Law of Precious Metals and Gemstones

Article 1

Previous Amendments

1- The Ministry of Industry and Mineral Resources shall supervise the industry of precious metals, gemstones, their manufactured products, and the items plated, coated, or inlaid with them, and oversee their regulation, in accordance with the provisions set forth by the regulations.
2- The Ministry of Commerce shall supervise the trade of precious metals, gemstones, their manufactured products, and the items plated, coated, or inlaid with them, and oversee their regulation, in accordance with the provisions set forth by the regulations.

Article 2

Previous Amendments

1- Subject to the provisions of other laws, the practice of the precious metals and gemstones industry is not permitted except after obtaining a license from the Ministry of Industry and Mineral Resources, in accordance with the regulations specifying the controls and conditions.
2- The regulations shall determine the financial fees for licenses and services provided in accordance with the provisions of this law.

Article Three

  • Selling, displaying or possessing- with intent to sell - of items plated with precious metals or the items which are less than the minimum regular carat is prohibited except in accordance with the instructions issued by a decision of the Minister of Commerce.

Article Four

  • Selling, displaying or possessing- with intent to sell - of bullions and artifacts of precious metals is prohibited unless they are hallmarked with the kingdom stamp.

Article Five

  • The competent authorities of customs or post, after notifying the concerned person, shall send the packages containing bullions or artifacts of precious metals and other items which are subject to the provisions of this Law and imported from abroad for commercial purposes to the competent authority in the Ministry of Commerce to be examined, analyzed and hallmarked with the Kingdom stamp or to ensure they are hallmarked with a recognized stamp.

Article Six

  • Bullions and artifacts of precious metals shall be submitted to the competent authority in the Ministry of Commerce to be examined and hallmarked according to the regular carats. If they appear to be less than the minimum regular carat, they shall be broken and sent back to their owner who, in all cases, may re-export them to their source if they are imported.

Article Seven

  • It is not permissible to make any change on the bullions or artifacts of precious metals after being hallmarked by the Ministry of Commerce to be prepared for sale unless required by industrial necessities and according to the instructions issued by the Ministry.

Article Eight

  • It is prohibited to sell artifacts of precious metals and plated, painted and inlaid items, or to display them for sale or possess them with intent to sell unless they are hallmarked as follows:

    • a. The precious metals artifacts shall be hallmarked according to their carat with one of the regular carats determined by the Ministry of Commerce.

    • b. The inlaid and painted items shall be hallmarked by a number that shows the percentage of contained pure precious metal associated with a statement of quality.

    • c. The plated items shall be hallmarked with the word "plated".

    • In case that the size of painted or inlaid items does not allow hallmarking as mentioned, each piece shall be labeled with a card indicating the mentioned data plus the shop owner name written in Arabic

Article Nine

  • The Ministry of Commerce may issue a resolution to approve the hallmark of other countries

Article 10

Previous Amendments

The Ministry of Commerce, in agreement with the Ministry of Industry and Mineral Resources, shall require owners of precious metals factories and workshops to use hallmark stamps to distinguish their products, registered in accordance with the regulations specified.
