Statute of the National Occupational Health and Safety Council

Article 1

  • The following words - wherever they appear in this regulation - shall have the meanings specified next to each, unless the context requires otherwise:

  • Regulation: Regulation of the National Occupational Health and Safety Council.

  • Council: National Occupational Health and Safety Council.

  • President: President of the Council.

  • Ministry: Ministry of Human Resources and Social Development.

  • Minister: Minister of Human Resources and Social Development.

  • Occupational Health and Safety: Protection of the employee from any hazard related to their work that poses a threat to their safety or health, including physical, mental, and social health.

Article 2

  • A council named (National Occupational Health and Safety Council) shall be established, which is organizationally linked to the Minister, and its headquarters shall be in the Ministry in the city of Riyadh.

Article 3

  • The Council aims to implement governance of occupational safety and health at the national level, to define and coordinate the roles among the relevant government entities, and to monitor the implementation of the national policy for occupational safety and health. To achieve this, it has the authority and necessary powers, specifically including the following:

  • 1- Reviewing the legislations, laws, regulations, programs, and any other regulatory tools related to occupational safety and health, and proposing the necessary amendments regarding them in accordance with the legal procedures.

  • 2- Working on establishing an effective and comprehensive monitoring and evaluation system for occupational safety and health, in coordination with the relevant entities.

  • 3- Developing a comprehensive national program for reporting work-related accidents, injuries, and occupational diseases, and documenting the reports and the results of the investigations related to them, in coordination with the relevant entities.

  • 4- Providing consultations and technical support regarding the field of occupational safety and health.

  • 5- Working on developing and adopting a specific and clear governance structure for occupational safety and health at the national level; to ensure the existence of an effective and flexible system in applying the provisions of occupational safety and health in the workplace, in coordination with the relevant entities.

  • 6- Coordinating the roles and responsibilities among the relevant government entities concerning occupational safety and health; to avoid duplication of efforts.

  • 7- Approving national programs and initiatives related to occupational safety and health, in coordination with the relevant government entities.

  • 8- Enhancing cooperation between employers, employees, and their representatives; to promote occupational safety and health.

  • 9- Evaluating and monitoring the impact and sustainability of occupational safety and health activities on the work environment.

  • 10- Working on raising awareness of the importance of occupational safety and health, in coordination with the relevant entities.

  • 11- Working on developing resources and capacities in the field of occupational safety and health, in coordination with the relevant entities.

  • 12- Reviewing international reports related to occupational safety and health.
     

Article 4

Previous Amendments
  • A- The Council shall be formed under the chairmanship of the Minister, and membership of the following:

    • 1- Deputy Minister of Labor, member and vice chairman

    • 2- A representative from the Ministry of Health.

    • 3- A representative from the Ministry of Finance.

    • 4- A representative from the Ministry of Industry and Mineral Resources.

    • 5- A representative from the Ministry of Municipal and Rural Affairs and Housing.

    • 6- A representative from the Ministry of Transport and Logistic Services.

    • 7- A representative from the Ministry of Energy.

    • 8- A representative from the Ministry of Education.

    • 9- A representative from the Ministry of Environment, Water, and Agriculture.

    • 10- A representative from the Public Health Authority.

    • 11- A representative from the General Organization for Social Insurance.

    • 12- A representative from the General Directorate of Civil Defense.

    • 13- A representative from the General Authority for Industrial Security.

    • 14- A representative from the Saudi Standards, Metrology and Quality Organization.

    • 15- A representative from the Saudi Chambers Federation.

    • 16- A representative from the National Committee for Labor Committees.

  • B- The rank of Council members representing government entities shall not be less than the fifteenth rank, or its equivalent.

Article 5

  • 1- The meetings of the Council are held at its headquarters, and may, when necessary, be held at any other location within the Kingdom as determined by the President or his Deputy.

  • 2- The Council shall meet - at the invitation of the President or his Deputy - at least once every three months, and whenever necessary, and if requested by at least one-third of its members. The invitation to the meeting must be sent in writing at least seven days prior to the meeting, and must include the agenda of the meeting.

  • 3- A meeting of the Council is not considered valid unless the majority of its members are present, including the President or his Deputy.

  • 4- The decisions and recommendations of the Council are issued by a majority of the votes of the attending members at least. In the event of a tie, the side that the President of the meeting voted for shall prevail.

  • 5- The Council may hold meetings and vote remotely, using technical means.

  • 6- The Council may make decisions and recommendations by circulating them among the members, who shall sign to indicate their acknowledgment. Decisions and recommendations made in this manner are not considered valid unless voted on by all members of the Council, and a decision or recommendation shall not be effective unless it has the approval of at least two-thirds.

  • The decision and recommendation made in this manner shall be presented to the Council at the first subsequent meeting for documentation in the minutes of the meeting.

  • 7- The Council may invite anyone it sees fit to attend its sessions without having the right to vote.

  • 8- No member may abstain from voting, nor may they delegate another member to vote on their behalf in their absence.

  • 9- The deliberations, recommendations, and decisions of the Council are documented in minutes signed by the President of the meeting and the attending members.

  • 10- The Council issues the rules and procedures governing the holding of its meetings and the mechanisms for making its recommendations and decisions.

Article 6

  • 1- The Council may form permanent or temporary committees from its members or others, assigning to them such tasks as it deems appropriate. The decision to form each committee shall specify its chairperson, members, their remuneration, and their competencies. These committees may seek assistance from whomever they deem necessary to perform the tasks assigned to them.

  • 2- The Council may seek assistance from consulting offices, experts, specialists, and qualified consultants to aid it in performing its tasks.

Article 7

  • The council shall have a General Secretariat linked to the President, headed by a Secretary-General, appointed by the President, and provided with a sufficient number of staff, along with the necessary administrative equipment.

Article 8

  • The General Secretary of the Council shall undertake all administrative, financial, and technical secretarial tasks that serve the purposes of the Council, and shall specifically exercise the following powers and responsibilities:

  • 1- Preparing the work of the Council and its subcommittees.

  • 2- Supervising the work carried out by consulting offices, experts, specialists, and consultants engaged by the Council; in preparation for submission to the Council.

  • 3- Following up on the work of the committees formed by the Council.

  • 4- Notifying the relevant authorities of the Council's decisions and recommendations, and following up on their implementation.

  • 5- Proposing the regulations governing the work of the secretariat and submitting them to the Council for approval.

  • 6- Preparing reports on the work and achievements of the Council at the end of each fiscal year and submitting them to the Council.

  • 7- Preparing studies and research related to the work of the Council through committees formed for this purpose.

  • 8- Representing the Council before judicial, administrative, and other authorities, and may delegate others to do so.

  • 9- Any other work assigned to him by the Council.

Article 9

  • A budget (program) is allocated to the council within the Ministry's budget, which is disbursed by a decision of the President.

Article 10

  • The employees of the Council Secretariat are subject to the regulations and rules in force in the Ministry.
