Regulation Governing Charitable Endowments (Part One – Inventory, Review and Registration)

  • Decision No. 80 dated 29/1/1393

  • The Council of Ministers,

  • After reviewing the accompanying transaction received from the Diwan of the Presidency of the Council of Ministers under No. 190 on 3/1/1391, submitted by His Excellency the Minister of Hajj and Endowments in his letter No. 145 dated 24-25/11/1390 AH, including a copy of the decision of the Supreme Endowments Council No. 72/M/Q/A dated 11/11/1390 issued approving the draft Regulation for the Organization of Charitable Endowments (Part One - Inventory, Verification, and Registration) attached. We kindly request consideration and approval of what the Council deems appropriate in this regard.

  • After reviewing the recommendation of the Regulations Committee No. 112 dated 16-17/11/1391, which includes its recommendation to approve the aforementioned draft regulation.

  • After reviewing the attached minutes taken from the ministerial committee formed of His Excellency the Minister of Hajj and Endowments, His Excellency the Minister of State and Chairman of the Disciplinary Board, and His Excellency the Minister of Education, which includes their endorsement of the Regulations Committee’s recommendation to approve the draft Regulation for the Organization of Charitable Endowments (Part One - Inventory,Verification, and Registration) in the form prepared by the Supreme Endowments Council.

  • It is decided:

  • To approve the draft Regulation for the Organization of Charitable Endowments (Part One - Inventory, Verification, and Registration) in the attached form.

    For the above reasons, it is issued.

    For the above reasons, it is issued.

    And since His Majesty the King has approved this — please complete what is necessary accordingly, reproduce the draft Regulation for the Organization of Charitable Endowments, provide the relevant authorities with a copy thereof, and return the original with two copies to be retained in the Diwan as usual.. It should be ensured that the sale and replacement of endowment properties with low yield, no yield, or those feared to be at risk of loss due to their condition, such as minors, is conducted in accordance with the established rules.MinorsFor this purpose, these properties are to be inventoried by the relevant endowment departments, and the inventory results are to be submitted in a report to the competent endowment councils in accordance with the attached Form No. (1) within the first month of the fiscal year.

  • All names of endowment properties are limited - for the purpose of organizing their registration under the names shown below, and each name is symbolized by the code indicated next to it:

    • A) Building (B) means any building constructed on an apartment system and rented under this system or rented entirely for any other purpose, and it is understood that it includes more than one residential unit and includes under this name hotels, schools, hospitals, etc.

    • B) House (H) means any house or building that includes a single residential unit, and this name includes (villas) and (removals), etc.

    • C) Shop (S) means any building designated for rent for the purpose of trade by buying and selling in general, and this includes the sale of services and includes under this name (warehouse), (store), (showroom), etc.

    • D) Agricultural Land (A) means any land with crops or plantations that yield produce or are prepared for that, and this name includes (orchard), (agricultural lands), (farmlands), (planted lands), and (cultivated lands).

    • E) Land (L) means any barren land that does not yield crops or any land with a ruined, collapsed house that does not produce from the land, and this includes (vacant land), (yard), and (ruins).

  • As for what does not fall under any of the above symbols among the endowed properties, it shall be recorded by a sufficient name to identify it, such as a coffee shop or a bathhouse.
