Regulatory Arrangements for the Center for Spending Efficiency

Article 1

  • The following words and phrases - wherever they appear in these arrangements - shall have the meanings specified next to each, unless the context requires otherwise:

    • 1- Center: Center for Achieving Spending Efficiency.

    • 2- Arrangements: Organizational arrangements of the Center.

    • 3- Council: Board of Directors of the Center.

    • 4- Minister: Minister of Finance.

    • 5- Chief Executive: Chief Executive of the Center.

    • 6- Government Agencies: Ministries and other government agencies funded by the state’s general budget.

Article 2

  • 1- The center enjoys independent legal personality, financial and administrative independence, and is organizationally linked to the Minister. Its main headquarters is located in the city of Riyadh, and it has the authority to establish branches and offices within the Kingdom as needed.

  • 2- The center operates on commercial principles and standards, and possesses the flexibility and powers that enable it to carry out its missions, in accordance with the financial and administrative regulations.

Article 3

  • The center aims to contribute to achieving spending efficiency in government agencies in accordance with the relevant plans, programs, and decisions, and to monitor the implementation of those agencies for the initiatives and programs related to the center's jurisdiction.

Article 4

  • Without prejudice to the competencies and responsibilities of other entities, the center shall undertake all necessary actions to achieve its objectives, including the following:

    • 1- Formulating policies, strategies, plans, and programs aimed at achieving efficiency in the expenditure of government agencies, in accordance with legal procedures, and coordinating with the internal audit departments in those agencies to monitor their implementation after approval.

    • 2- Studying the details of expenditure and the operational and capital practices related to it in government agencies, identifying opportunities to achieve expenditure efficiency, and determining the savings resulting from it in the budgets of those agencies.

    • 3- Proposing regulations related to expenditure efficiency, suggesting amendments to the existing ones, and submitting them to complete the necessary legal procedures.

    • 4- Approving indicators and standards for measuring expenditure efficiency, and continuously developing them.

    • 5- Developing the tools, methodologies, and techniques necessary to enhance the capabilities of government agencies to achieve expenditure efficiency.

    • 6- Adopting best practices and technological applications to achieve expenditure efficiency.

    • 7- Preparing reports to measure and monitor expenditure efficiency in government agencies and submitting them to the Council of Economic and Development Affairs.

    • 8- Proposing executive plans for each initiative or program aimed at achieving expenditure efficiency, recommending the appropriate entity to undertake the implementation of the initiative or programs, and presenting that to the Council of Economic and Development Affairs.

    • 9- Reviewing initiatives and programs to achieve the Kingdom's Vision (2030), to ensure their alignment with the objectives of achieving expenditure efficiency, and proposing necessary changes to ensure expenditure efficiency, and submitting them to complete the necessary actions regarding them.

    • 10- Coordinating with government agencies to form working teams within them to study the details of expenditure and the operational and capital practices related to it.

    • 11- Holding meetings, seminars, conferences, and specialized training courses in the field of achieving expenditure efficiency.

    • 12- Engaging experts, consultants, and distinguished consulting firms in the fields of achieving expenditure efficiency.

    • 13- Establishing partnerships and cooperation agreements with relevant government agencies to exchange experiences and achieve expenditure efficiency targets.

    • 14- Preparing studies and scientific research in the fields of expenditure efficiency and publishing them.

    • 15- Providing administrative and technical consultations in the fields of achieving expenditure efficiency.

    • 16- Encouraging government agencies to excel in expenditure efficiency by proposing incentives for that, and submitting them to complete the necessary actions regarding them.

Article 5

  • The center shall have a Board of Directors chaired by the Minister, with no less than five members, who are appointed by a decree from the Prime Minister based on the Minister's proposal. Their membership shall be for a period of three years, renewable once.
     

Article 6

  • The Council is responsible for overseeing the management of the center's affairs and conducting its matters, and it makes all necessary decisions to achieve its objectives within the limits set by the arrangements. In particular, it has the following powers:

    • 1- Approving the center's general policies and the plans and programs necessary for their implementation.

    • 2- Approving the organizational structure of the center.

    • 3- Approving the center's financial and administrative regulations.

    • 4- Approving the operational procedures of the center.

    • 5- Approving the establishment of branches and offices for the center.

    • 6- Reviewing the periodic reports submitted regarding the progress of work in the center.

    • 7- Approving the draft budget of the center, its final account, the auditor's report, and the annual report, in preparation for submitting them according to the applicable legal procedures.

    • 8- Approving the services that can be provided to non-governmental entities that request them, and the financial compensation for those services.

    • 9- Accepting donations, gifts, grants, bequests, endowments, and assistance provided to the center, in accordance with the regulations governing that.

    • 10- Appointing an external auditor and an internal financial controller.

    • The Council may form permanent or temporary committees from among its members or others. It assigns to them the tasks it deems necessary. The decision to form each committee specifies its chairperson, members, and competencies. These committees may seek assistance from whomever they deem necessary to perform the tasks assigned to them.

    • It may delegate some of its tasks to the Chief Executive Officer or to whomever it sees fit among the center's staff, in accordance with the requirements of the work therein.

Article 7

  • 1- The Council shall meet at the invitation of its Chairman once every three months, and whenever necessary as deemed by the Chairman of the Council, or if requested by at least one-third of the members. The invitation must be sent in writing at least seven days prior to the meeting, and it must include the agenda.

  • 2- The meetings of the Council shall be held in the presence of at least the majority of its members, including the Chairman of the Council or his representative.

  • 3- The decisions of the Council shall be issued by a majority of its members, and in the event of a tie, the side that the Chairman of the meeting votes for shall prevail.

  • 4- No member of the Council may abstain from voting or delegate another member to vote on their behalf in their absence.

  • 5- The discussions and decisions of the Council shall be recorded in minutes signed by the Chairman of the meeting and the attending members, and any member who objects to any decision may record their objection with justification in the minutes.

  • 6- The Council may invite individuals to attend its meetings for assistance without granting them the right to vote.

  • 1- The exchange of data between government agencies and the center shall be conducted electronically whenever possible, in accordance with the applicable regulations and instructions.

  • 2- The center may, after obtaining the Council's approval, publish data and results of spending efficiency to enhance transparency.

Article 10

  • The personnel of the center are subject to the Labor Law and the Social Insurance Law.
