Regulation Governing the Practice of Transaction Authentication before Governmental Entities

Article 1

The following words, wherever they appear in this Regulation, indicate the meanings specified before them unless the context requires otherwise:
- Follow-up: It refers to the act of professionally pursuing and completing transactions with government agencies on behalf of the transaction owners and those in need, in cases where the nature of the transaction does not require the owner to be present in person.

- Register: It is the Commercial Register issued by the Ministry of Commerce or one of its branches for the practice of the profession of follow-up.

- License: It is the permission issued by the Ministry of Commerce or one of its branches to practice the profession of follow-up on transactions with government agencies for a specified period.

Article 2

Previous Amendments

The following conditions must be met for the issuance of the license:
A- The applicant for the license must be a Saudi national who is proficient in reading and writing.
B- The applicant must be at least (eighteen years old).
C- The applicant must not have been previously convicted of a crime that undermines honor or trust, unless their status has been restored.
D- The applicant must provide the Ministry of Commerce a bank guarantee in the amount of ten thousand Riyals.

Article 3

The owner of the documentation office must record in his boards and all printed materials that he practices the profession of documentation alongside his name and registration number. He must also display the types of services and their fees in a prominent place within the office.

Article 4

The office of the follow-up agent must provide the following documents:
A - Regularly numbered records that include all data of the applicants for the follow-up service request, fulfilling the type of service, its fee, the client's name and address, the date of the service request, and the duration required to complete it.

B - A financial record showing the office's revenues and expenses, and to retain these records for no less than ten years, in accordance with the Commercial Books System issued by Royal Decree No. (M/61) dated 17/12/1409 AH.
C - Receipts in original and copy, with the original attached to the transaction and the applicant for the service receiving the copy.
D - A contract signed between the parties, with the applicant for the service retaining the original contract.

Article 5

The office of the legal representative must ensure that the service applicant agrees to the type of service being provided, and obtain their signature on that, without making any modifications or deletions to the documents received. They must perform their work accurately without negligence or delay, maintain the confidentiality of the clients they deal with, and return the documents to their owners.

Article 6

The owner of the office of follow-up must appoint a person, in case of his absence, who meets the conditions mentioned in Article (2) to carry out the office's work. This does not exempt the owner of the office from liability for violating any provision of these regulations.

Article 7

A- It is prohibited for the owner of the follow-up office to announce their activity before the issuance or renewal of the license from the competent authority.
B- It is prohibited for the owner of the follow-up office to agree to carry out follow-up activities with institutions or companies that have more than fifty (50) foreign workers.
C- It is prohibited for the owner of the follow-up office to employ non-Saudis in the profession of follow-up.

Article 8

The offices of legal representation are subject to the supervision and oversight of the Ministry of Commerce.

Article 9

The Ministry of Commerce - upon meeting the conditions - opens files for licensed agents and grants them a license to practice this profession for a period of five years, in exchange for an issuance fee. This license may be renewed for a similar duration or periods, also in exchange for a fee, and agents must present the license upon request.

Article 10

In the event of the expiration or cancellation of the license for the follow-up for any reason, the bank guarantee shall be released after ensuring that there are no obligations to third parties on the office.
