affixed in the manner specified by the authority in terms of type and grade, according to what is stated in Article (6) of this regulation and the related energy consumption efficiency specifications.

    • H) All information used in placing the label must be correct and verified.

Article 5: Steps to Obtain an Energy Efficiency Certificate for the Model

  • 1/5 Submission of the Claim

  • To obtain an Energy Efficiency Certificate for the model, the supplier must follow the following steps:

    • A) Submit an independent claim to the authority for each model of products for which an Energy Efficiency Certificate is required.

    • B) Fill out the forms annexed with the energy efficiency specifications of the concerned product, and provide the authority with any other additional documents upon request.

    • C) Attach the technical file including test reports that prove the product's compliance with the energy efficiency specification from a registered laboratory, along with a copy of the valid attesting certificate.

    • D) Attach conformity assessment documents that demonstrate the product's compliance with the relevant Saudi technical regulation.

    • E) The supplier shall submit a semi-annual report to the authority; including the sales quantity in the Kingdom for products that have obtained the Energy Efficiency Certificate for the model, while the authority maintains the confidentiality of this information.

    • F) The supplier, when submitting a claim for obtaining the Energy Efficiency Certificate for the model, must provide the authority with any data related to the specific product in the claim, and facilitate the task of obtaining a representative sample of the model when needed, for the purpose of verifying its compliance with the energy efficiency specifications related to the product, at his own expense.

    • G) The supplier must acknowledge that all data provided to the authority is correct and under his responsibility.

    • H) The supplier must pay the authority the costs incurred for the process of granting the Energy Efficiency Certificate for the model.

  • 2/5 Granting the Energy Efficiency Certificate for the Model

  • The authority carries out the following procedures to grant the Energy Efficiency Certificate for the model:

    • A) The authority studies the documents according to the granting procedure for the Energy Efficiency Certificate for the model approved by the authority for this purpose for each product, to verify that the claim meets all the requirements for obtaining the Energy Efficiency Certificate for the model.

    • B) The authority verifies the product's compliance with the requirements of this regulation, according to the conformity assessment model (1a) "Model Approval" shown in the annex (2), in addition to verifying the product's compliance with the essential requirements according to the relevant technical regulation.

    • C) The authority issues the Energy Efficiency Certificate for the model after the product meets all the requirements stated in this regulation.

    • D) Notify the supplier in writing in case of rejection of his claim with an explanation of the reasons.

    • E) When the supplier meets all the requirements and completes all the required corrections within the specified period in the related granting procedure, the authority issues the Energy Efficiency Certificate for the model.

    • F) The granting procedure for the concerned product determines the costs incurred for the process of granting the Energy Efficiency Certificate for the model.

    • G) The authority has the right - when necessary - to withdraw samples from random shipments of imported or locally manufactured products and test them in a registered laboratory, with the supplier bearing the costs of sample withdrawal and testing and related matters.

    • H) The validity period of the Energy Efficiency Certificate for the model is one year, renewable, provided that the supplier submits a renewal claim for the certificate at least one month before its expiration date.

Article 6: License to Use the Card

Article 7: Metrological Requirements

International System of Units (SI Units) or their multiples or subdivisions must be used during design, manufacturing, or trading.

Article 8: Responsibilities of Regulatory Authorities (Ports - Factories)

  • The regulatory authorities, as part of their jurisdiction and powers, shall do the following:

    • A) Ensure the procedures for affixing the label on products subject to this regulation and verify the accuracy of the data.

    • B) Randomly sample products subject to this regulation and refer them to specialized laboratories to ensure their compliance with the requirements stated in this regulation.

    • C) The regulatory authorities have the right to charge suppliers the costs of conducting tests and related matters.

    • D) In the event of detecting a non-compliance of the product, the regulatory authority shall withdraw the concerned products from warehouses and take legal actions against them.

    • E) The regulatory authorities shall verify that the products covered by this regulation are licensed by the authority and bear the label.

Article 9: Responsibilities of Market Survey Authorities

  • Market surveillance authorities, as part of their jurisdiction and powers, shall:

    • 1) Apply market surveillance procedures to products subject to this regulation; offered in the markets, as well as products stored in the warehouses of traders and manufacturers to verify the procedures for affixing the label on products subject to this regulation and verify the accuracy of the data.

    • 2) Withdraw samples of the product, whether from the market or the warehouses of suppliers (manufacturers, importers, and distributors), to conduct the necessary tests and ensure their compliance with the requirements stipulated in this regulation, with the supplier bearing all costs related to the withdrawal, shipping, and testing of samples to ensure their continuous compliance with the relevant standard specification and this regulation.

    • 3) In the event of detecting non-compliance of the product - offered and stored - with the requirements of this regulation, the market surveillance authorities shall take all administrative measures of withdrawal and recall of the concerned product, and apply the procedures and penalties referred to in Article (10), after taking the necessary measures.
