The terms and phrases mentioned below - wherever they appear in this Regulation - shall have the meanings specified next to each of them, unless the context requires otherwise:
The Center: National Water Efficiency and Conservation Center.
Regulation: Implementing Regulation for Monitoring and Compliance with Water Efficiency and Conservation Standards.
Law: Water Law.
Water Efficiency: Improving the efficiency of the water supply chain.
Water Conservation: Optimal use of water for urban, industrial, or agricultural purposes.
Committee: Committee for reviewing and adjudicating violations of the provisions of the law related to the Ministry's jurisdiction and its regulations.
Authorities Competent: These are government entities from ministries, agencies, public institutions, centers, and similar entities that have the authority to issue legislation, standards, or requirements related to water efficiency and conservation.
Urban Sector: Consumers of water for residential, commercial, construction purposes, and for public utilities, landscaping, public gardens, and similar uses.
Agricultural Sector: Consumers of water for plant and animal wealth purposes.
Industrial Sector: Consumers of water for industrial purposes including oil extraction, gas, mining, and manufacturing goods.
Maximum Flow Rate: The upper limit of the liquid flow specified in the product, measured in liters per minute (liters/minute), and for urinals with flow systems and toilets with dual/ single flush and eastern toilet flush tanks (liters/flush).
Nominal Flow Rate: The volume of liquid that passes through the product, measured in liters per minute (liters/minute), and for urinals with flow systems and toilets with dual/ single flush and eastern toilet flush tanks (liters/flush).
Specification: An approved document that sets the rules and instructions or characteristics for products or processes and methods of production related to it (Saudi specification, national specification, regional specification, international specification).
Products: These are sanitary products and equipment that control the flow (flush) of water and direct it, including:
Faucets of all types and shapes, toilets that operate with a water flow (flush) system of all types and shapes, including flush tanks (siphons), for all mechanical or electronic types or those that operate with sensors, designed to conserve water consumption.
Water Quota: The amount of water specified according to the needs of different crops.
Water Footprint: A detailed analysis of the water used in goods and services in the Kingdom.
Gray Water: Water resulting from various uses - excluding water from toilets - and includes water from bathing, hand washing sinks, kitchens, dishwashers, laundry sinks, car washing, floor washing, or swimming pools.
Licensed Providers: Providers of water efficiency and conservation services who have obtained licenses from the National Water Efficiency and Conservation Center, according to the requirements specified in the Regulation for Providers of Water Efficiency and Conservation Services.
Service Provider: Licensed - under the provisions of the Water Law - to provide water distribution and retail sale services, or to collect and transport wastewater.
The regulation aims to achieve the following:
1- Establish a comprehensive mechanism to ensure compliance with water efficiency and conservation.
2- Achieve water sustainability through adherence to water efficiency and conservation standards in the urban agricultural, and industrial sectors.
3- Ensure the implementation of the center's strategic plan regarding monitoring and compliance.
4- Ensure compliance with water efficiency and conservation standards.
5- Address current gaps related to monitoring and compliance.
6- Integrate with relevant entities to enhance water efficiency and conservation.
7- Activate the center's supervisory role in ensuring compliance with water efficiency and conservation standards.
8- Establish the legal basis for the monitoring mechanism on the public sector and escalation procedures to the supreme authority.
All natural or legal persons, whether public or private, are subject to the provisions of this Regulation, and its provisions apply for the purposes of monitoring compliance with the standards of efficiency and rationalization of water in the urban, agricultural, and industrial sectors.
The entity responsible for extracting, producing, transporting, distributing, and using water in the urban sector shall comply with the requirements and standards of the regulations guiding water consumption, according to what is issued by the competent authorities, including but not limited to the following:
1- What is stated in the checklist in the Water Efficiency and Conservation Guide for Buildings "approved by the National Committee for the Saudi Building Code."
2- The maximum flow rate for water-saving devices.
3- The permissible limits for the nominal flow rate of water-saving devices.
4- The technical regulations and specifications for water-saving products and devices.
5- The priorities for water use stated in the Water Law, and what is issued by the competent authorities in this regard.
The entity responsible for extracting, producing, transporting, distributing, and using water in the agricultural sector is obligated to install advanced and efficient tools and technologies, adhere to water allocation systems, and direct usage in a manner that ensures the sustainability of water in the agricultural sector, achieving the minimum environmental balance and complying with the standards and requirements issued by the competent authorities (Agriculture Agency and Saudi Irrigation Organization) in this regard, including but not limited to the following:
1- Requirements for obtaining water supply licenses in the agricultural sector.
2- Compliance with the priorities for water use in the agricultural sector according to the law and the directives issued by the competent authorities.
3- Water allocations for the quantities of water according to crop needs.
4- Directing usage to supporting water sources, then surface water, then renewable groundwater, and finally non-renewable groundwater according to usage directives, in accordance with what is stipulated in the Implementing Regulation of the Water Law regarding the tasks of the Ministry of Environment, Water, and Agriculture.
The entity responsible for extracting, producing, transporting, distributing, and using water in the industrial sector is obligated to comply with the standards and requirements issued by the competent authorities, including but not limited to the following:
A- Obligation to install water-saving systems.
B- Obligation to adhere to the required water quantities for each industry.
C- Obligation to comply with the legally authorized uses.
D- Use of water in accordance with the priorities specified by law and what is issued by the relevant authorities.
E- Decisions regarding the allocation of the water footprint for industrial products.
F- Directing usage to supporting water sources, then surface water, then renewable groundwater, and finally non-renewable groundwater according to usage directives, in accordance with the Implementing Regulation of the Water Law, related to the tasks of the Ministry of Environment, Water, and Agriculture.
The licensees are obligated to provide water efficiency and conservation services by verifying the standards that ensure the rationalization of consumption in the urban, agricultural, and industrial sectors in accordance with what is issued by the center. Among those standards, but not limited to, are the following:
A- Reviewing the quantities of water consumption in the urban, agricultural, and industrial sectors and the extent of their compliance with the standard quantities.
B- Verifying the presence of water-saving sanitary tools in accordance with the standards issued by the relevant authorities.
C- Issuing reports on water efficiency and conservation and providing solutions.
D- Maintaining the confidentiality of information and customer data.
