The Board of Directors of the Transport General Authority

Based on the powers granted to it by the law

And after reviewing the Land Transport Law on Roads, issued by Royal Decree No. (M/188) dated 24/8/1446 AH.

And after reviewing the Regulation of the Transport General Authority, issued by Council of Ministers Decision No. (323) dated 14/9/1434 AH, and its amendments.

After deliberation, the Board resolved by circulation as follows:

First: Approving the Implementing Regulation for Heavy Goods Transport Activities for Commercial and Non-Commercial Purposes in the attached form.

Second: Approving the mechanism for adjusting the status of land transport establishments on roads in accordance with the provisions of the Land Transport Law on Roads, and the Implementing Regulation for Heavy Goods Transport Activities for Commercial and Non-Commercial Purposes in the attached form.

Third: The provisions of the regulation and the mechanism referred to in items (First) and (Second) of this resolution shall apply from the date of their publication in the Official Gazette.

Chapter 1: Preliminary Provisions

Article 1

  • The words and phrases contained in this Regulation shall have the meanings assigned to them in the Law and this Regulation, unless the context requires otherwise:

    • 1- Law: The Land Transport Law issued by Royal Decree No. (M/188) dated 24/8/1446 AH.
    • 2- Regulation: The Implementing Regulation for Heavy Goods Transport Activities for Commercial and Non-Commercial Purposes.
    • 3- Activities: Heavy goods transport activity for commercial purposes (for others), heavy goods transport activity for commercial purposes (for the establishment), and heavy goods transport activity for non-commercial purposes.
    • 4- Heavy Goods Transport: Transporting goods by trucks whose total weight exceeds (3,500) kilograms.
    • 5- Total Weight: The weight of the empty truck plus the load, driver, and passengers.
    • 6- Heavy Goods Transport Activity for Commercial Purposes (for others): Transporting others' goods by establishments or individuals using trucks, considered a sub-activity of goods transport for commercial purposes.
    • 7- Heavy Goods Transport Activity for Commercial Purposes (for the establishment): Transporting the establishment’s goods using its trucks, considered a sub-activity of goods transport for commercial purposes.
    • 8- Heavy Goods Transport Activity for Non-Commercial Purposes: Transporting an individual’s goods using their private truck for personal purposes, or transporting goods of non-profit establishments using their trucks for non-commercial purposes, considered a sub-activity of goods transport for non-commercial purposes.
    • 9- Establishment: Any legal entity enjoying full legal capacity.
    • 10- Individual: Any natural person enjoying full legal capacity.
    • 11- License: An official document issued by the Authority permitting the holder to practice the activities in accordance with the provisions of this Regulation.
    • 12- Service Provider: The person licensed to practice one or more of the activities.
    • 13- Sender: The person contracting with the service provider in the heavy goods transport activity for commercial purposes (for others) to transport goods on roads to the recipient.
    • 14- Recipient: The person to whom the goods are sent.
    • 15- Vehicle: A land transport means prepared to transport goods on roads, powered or towed by mechanical force, including a single vehicle, tractor, trailer, or semi-trailer.
    • 16- Single Vehicle: A single vehicle powered by mechanical force and prepared for heavy goods transport on roads.
    • 17- Truck: A single vehicle powered by mechanical force or towing a trailer, or any other configuration permitted to operate on roads, prepared for heavy goods transport for commercial or non-commercial purposes.
    • 18- Operating Card: A document issued by the Authority for the service provider’s vehicle to practice any of the activities according to the conditions and requirements specified in the Regulation.
    • 19- Center: The place through which the establishment practices the heavy goods transport activity for commercial purposes (for others), or the heavy goods transport activity for commercial purposes (for the establishment) in accordance with the provisions of this Regulation.
    • 20- Goods: Materials, equipment, merchandise, animals, food, or other items transported by trucks.
    • 21- Hazardous Materials: Materials, goods, or waste that may pose a danger to living organisms, infrastructure, property, or the environment, according to applicable laws, regulations, or international agreements.
    • 22- Driver: Anyone who drives a truck.
    • 23- Professional Driver Card: A document issued by the Authority to the driver according to the conditions and requirements specified in the Regulation.
    • 24- Professional Driver Card for Transporting Hazardous Materials: A document issued by the Authority to a truck driver transporting hazardous materials according to the conditions and requirements specified in the Regulation.
    • 25- Periodic Technical Inspection Document: A document issued by competent authorities to prove that the vehicle has passed the periodic technical inspection requirements.
    • 26- Transport Contract: The contract concluded between the sender or recipient and the service provider in the heavy goods transport activity for commercial purposes (for others), or their representative, stipulating the conditions under which the goods are transported.
    • 27- Transport Document: A document issued under the transport contract and considered proof of the service provider’s receipt of the goods subject to transport in the condition stated therein for delivery to the recipient in the same condition.
    • 28- Load Statement: A list of goods loaded on the truck in a single trip, including description, quantities, weights, dimensions of the goods, and addresses of senders and recipients.
    • 29- Inspector: The person authorized to inspect, monitor, and record violations of the Law or Regulation, appointed by a decision from the President.
    • 30- Authority’s Electronic Platform: The electronic platform approved by the Authority that enables access to data of the establishment, vehicles, and drivers.
    • 31- Financial Consideration: The amount determined by the Authority in return for any licenses, documents, services, and works provided under the provisions of the Law or Regulation.
    • 32- Financial Penalties: The amount of money the violator is obligated to pay to the Authority as a result of violating any provisions of the Law or the Violations and Penalties Schedule.
    • 33- Committee: The committee formed by a decision of the President in accordance with the provisions of the Law.

Article 2

  • First: The regulation aims to organize heavy cargo transport activities for commercial and non-commercial purposes, develop and advance its services, and encourage investment in it in accordance with the systems and regulations - in coordination with the concerned authorities - in a manner consistent with the economic and social development goals in the Kingdom, taking into account environmental aspects and security and safety requirements.

  • Second: Without prejudice to the relevant systems and their equivalents and the international agreements to which the Kingdom is a party:

    • 1- The provisions of this regulation apply to practitioners of heavy cargo transport carried out within the territory of the Kingdom.

    • 2- The provisions of this regulation apply to service providers (establishments or individuals).

    • 3- The provisions of this regulation do not apply to:

      •   A- Transport by trucks with a total weight of (3,500) kilograms or less, subject to the provisions of the Implementing Regulation for Light Cargo Transport Activities for commercial and non-commercial purposes.
      •   B- Transport of cars and vehicle towing subject to the provisions of the Implementing Regulation for Car Transport and Vehicle Towing Activities.
      •   C- Public works vehicles whose regulation is subject to the authority concerned with regulating heavy equipment, except for dual-purpose vehicles (vehicles that perform any of the heavy cargo transport functions in addition to the public works function), to which the provisions of this regulation apply in addition to the regulations issued by the authority concerned with regulating public works vehicles.
      •   D- Pickup-type transport vehicles owned by individuals and designated for personal use and registered as private transport, provided that none of the cargo transport activities for commercial purposes are practiced with them.
      •   E- Vehicles belonging to government agencies, diplomatic and consular missions, regional and international organizations, emergency and ambulance vehicles, vehicles for transporting the deceased, and vehicles for transporting money, precious metals, and documents of monetary value.
    • 4- It is prohibited for any person to practice any of the activities except after obtaining the necessary license from the Authority, or to continue practicing any of the activities after the license expires, is canceled, or during its suspension period. The prohibition includes all preparatory work for any person to practice any of the activities without a license, including inviting, calling, pursuing, obstructing, gathering, or roaming in places where goods are located.

    • 5- Non-Saudi trucks are prohibited from practicing domestic transport within the Kingdom.

Chapter 2: License

Chapter 1: Licensing of Heavy Goods Transport Activity for Commercial Purposes (for Others) - Establishments

Article 4

1- The licensing conditions stated in paragraphs (2, 5, 6, 9) of Article (Three) are binding for its validity, and in the event of a breach of any of these conditions; penalties shall be imposed in accordance with the law and the approved schedule of violations and penalties.

2- In the event of a shortage in the minimum number of trucks required for establishments to practice heavy goods transport activities for commercial purposes (for others) due to accidents or disasters beyond the establishment's control, and the shortage is not completed within (180) days from the date of the shortage; penalties shall be imposed in accordance with the law and the approved schedule of violations and penalties.

Article 5

  • 1- A restricted license is issued to the establishment upon submitting the license application after fulfilling paragraph (2) of Article (Three) and for a period of (60) days, to enable the establishment to complete fulfilling all the licensing conditions stated in Article (Three), provided that the establishment does not practice the activity through the restricted license, and the restricted license is canceled after its duration expires.
  • 2- The license is issued in the name of the establishment, and for a period of (3) years.

Article 6

  • Subject to Article (Three) of this Regulation, the license shall be renewed upon a request from the service provider, and after payment of the financial fee - if any - for a similar period, in accordance with the following regulations:

    • 1- Submitting the renewal request and fulfilling all its conditions within the period preceding the license expiration date by (180) days, otherwise the request shall be considered void.
    • 2- Providing a valid Saudization certificate.
  • It is permitted to submit the renewal request and fulfill all its conditions within a period of (30) days from the license expiration date, otherwise the request shall be considered void, without prejudice to the Authority's right to impose the prescribed penalties for delay in renewing the license.
