The institution is an entity with a legal personality whose primary purpose is to provide educational services above the secondary level without aiming to achieve material profit, and its establishment and growth depend on continuous self-financing.
The license applicant shall fill out the license application form and submit it to the ministry along with the following:
* A copy of the personal identification card of the license applicant, whether an individual or more, or a copy of the license or commercial register if it is a legal entity.
* A copy of the institution's articles of association.
* A statement of the funds and endowments that will be allocated to the institution to assist it in achieving its objectives.
The Articles of Association of the institution must include the following:
* The name of the institution, its headquarters, and its address.
* The name(s) of the founders, their ages, professions, place of residence, address, and signature of each.
* Membership conditions, if any, and types, as well as the rights and duties of members.
* Rules related to its management, representation, and the identification of the bodies responsible for its affairs and their respective jurisdictions.
* Its resources, how to manage them, and methods of expenditure.
* Definition of the beginning and end of the financial year and the type of financial oversight on its funds.
* How to amend its system, how to merge with others, and how to establish branches.
* How to dissolve or liquidate it and the entities to which its assets will be transferred.
The license for the institution shall be as follows:
First:
A decision shall be issued by the Minister for the preliminary approval to establish the institution, after which the institution shall proceed with the following:
* Electing a Board of Directors in accordance with Article Eight of these regulations.
* Informing the Ministry of the names of the Board members and the tasks assigned by the Board to the President, Vice President, General Secretary, and Treasurer, as well as specifying the bank or banks with which the institution wishes to deal.
Second:
A decision shall be issued by the Minister for the final license of the institution after submitting the documents supporting the allocation of funds and endowments for the benefit of the institution in accordance with paragraph (c) of Article Five, and submitting the institution's budget audited by a licensed accountant. Thus, the institution acquires legal personality.
The institution shall have a board of directors consisting of no less than five members, nominated by the founder and approved by the Minister. The bylaws shall specify the term of membership of the board of directors, which shall not exceed four years and may be renewed.
The minister may appoint a temporary board of directors for the institution in cases that serve the interests and objectives of the institution.
The Ministry must be notified with a copy of the minutes of each meeting of the Board of Directors and the decisions made within twenty days from the date of the Council's approval, and the Ministry has the right to object to those decisions within twenty days from the date they are submitted to the Ministry.
