Regulation of the Council of Charitable Associations

Chapter 1: Definitions and Objectives

Article 1

The following words and phrases - wherever they appear in this Regulation - shall have the meanings specified next to each of them unless the context requires otherwise:
The Center: The National Center for Non-Profit Sector.
The Board of Directors of the Center: The Board of Directors of the National Center for Non-Profit Sector.
The Supervising Authority: The technical authority under which the activities of the specialized sub-council fall.
The Law: The Law of Associations and Non-Profit Institutions.
The Implementing Regulation: The Implementing Regulation of the Law of Associations and Non-Profit Institutions.
The Regulation: The Regulation of the Council of Non-Profit Associations.
The Association: The non-profit association licensed by the Center in accordance with the Law of Associations and Non-Profit Institutions.
The General Assembly: The General Assembly of the Council of Non-Profit Associations or the sub-council.
The Council: The Council of Non-Profit Associations.
The Board of Directors: The Board of Directors of the Council of Non-Profit Associations.
The Executive President: The Executive President of the Council or the sub-council.
The Sub-Council: The council or sub-councils emanating from the Council, whether regional or specialized.
The General Assembly of the Branch: The General Assembly of members whose main headquarters fall within the scope of the regional sub-council, and members of the General Assembly who meet the membership conditions in the specialized sub-councils.
The Board of Directors of the Branch: The Board of Directors of one of the sub-councils emanating from the Council.

Article 2

A Council for Non-Profit Organizations is established under this Regulation, which enjoys legal personality and financial and administrative independence, with its main headquarters located in Riyadh. With the approval of the center, it may establish regional or specialized subsidiary councils that possess independent legal status.
 

Article 3

  • 1- The objective of the Council is to represent non-profit organizations in their public affairs at the national level before the center, governmental and non-governmental entities, and to achieve cooperation, integration, and coordination among them, in order to empower and develop the non-profit sector.

  • 2- The Council or its authorized representative may represent non-profit organizations before judicial and quasi-judicial authorities in the following cases:

    • A- Defamation of non-profit organizations and their employees or those dealing with them.

    • B- Undermining the integrity of the work of non-profit organizations without just cause.
       

Article 4

Without prejudice to the competencies of the center, the supervising authority, the subsidiary councils, and other entities, the council shall have the following competencies and tasks:
1- Representing the sector of non-profit organizations and its interests before the relevant authorities.
2- Coordinating between the regional and specialized subsidiary councils to unify efforts and achieve cooperation and integration among them.
3- Coordinating with the relevant authorities to support the non-profit organizations sector and meet its needs.
4- Providing recommendations and proposals to the center or the relevant authorities related to policies, regulations, strategic plans, public programs, and others related to the non-profit organizations sector, each according to its competencies.
5- Representing the non-profit organizations sector at local and international events and conferences, taking into account what is stated in Article Sixty of the regulation.
6- Providing or coordinating rehabilitation and development programs for non-profit organizations in accordance with what is decided by the Board of Directors and in a manner that does not conflict with the competencies of other entities.
 

Article 5

Without prejudice to the competencies of the center, the supervising authority, the subsidiary councils, and other entities, the council shall take all necessary measures to achieve its objectives and perform its competencies, including the following:
1- Establishing partnerships and qualitative relationships that would support and empower the non-profit organizations sector.
2- Conducting surveys and preparing studies and research related to the non-profit organizations sector and publishing them after coordinating with the relevant authorities.
3- Providing support, assistance, and advice to the subsidiary councils and relevant entities to empower the non-profit organizations sector.
4- Coordinating with relevant authorities to resolve issues faced by non-profit organizations and address the challenges they encounter.
5- Collaborating with regional and international entities to contribute to the development of the non-profit organizations sector, taking into account what is stated in Article Sixty of the regulation.
6- Raising awareness of the importance of non-profit organizations, their purposes, and activities, including holding conferences, seminars, programs, and awareness-raising activities in this regard.
