No broadcasting or television material may be sold unless it has been approved by the regulatory authority and broadcasted by the radio or television, as applicable.
The sale of rare documentary materials is prohibited except with the approval of the Minister of Culture and Information, taking into account the application of item (Eighth) of these regulations in the event of their commercial utilization.
Without the obligation to adhere to the minimum limit mentioned in paragraph (3) of item (Fourth) of these regulations, broadcasting or television materials are sold to private profit-making entities that own closed broadcasting and television circuits such as (hotels - residential complexes - private hospitals... etc.) at a price estimated at (5%) of their purchase value, for broadcasting or showing in a maximum of two closed circuits, and the price is increased by (2%) of the purchase value for each additional circuit.
The committee referred to in paragraph (2) of item (Fourth) of these regulations determines the sale value of materials produced within the broadcasting and television studios for showing in two closed circuits in those entities, and the value is increased by (10%) for each additional circuit.
The broadcasting or television materials are sold to government entities and non-profit private entities within the Kingdom at a rate estimated at (3%) of the purchase value of these materials, or at the value determined by the Committee referred to in paragraph (2) of item (Fourth) of these regulations for materials produced within broadcasting and television studios, without the obligation to adhere to the minimum limit mentioned in paragraph (3) of item (Fourth) of these regulations.
Various segments and clips from the radio or television archive are sold for an amount of (1000) Riyals per minute for all entities and individuals, with a minimum of (2000) Riyals, provided that they are not used in the production of other materials, gifted, or used for commercial purposes except in accordance with clause (Eighth) of these regulations.
The various clips and footage - in the event that an entity or individual wishes to commercially benefit from them for the production of a broadcast, television, or advertising material - shall be governed as follows:
1- In the case of benefiting from the clips and footage to produce a specific duration and value broadcast or television material, the value per minute for these clips or footage shall be calculated based on the sale price of the material to be produced, provided that the value is not less than the price stated in item (Seventh) of these regulations.
2- In the case of benefiting from the clips and footage to produce a broadcast or television material that is not of a specific duration and value (to be marketed after production), the Committee referred to in paragraph (2) of item (Fourth) of these regulations shall estimate the sale price, provided that the value is not less than the price stated in item (Seventh) of these regulations.
If any entity wishes to purchase any broadcast or television material covered by these regulations, it must submit a request to the Ministry of Culture (the Ministry's Assistant Agency for Television Affairs or for Radio Affairs as applicable) that includes the following:
1- Specification of the required material or the part required from it.
2- Specification of the station, channel, or entity that will broadcast or display it.
3- A written commitment not to sell, gift, or use the broadcast or television material for any purpose other than broadcasting or displaying it solely by the station, channel, or entity specified in the purchase request, and that in the event of a violation, the Ministry has the right to take necessary actions to demand any compensation it deems appropriate from the entity.
Broadcasting or television materials are sold to individuals for personal use based on a written request to the Ministry of Culture (the ministry's agency responsible for television or radio affairs as applicable) that includes a commitment not to copy this material or use it for any other purpose, and that in the event of a violation, the ministry has the right to take the necessary procedures to claim any compensation it deems appropriate.
