Statute of the Health Endowment Fund

  • After reviewing the correspondence received from the Diwan of the Presidency of the Council of Ministers No. 44426/B dated 1428/10/9 AH, including the two letters from His Excellency the Minister of Islamic Affairs, Endowments, Dawah and Guidance, Chairman of the Supreme Endowment Council No. 2709/4/5 dated 1425/8/19 AH, and No. 2685/4/5 dated 1425/8/18 AH, regarding the draft statute for the Health Endowment Fund.

  • After reviewing the aforementioned draft statute.

  • After reviewing theLaw of the Supreme Endowment Councilissued by Royal Decree No. (M/35) dated 1386/7/18 AH.

  • After reviewing the Health Law, issued by Royal Decree No. (M/11) dated 1423/3/23 AH.

  • After considering the Shura Council decisions No. (76/102) dated 1427/2/26 AH, and No. (37/51) dated 1428/9/13 AH.

  • After reviewing the minutes No. (55) dated 1426/2/17 AH, No. (85) dated 1426/3/9 AH, No. (222) dated 1426/6/6 AH, No. (301) dated 8/15/1426 AH, No. (358) dated 1427/8/23 AH, and memorandum No. (262) dated 1427/6/20 AH, prepared by the Experts Authority.

  • After reviewing the recommendation of the General Committee of the Council of Ministers No. (736) dated 1428/10/24 AH.

  • It is decided

  • to approve the establishment of the Health Endowment Fund, in accordance with its accompanying statute.

Article 1

The fund shall have a legal personality with independent financial and administrative liability, and its headquarters shall be in the capital city, Riyadh. Branches may be established in other regions as needed.

Article 2

Previous Amendments
  • The organizational structure of the fund consists of the following:

  • 1- The General Panel of the Fund, which is the general assembly of those who have contributed to the endowment either in kind or in cash not less than one million riyals. Any group of endowers whose total endowment amounts to one million riyals or more may be represented in the General Panel by one of them.

  • 2- A Board of Directors responsible for supervising and monitoring the fund's activities and issuing its regulations, chaired by the Minister of Health, and including the membership of:

    • - A representative from the Ministry of Health.

    • - A representative from the General Authority for Awqaf.

    • - A representative from the Ministry of Labor and Social Development.

    • - A representative from the Saudi Health Council.

    • - Five members from the endowers or others, appointed by the General Panel of the Fund.

    • The rank of representatives of government agencies must not be less than (fourteenth grade) or its equivalent.

  • 3- The Executive Management, whose competencies and authorities are defined by the regulations issued by the Board of Directors.

  • 4- A Sharia Committee composed of highly qualified, experienced, and competent members, numbering no less than five specialists in the jurisprudence of financial transactions, endowments, and regulations, entrusted with the following:

    • A- Preparing studies required for the fund's work.

    • B- Addressing any issues that arise during the fund's performance of its duties related to endowments.

    • C- Any other task assigned by the Board of Directors.

    • The members of the committee referred to in this paragraph and their remuneration shall be appointed by a decision of the Board of Directors. The Board shall also appoint a reserve member for each of them to replace them in case of absence.

Article 3

  • The fund aims to achieve the following:

    • 1- Encouraging acts of charity and voluntary contributions in the field of healthcare.

    • 2- Highlighting the importance of healthcare as a form of charity deserving the allocation of the most valuable endowments and donations.

    • 3- Actively contributing to health development by organizing and investing the fund's resources to provide priority health needs.

    • 4- Assisting in providing patients with necessary devices, treatment, and rehabilitation, especially those with chronic or incurable diseases.

    • 5- Contributing to financing preventive programs and health research aimed at combating and treating diseases.

Article 4

  • The fund's resources consist of the following:

    • 1- Properties, financial instruments, shares, and cash funds endowed by their owners for the purposes of the fund.

    • 2- Cash and in-kind donations.

    • 3- Revenues from the fund's endowments and their investments.

    • 4- Revenues collected from the fund's investments or from operating the health facilities it supervises.

    • 5- Contributions determined by the state, whether monetary or in-kind, such as lands and others.

Article 5

The fund may establish companies or institutions to serve its purposes in accordance with the applicable regulatory procedures.
