Law on the Protection of Public Funds of the GCC Countries

  • We, Salman bin Abdulaziz Al Saud

  • King of the Kingdom of Saudi Arabia

  • Based onArticle (Seventy) of the Basic Law of Governanceissued by Royal Order No. (A/90) dated 27-08-1412 AH.

  • And based onArticle (Twenty) of the Council of Ministers Lawissued by Royal Order No. (A/13) dated 03-03-1414 AH.

  • And based on Article (Eighteen) of the Shura Council Law, issued by Royal Order No. (A/91) dated 27-08-1412 AH.

  • After reviewing Shura Council Resolution No. (10/86) dated 23-04-1445 AH.

  • After reviewing Council of Ministers Resolution No. (268) dated 28-03-1446 AH.

  •  

  • We have decreed the following:
     

  • First:

  • Approval of the unified law concerning plant genetic resources for food and agriculture for the GCC countries, adopted by the Supreme Council of the Gulf Cooperation Council in its 43rd session held on 15 Jumada al-Awwal 1444 AH corresponding to December 9, 2022, in Riyadh, in the attached wording.
     

  • Second:

  • Approval of the Public Funds Protection Law for the GCC countries on a guiding basis for a period of two (2) years, adopted by the GCC Ministerial Council in its 154th preparatory session for the 43rd session of the Supreme Council held on 13 Jumada al-Awwal 1444 AH corresponding to December 7, 2022, in the attached wording.
     

  • Third:

  • His Highness the Prime Minister, the Ministers, and the heads of the concerned independent bodies - each within their jurisdiction - shall implement this decree.

Chapter 1: Definitions and General Provisions

Article 1

 

  • For the purposes of applying the provisions of this law, the following words and phrases shall have the meanings assigned to them as follows:

    • Council: The Gulf Cooperation Council.

    • Competent Authority: The agencies responsible for protecting public funds and combating corruption.

    • Concerned Authority: The entities specified in Article (4).

    • Investigating Authority: The public prosecution or the general prosecution or the anti-corruption bodies in the member states of the Council.

    • Public Funds: The funds owned by the state or public legal entities and the funds that the laws of the member states of the Council stipulate are subject to oversight.

    • Public Servant: Anyone who works in the entities specified in Article (4) or is assigned to a public service therein.

    • Article One:

Article 2

  • The provisions of this law are considered guidelines insofar as they do not conflict with the national laws in force in the countries of the Gulf Cooperation Council, and it shall be effective for a period of two years from the date of its approval by the Ministerial Council of the Gulf Cooperation Council.

Article 3

  • Public funds are sacred, and they must be protected and preserved, and no action may be taken regarding them in any form except in accordance with the provisions of the law, and they may not be owned or any real right acquired over them by prescription.

Article 6

  • Employees designated by a decision from the competent authority in each country shall have the status of judicial officers concerning the provisions of the law.

Chapter 2: Control over Public Funds

Article 7

  • The relevant authorities that invest funds within or outside the state must submit to the competent authority a complete statement regarding the status of the invested funds, their condition, and the uninvested balances, within () days from the end of the financial year, without prejudice to what is stipulated by other national regulations (laws).
