Implementing Regulation of the Accredited Residents Law - 1441

Chapter 1: Definitions

Article 1

  • 1. The words and terms mentioned in this Regulation shall have the meanings specified next to each of them in Article One of the Law of Certified Appraisers issued by Royal Decree No. (M/43) dated 9/7/1433H and its amendments issued by Royal Decree No. (M/109) dated 22/8/1441H.

  • 2. The following words and terms - wherever they appear in this Regulation - shall have the meanings clarified next to each of them unless the context requires otherwise:

    • Regulation: The Implementing Regulation of the Law of Certified Appraisers.

    • Council: The Board of Directors of the Authority.

    • General Secretariat: The General Secretariat of the Authority.

    • Evidence: The Practice Guide issued by the Authority for each branch of appraisal; aimed at enhancing the quality of appraisal and raising the professional efficiency of those conducting appraisal work, and adopting specialized professional standards for each branch. 

    • Code of Conduct: The rules governing the ethics and conduct of the appraisal profession adopted by the Council.

    • General Assembly: A general assembly consisting of all primary and associate members who have paid their annual membership fees.

    • Supervisory Committee: The committee that supervises the election of the members of the Board of Directors of the Authority.

    • Voters: All primary and associate members in the Authority, who have paid their annual membership fees and whose membership was valid at the time of opening the nomination for the Board of Directors membership.

    • Review Committee: The committee that reviews violations of the provisions of the Law and its Implementing Regulation and the regulations governing the work of the Authority.

    • Subscriptions: The financial fees determined for membership categories and the establishment account, and the services provided by the Authority. 

    • Appraisal Establishment: The individual establishment or professional company that meets the regulatory requirements related to practicing the appraisal profession.

    • Experience Hours: The hours of professional practice acquired through conducting appraisal work, which the General Secretariat determines the mechanism for calculating, and calculating the equivalent of these hours from the hours allocated for indirect work and similar activities related to appraisal work.

    • Appraisal Report: The document issued by the certified appraiser for their clients, including the result of the appraisal, fulfilling the obligations of the certified appraiser as outlined in the Law, the Regulation, and the Evidence, and complying with the approved appraisal standards.

    • Client: The natural or legal person who commissions the appraiser to perform the appraisal task. 

    • Fourth Degree: Uncles and aunts and their children, maternal and paternal uncles and aunts, and their children.

    • Electronic Systems: The electronic systems or means adopted by the Authority to organize the practice of the profession, including the following: 

      • A- Electronic Value System: A system that includes all electronic services provided by the Authority to its members, through which they document their work and record their experiences. 

      • B- Estimation System: An electronic system created by the Authority to manage and organize appraisal and damage estimation processes in the centers accredited by it, aimed at enabling the Authority to supervise, develop, and organize and extend control over the profession of appraisal and damage estimation in some other branches of appraisal that the Council may add.

      • C- Any system or electronic means adopted by the Authority to organize the practice of the profession.

    • Establishment Account: An electronic account created by the certified appraiser in the electronic system specified by the General Secretariat and according to the required data, aimed at organizing all works issued by appraisal establishments, and providing the Authority with the appraiser's data, address, and all information requested, as well as depositing the appraisal reports issued by them.

    • Summaries of Appraisal Reports: Electronic templates in the electronic system specified by the General Secretariat and according to the required data, through which the certified appraiser summarizes the appraisal reports issued by them.

Chapter 2: Membership

Article 2

The Council adopts a regulation for membership in the authority that includes the following provisions: 
1. Defining the general provisions for membership in the authority, approving the specific controls related to it, clarifying the mechanism and conditions for acquiring, terminating, and canceling membership, as well as related provisions.

2. Categories of membership in the authority for each branch of evaluation.

3. The conditions and requirements related to academic qualifications and tests required for each category of membership according to each branch of evaluation.

 

Chapter 3: Registration in the Register of Certified Residents

Article 4

Without prejudice to the provisions of the regulations of other professional bodies, other professionals who are members of other professional bodies or organizations may obtain a license to practice the profession of appraisal in any branch of appraisal, provided that the applicant meets the necessary conditions for granting the license.

Article 6

The meeting of the Committee for the Registration of Appraisers shall not be valid unless all its members are present, and its decisions shall be made by majority according to the regulations. No member of the committee may abstain from voting or appoint another to vote on their behalf, and the committee may hold its meetings through electronic means.

Article 7

A record is prepared upon the convening of the Registration Committee for Appraisers, which includes its decisions. The record is signed by all members, and the committee may sign its records and decisions and approve them electronically. It is also permitted for the committee to make its decisions by circulation.
