Mechanism for Amending the Status of Land Transport Establishments on Roads in Accordance with the Provisions of the Land Transport Law on Roads and the Implementing Regulation for Heavy Goods Transport Activities for Commercial and Non-Commercial Purposes

Article 2

  • Second:

    • 4- It is prohibited for any person to practice any of the activities except after obtaining the necessary license from the Authority, or to continue practicing any of the activities after the license expires, is canceled, or during its suspension period. The prohibition includes all preparatory acts for any person to practice any of the activities without a license, including inviting persons, calling them, pursuing them, intercepting them, gathering, or roaming in places where goods are located.
  • The necessary grace period to adjust the situations:

    • Licensed persons (before the regulation comes into effect): Six months from the effective date concerning the heavy goods transport activity for commercial purposes (for the benefit of the establishment).
    • Licensed persons (after the regulation comes into effect): ---

Article 3

  • It is required for the establishment to obtain a license to practice heavy cargo transport activity for commercial purposes (for others - establishments) to fulfill the following requirements:

    • 2- A valid commercial register for the establishment that includes the heavy cargo transport activity for commercial purposes (for others - establishments).

      • The deadline for adjusting the status:

        • Licensed before the regulation came into effect: Nine months from the effective date regarding the activity title in the commercial register.
        • Licensed after the regulation came into effect: Nine months from the effective date regarding the activity title in the commercial register.
      • Clarifications: ---

      • Legal instrument (according to the law / according to the regulation): According to the regulation.

    • 6- Providing the required single vehicles and/or tractors to practice the activity, no less than (10) single vehicles and/or tractors, provided that their registration type is (public transport) according to the Traffic Law and its executive regulations, and that they are owned directly by the establishment, or through financial leasing provided that the establishment is the actual user.

  • The deadline for adjusting the status:

    • Licensed before the regulation came into effect: Continuation for entrepreneurs licensed before the regulation who own less than the required minimum, with annual gradual addition of vehicles to the activity until reaching the required minimum.
    • Licensed after the regulation came into effect: ---
    • Clarifications: The addition must be at least two vehicles annually, and the renewal of the license or the expired operation card for existing vehicles shall not be granted except after fulfilling the annual addition requirement according to the regulation.

Article 10

  • 9- A service provider engaged in the heavy goods transport activity for commercial purposes (for third parties - individuals) may operate one or more trailers or semi-trailers, provided that an operating card is issued for each trailer or semi-trailer before it is operated in the activity, in accordance with the following:

  • The period required to rectify the status:

    • Licensees (before the Regulation enters into force): One year from the date of entry into force.
    • Licensees (after the Regulation enters into force): One year from the date of entry into force
    • Clarifications: ---

Eleventh

Previous Amendments
  • The establishment must, in order to obtain a license to conduct the activity of heavy goods transport for commercial purposes (for the benefit of the establishment), satisfy the following requirements:

  • 2- A valid Commercial Register for the establishment that includes any of the following economic activities: (industrial activities, agricultural activities, or any commercial activities that require the performance of heavy goods transport operations for their benefit, as determined by the Authority by a decision of the President), in addition to including in the Commercial Register the activity of heavy goods transport for commercial purposes (for the benefit of the establishment).

  • The period required to rectify the status:

    • Licensees (before the Regulation enters into force): Nine months from the date of entry into force with respect to the activity name in the Commercial Register
    • Licensees (after the Regulation enters into force): Nine months from the date of entry into force with respect to the activity name in the Commercial Register
    • Clarifications: ---
    • Legal instrument (under the Law / under the Regulation): Under the Regulation
  • 5- Providing the individual vehicles and/or tractors necessary to conduct the activity, as determined by the Authority by a decision of the President, provided that they number no fewer than (1) individual vehicle or tractor, that their registration type is (Public Transport) in accordance with the Traffic Law and its Implementing Regulations, and that they are owned directly by the establishment or through finance lease, provided that the establishment is their actual user.

    • The period required to rectify the status:

      • Licensees (before the Regulation enters into force): 2026/8/27 AD
      • Licensees (after the Regulation enters into force):  ---

Nineteen

  • 4- The operating license conditions stated in paragraph (1) of this article are binding for its validity. In case of violation of any of these conditions, a period of (30) days is granted to rectify the violation, and the activity shall not be practiced until the violation is corrected. If the period expires without correction, a request shall be submitted to the committee to suspend the operating license, without prejudice to the right to impose the penalties prescribed for this violation.

  • Licensees (before the regulation comes into effect): Three months from the effective date regarding the classification of non-profit establishments and proving the need for them

  • 5- A (Saudi individual/non-profit entity) may, in the heavy goods transport activity for non-commercial purposes, own one or more trailers or semi-trailers, provided that an operating card is issued for each trailer or semi-trailer before it is operated in the activity, in accordance with the following:

    • Time limit required to rectify status:
    • Licensees (before the Regulation enters into force): One year from the date of entry into force
    • Licensees (after the Regulation enters into force):  One year from the date of entry into force

Previous Amendments
  • 1- The driver must obtain a professional driver’s card or a hazardous materials transport driver’s card, as applicable. The following conditions are required for its issuance:

  • B- The obligation to pass the professional competency test to obtain a professional driver’s card or a hazardous materials transport driver’s card is as follows:

    • A- For drivers holding a valid driver’s card: the obligation begins from the card’s expiration date, after the Authority launches the (Professional Qualification Program for Heavy Transport Drivers) or the (Professional Qualification Program for Hazardous Materials Transport Drivers), as applicable.
    • B- For drivers who do not hold a driver’s card or whose driver’s card has expired: the obligation begins from the date the Authority launches the (Professional Qualification Program for Heavy Transport Drivers) or the (Professional Qualification Program for Hazardous Materials Transport Drivers), as applicable.
  • The grace period for adjusting the status:

    • Licensed persons (before the regulation comes into effect): one year from the effective date
    • Licensed persons (after the regulation comes into effect): one year from the effective date

Twenty-fourth

  • The operational age must not exceed (20) years from the manufacturing date for the single vehicle or tractor used in heavy goods transport activity for commercial purposes (for others - establishments), heavy goods transport for commercial purposes (for others - individuals), and heavy goods transport activity for commercial purposes (for the benefit of the establishment).

  • The necessary period for adjusting the status:

    • Licensed parties (before the regulation comes into effect): Three years from the effective date concerning heavy goods transport activity for commercial purposes (for the benefit of the establishment), and heavy goods transport activity for non-commercial purposes
    • Licensed parties (after the regulation comes into effect): ---

Thirty

  • 11- The service provider in the heavy goods transport activity for commercial purposes (for others - establishments) and the heavy goods transport activity for commercial purposes (for the benefit of the establishment) must link all licenses issued by the Authority with the Saudi Business Center, and place the unified electronic code in a visible place for beneficiaries at the center.

  • The deadline for adjusting the status:

    • Licensed persons (before the regulation comes into effect): Six months from the date of enforcement
    • Licensed persons (after the regulation comes into effect): Six months from the date of enforcement

  • 12- Vehicles with dual functions must obtain an operating card from the Authority according to the mechanism agreed upon with the entity responsible for regulating public works vehicles.

    • Licensed persons (after the regulation comes into effect): Six months from the date of enforcement
