Article 5: Conditions and Regulations for Issuing Well Drilling Licenses for Agricultural Purposes

  • 1- It is permitted (to drill new wells, drill alternative wells, and clean and deepen existing wells) on agricultural lands located in the Arabian Shield area and in the exempt area on the continental shelf, without the requirement of reclamation.

  • 2- It is permitted (to drill alternative wells, and clean and deepen existing wells) on agricultural lands located on the continental shelf according to the following conditions:

    • A- The land must contain existing agricultural or animal activities.

    • B- Attach the developed agricultural record.

    • C- No restricted or prohibited activities should be practiced.

    • D- The farm must apply the use of conservation methods, and in case it does not apply water conservation methods, the farm owner shall sign an electronic written commitment to use water conservation methods within a year, in accordance with the water quotas.

    • E- A commitment to install an electromagnetic meter on the well pump with a data transmitter according to the specifications approved by the Ministry, and under its supervision, and the Ministry will install chips on these transmitters to transfer data to the Ministry's site.

  • 3- It is permitted (to drill new wells, drill alternative wells, and clean and deepen existing wells) for specialized projects (greenhouses, hydroponics, vertical farming, wheat cultivation, poultry projects, poultry slaughterhouses, red meat factories, livestock fattening projects, nurseries, fish farming in the Arabian Shield only) according to the following conditions:

    • A- Attach the construction license for establishing the project.

    • B- Attach a license for wheat or fodder cultivation.

    • C- Attach the developed agricultural record.

    • D- Priority for drilling is given to secondary formations if available, and the well is drilled according to the Ministry's specifications.

    • E- Priority is given to establishing these projects on lands that were previously cultivated with fodder or wheat.

    • F- No source of treated water is available for agricultural nursery projects.

    • G- Fish farming projects are permitted only in the Arabian Shield areas.

    • H- The project owner commits not to change the type of project or irrigation method or expand the area without obtaining approval from the Ministry's Agriculture Agency and the Water Agency.

    • I- A commitment to install an electromagnetic meter on the well pump with a data transmitter according to the specifications approved by the Ministry, and under its supervision, and the Ministry will install chips on these transmitters to transfer data to the Ministry's site.

Article 6: Conditions and Regulations for Issuing Well Drilling Licenses for Industrial Purposes

  • 1- The (drilling of new wells, drilling of alternative wells, and cleaning and deepening of existing wells) is permitted for bottled drinking water factories and ice factories according to the following conditions:

    • A- A valid commercial registration that includes the activity of bottled water production.

    • B- An industrial license for establishing the factory.

    • C- A commitment to install an electromagnetic meter on the well pump with a data transmitter according to the specifications approved by the Ministry, and under its supervision. The Ministry will install chips on these transmitters to transfer data to the Ministry's site.

  • 2- The (drilling of new wells, drilling of alternative wells, and cleaning and deepening of existing wells) is permitted for mining projects, quarries, block and brick factories, cement and ready-mix concrete factories, and other factories according to the following conditions:

    • A- The unavailability of treated water to serve the site.

    • B- A valid project establishment license from the competent authority.

    • C- Specification of the daily water quantities required for the factory and their purpose.

    • D- The drilling must be according to the Ministry's specifications and under its supervision.

    • E- Monitoring wells must be drilled according to the standards set by the Ministry.

    • F- The wells and their equipment must be handed over to the Ministry after the concession period ends, or the licensee must fill the well with technical filling when it is no longer needed.

    • G- A commitment to install an electromagnetic meter on the well pump with a data transmitter according to the specifications approved by the Ministry, and under its supervision. The Ministry will install chips on these transmitters to transfer data to the Ministry's site.

  • 3- The (drilling of new wells, drilling of alternative wells, and cleaning and deepening of existing wells) is permitted for the Industrial Cities Authority and Economic Cities according to the following conditions:

    • A- The site must not be served by a drinking water network.

    • B- Specification of the daily water quantities required for the site.

    • C- The purpose of the water must be urban use.

    • D- Submission of a plan that includes specifying a special location as a well field, the number of required wells, and the daily water needs in the city.

    • E- In case network water becomes available after drilling and operating the well, the well must be closed and kept for emergencies.

    • F- A commitment to install an electromagnetic meter on the well pump with a data transmitter according to the specifications approved by the Ministry, and under its supervision. The Ministry will install chips on these transmitters to transfer data to the Ministry's site.

  • 4- The (drilling of new wells, drilling of alternative wells, and cleaning and deepening of existing wells) is permitted for fuel stations according to the following:

    • A- The site must not be served by a drinking water network.

    • B- A commitment not to use the well for discharging any waste.

    • D- A commitment to install an electromagnetic meter on the well pump with a data transmitter according to the specifications approved by the Ministry, and under its supervision. The Ministry will install chips on these transmitters to transfer data to the Ministry's site.

  • 5- The (drilling of new wells, drilling of alternative wells, and cleaning and deepening of existing wells) is permitted for road projects according to the following:

    • A- Approval from the Ministry of Transport and Logistic Services for drilling the well.

    • B- A commitment to install an electromagnetic meter on the well pump with a data transmitter according to the specifications approved by the Ministry, and under its supervision. The Ministry will install chips on these transmitters to transfer data to the Ministry's site.

    • C- The wells and their equipment must be handed over to the Ministry upon completion of the road construction, and if the Ministry no longer needs them, the licensee is obligated to fill the well according to the Ministry's specifications and under its supervision by an approved contractor.

Article 7: Technical Specifications for Well Fortification

  • 1- Manual Wells:

    • A- Construct a reinforced concrete collar around the well and connect it with well casing concrete according to the diameter of the well, ensuring that its height is not less than (1.5) meters from the ground surface and with a thickness of (50) cm.

    • B- Install a galvanized iron ladder that is rust-resistant for the entire depth of the well.

    • C- Cover the well with a lid made of corrugated sheet metal with a thickness of (6) mm, mounted on (4) steel brackets installed at intersections.

    • D- Place a guidance sign measuring (0.50*1m) on the wall of the collar indicating the depth of the well and the number and date of the drilling license.

  • 2- Tubular Wells:

    • A- Create a reinforced concrete slab around the well with dimensions of (1m * 2m * 3m).

    • B- Install a cover on the wellhead with a thickness of (8 mm) before use, and after the need for it has ceased.

    • C- Place a guidance sign measuring (0.50*1m) indicating the depth of the well and the number and date of the drilling license.

Article 8: Other Purposes Not Mentioned in These Terms

  • The claim is studied by a technical committee formed by the Ministry's Water Agency to approve or disapprove it, such as (shared wells, new wells, monitoring wells, test wells, and wells for research and studies) based on the location of the well and its purpose.
