Implementing Regulation of the Law of Certified Evaluators

  • Based on the powers granted to him

  • After reviewing Article (44) ofthe Certified Valuers Law, issued by Royal Decree No. (M/43) dated 9/7/1433 AH, and its amendments, which states: "The Board of Directors shall prepare the Implementing Regulation of this Law, which shall be issued by a decision of the Minister and shall be effective upon the enforcement of this Law."

  • After reviewing the Saudi Authority for Accredited Valuers Board of Directors Decision No. (2/40/M/23) dated 6/1/1445 AH, which includes approval of the Implementing Regulation of the Certified Valuers Law, its transitional provisions within its issuance instrument, and the recommendation to submit it for approval.

  • After reviewing the decision of His Excellency the Minister of Commerce No. (639) dated 3/12/1441 AH, approving the Implementing Regulation of the Certified Valuers Law, and after reviewing the Saudi Authority for Accredited Valuers Board of Directors Decision No. (1/M/20) dated 3/12/1441 AH, approving the Membership Regulation.

  • Based on the justifications presented.

  • It is decided as follows:

    • First: Approval of the Implementing Regulation of the Certified Valuers Law, according to the attached text.

    • Second: The following shall be exempted from the effective date stipulated in Article (72) of the Regulation - approved in item (First) of this decision - as follows:

      • 1- The restrictions stated in paragraph (D/1) of Article (2) of the Regulation, regarding those who previously obtained the membership referred to in the aforementioned paragraph of the Regulation, with the effective date of these restrictions for them being 1/7/1446 AH, corresponding to 1/1/2025 AD.

      • 2- The calculation of the period mentioned in paragraph (2) of Article (7) of the Regulation shall commence for those who previously obtained the membership referred to in the aforementioned paragraph of the Regulation, starting from 19/6/1445 AH, corresponding to 1/1/2024 AD.

      • 3- The effective date of the provision of Article (22) of the Regulation shall be 1/7/1446 AH, corresponding to 1/1/2025 AD.

      • 4- The effective date of the provision of paragraph (12) of Article (28) of the Regulation shall be 25/12/1445 AH, corresponding to 1/7/2024 AD.

      • 5- The effective date of the provision of Article (26) of the Regulation, regarding the branches of valuation of machinery, equipment, and movable property, and valuation of precious metals and gemstones, shall be as follows:

        • A- The branch of valuation of machinery, equipment, and movable property shall be effective on 1/7/1446 AH, corresponding to 1/1/2025 AD.

        • B- The branch of valuation of precious metals and gemstones shall be effective on 19/2/1451 AH, corresponding to 1/7/2029 AD.

    • Third: All practitioners of the valuation profession in the branch of precious metals and gemstones must, before the enforcement of the Regulation - approved in item First of this decision - regularize their status in accordance with the provisions and rules governing the valuation profession, particularly the following:

      • 1- Obtaining one of the Authority’s membership categories before 6/1/1447 AH, corresponding to 1/7/2025 AD.

      • 2- Obtaining the license to practice the profession before 16/1/1448 AH, corresponding to 1/7/2026 AD.

    • Fourth: This decision shall be effective from the date of its publication in the Official Gazette and shall repeal any conflicting decisions.

Chapter 1: Definitions

Article 1

  • 1- The words and phrases contained in this Regulation shall have the meanings specified before each of them in Article (1) of the Law for Certified Appraisers, issued by Royal Decree No. (M/43) dated 9/7/1433 AH, and its amendments.

  • 2- The following words and phrases - wherever they appear in the Regulation - shall have the meanings clarified before each of them; unless the context requires otherwise:

  • Regulation: The Implementing Regulation of the Law for Certified Appraisers.

  • Council: The Board of Directors of the Authority.

  • Chief Executive Officer: The Chief Executive Officer of the Authority.

  • Appraisers Registration Committee: The committee formed under Article Seven of the Law.

  • Profession: The profession of appraisal.

  • Standards: The appraisal standards adopted by the Authority.

  • Evidence: The professional evidence issued by the Authority for each branch of appraisal, or issued for specific purposes.

  • Code of Conduct: The code of conduct for the appraisal profession and its ethics.

  • Continuing Education Rules: The rules for continuing professional education programs.

  • Provisions and Rules Governing the Appraisal Profession: Include the provisions of the Law, the Regulation, the Code of Conduct, the Standards, the Evidence, the Continuing Education Rules, and the decisions and instructions issued by the Authority related to the profession.

  • General Assembly: A general assembly consisting of all primary members who have paid their annual membership fees.

  • Supervisory Committee: The committee that supervises the election of Council members from the certified appraisers.

  • Voters: All primary members of the Authority, who have paid their annual membership fees and whose membership is valid at the time of opening the nomination for Council membership.

  • Review Committee: The committee that reviews violations of the provisions and rules governing the appraisal profession.

  • Subscriptions: The financial fees determined for membership categories and the establishment account, and the services, works, and licenses provided by the Authority, including the financial fees for studying claims.

  • Appraisal Establishment: The individual establishment or professional company that meets the regulatory requirements related to practicing the appraisal profession.

  • Hours of Experience: The hours of professional practice acquired through performing appraisal work, which the Authority determines the mechanism for calculating, and calculating what is equivalent to it from the hours allocated for indirect work and similar activities related to appraisal work.

  • Appraisal Report: The document issued by the certified appraiser to their clients, including the result of the appraisal, and fulfilling the obligations of the certified appraiser as specified in the provisions and rules governing the appraisal profession.

  • Client: A natural or legal person who commissions the appraiser to perform the appraisal task.

  • Electronic Systems: The electronic systems or means adopted by the Authority to organize the practice of the profession, including the following:

    • A- Electronic Portal: An electronic services portal that includes all services provided by the Authority to its members, through which they document their work and record their experiences.

    • B- Estimation System: An electronic system created by the Authority to manage and organize the processes of appraisal and damage estimation in the centers accredited by it, aiming to enable the Authority to supervise, develop, and organize and extend control over the profession of appraisal and damage estimation in some other branches of appraisal that the Council may add.

    • C- Any system or electronic means adopted by the Authority to organize the practice of the profession.

  • Establishment Account: An electronic account created by the certified appraiser in the electronic systems, with the data required by the Authority specified; it aims to organize all works issued by appraisal establishments, and provides the certified appraiser with a means to supply the Authority with their data, address, and all information requested, as well as deposit the appraisal reports issued by them.

  • Summary of the Appraisal Report: An electronic form in the electronic systems specified by the Authority, detailing the required data, through which the certified appraiser summarizes the appraisal report issued by them.

  • Vehicle Damage Appraisal Branch: The branch concerned with estimating the repair value of the damaged vehicle, and estimating all costs or damages associated with it.

  • Precious Metals and Gemstones Branch: The branch concerned with estimating the value of precious metals and gemstones, and anything that is inherently included within them according to what is specified by the Evidence and Standards.

Chapter 2: Membership

Article 2

  • 1- The categories of membership in the Authority - according to Article (Twenty-Four) of the Law - are as follows:

    • A- Regular Members: These are individuals who hold a university degree in one of the specializations recognized by the Authority, provided they obtain a fellowship certificate in one of the evaluation branches, and the name of this membership is supplemented by the name of the branch in which the fellowship certificate was obtained.

    • B- Associate Members: These are individuals who hold a university degree in one of the specializations recognized by the Authority without obtaining a fellowship certificate, and the name of this membership is supplemented by the name of the branch in which they have passed (Level One) of the levels required to obtain the fellowship certificate for that branch.

    • C- Honorary Members: These are individuals who are granted membership by the Council in recognition of their achievements or services to the profession of evaluation, whether they are natural or legal persons, and this membership is not limited by duration.

    • D- Student Members: These are individuals who apply for membership from students studying university specializations related to any branch of evaluation, and the name of this membership is supplemented by the name of the branch specified by the membership applicant, and this membership is not granted in more than one branch of evaluation, nor to those who have exceeded the age of twenty-five.

  • 2- The Authority shall periodically determine the university degrees and recognized specializations referred to in this article, provided that the academic degree is granted by an accredited entity.

Article 3

  • Both the affiliated member and the affiliated student are allowed to acquire experience hours and work in a licensed evaluation establishment, provided that the affiliated student commits to passing Level (One) of the levels required to obtain the fellowship certificate in the branch in which they hold membership before working in any establishment.

Article 4

  • In accordance with the provisions of Article (2) of the Regulation, the following conditions must be met for an individual to be granted membership in the authority:

  • 1- Must have full capacity.

  • 2- Must have a good reputation and conduct, and must not have been previously convicted - by a final judgment - of a legal penalty or in a crime that undermines honor and integrity unless rehabilitated.

  • 3- Must attach to the application for membership all data, documents, and forms required by the authority.

  • 4- Payment of the financial fee for annual membership subscriptions.

Article 5

  • The competent administration - which is entrusted with a decision from the President to register and manage the memberships of the authority - shall study the claims for membership - after the payment of the financial fee for studying the claim as determined by the authority - and the procedures for granting membership, without prejudice to the provisions contained in this chapter of the regulation, shall be as follows:

    • 1- The membership claim is submitted according to the procedures specified by the authority.

    • 2- The competent administration shall take the necessary measures to verify the applicability of the membership conditions to the applicant, and the accuracy of the data provided by the membership applicant. The applicant must fulfill the requirements within a period not exceeding (thirty) days from the date of being notified; otherwise, the claim shall be considered as if it never existed.

    • 3- The competent administration shall notify the membership applicant via electronic systems of the authority's decision regarding their claim, and request the payment of the financial fee for membership if this decision is issued in approval.

    • 4- After confirming the payment of the financial fee for membership, the competent administration shall issue the membership and notify the applicant electronically, and reflect its data on the official website of the authority.

  • The same procedures and conditions required for granting membership shall be followed for renewing membership, provided that renewal claims are submitted at least sixty days before the membership expires.

Article 6

  • The duration of membership and the duration of the evaluation entities' accounts is one year, starting on the first day of each Gregorian year and ending at its conclusion. The financial fee for membership and the evaluation entities' accounts is calculated on a daily basis, with the total number of days for one Gregorian year being (365) days. In the event that the issuance or renewal of membership or the account of the entity occurs after the beginning of the last quarter of the Gregorian year - that is, at the end of the day (the thirtieth) of September - the financial fee for this period will be calculated in addition to the financial fee for the following year.

Article 7

  • 1- The membership of the primary member shall not be renewed if they do not fully comply with the provisions of the continuing education regulations.

  • 2- The membership of the associate member or the student member shall not be renewed from the date of obtaining membership unless they pass the course and examination specified by the authority every two (2) years, except for those who are enrolled in the levels required to obtain the fellowship certificate.
