GCC Fertilizers and Soil Conditioners Law

Article 1

The purpose of this law (system) is to regulate the production, import, and trade of fertilizers and soil enhancers in the Gulf Cooperation Council countries.

Article 2

Article 3

  • The provisions of this law (regulation) apply to the following:

    • First: Fertilizers:

    • They are divided into the following types:

      • 1 - Chemical fertilizers, which are:

        • A - Simple inorganic primary element fertilizers (Nitrogen fertilizers, Phosphate fertilizers, Potassium fertilizers).

        • B - Compound inorganic primary element fertilizers:

          • * NPK fertilizers

          • * NP fertilizers

          • * NK fertilizers

          • * PK fertilizers

        • C - Inorganic liquid fertilizers, which include:

          • - Simple fertilizers, which can be either liquid, in suspension, in paste form, or in the form of compressed gases such as ammonia.

          • - Compound fertilizers, which can be either liquid, in suspension, or in paste form.

        • D - Inorganic secondary element fertilizers, which include:

          • - Calcium (Ca)

          • - Magnesium (Mg)

          • - Sulfur (S)

        • E - Inorganic micronutrient fertilizers:

          • - Simple micronutrient fertilizers containing only one element, which are Iron (Fe), Zinc (Zn), Copper (Cu), Manganese (Mn), Boron (B), Chloride (Cl), and Molybdenum (Mo)

          • - Compound micronutrient fertilizers containing more than one element.

      • 2 - Organic fertilizers.

    • Second: Agricultural soil improvers:

    • They include the following:

      • 1 - Soil improvers, which are:

        • - Organic improvers.

        • - Inorganic improvers.

      • 2 - Microorganisms.

Article 4

  • The Minister issues, based on the proposal of the competent authority, decisions that specify the types of fertilizers and agricultural soil enhancers permitted, their specifications, and the conditions and procedures for their use and circulation in the country, and specifically determines the following:

    • A - Specifications for fertilizer and agricultural soil enhancer containers, the labels on them, and the information that must be included.

    • B - Conditions and procedures for the examination and analysis of fertilizers and agricultural soil enhancers, assessing their suitability, and the procedures followed in the systems of contestation or appeal and how to adjudicate them.

    • C - Procedures to be followed regarding fertilizers and agricultural soil enhancers that violate the provisions of this law (system) and the decisions implementing it.

Article 5

The competent authority in the state determines the fees due in accordance with the provisions of the law (system) and its executive regulations.

Article 6

The competent authority is responsible for registering fertilizers and agricultural soil conditioners that may be imported, exported, manufactured, traded, or used in the country.

Article 7

  • 1 - The import or trade of fertilizers and agricultural soil enhancers is prohibited according to the provisions of the previous article, except after obtaining the necessary License from the competent authority. The following are exempted from this:

    • A - Fertilizers and agricultural soil enhancers intended for universities and research centers for scientific research purposes, after obtaining approval from the competent authority.

    • B - Fertilizers and agricultural soil enhancers imported for the purpose of re-exporting, provided that they do not exceed the state’s borders. It is permissible, after taking the necessary precautions in coordination with customs and agricultural quarantine authorities, to transfer the shipment from one outlet to another for the purpose of export.

  • 2 - The manufacturing, preparation, or installation of any type of fertilizer is prohibited except after obtaining the License from the competent authority.

Article 8

No shipment (consignment) is allowed to enter the country except with a phytosanitary certificate issued by the responsible governmental authorities in the country of origin, proving that it is free from weed seeds and harmful microorganisms such as bacteria, fungi, viruses, and nematodes, as well as harmful insect and animal pests.
It must also be accompanied by an analysis certificate indicating that it is free from heavy metals and radioactive elements.

Article 9

The minister may, based on the recommendation of the competent authority, prohibit the production, manufacturing, export, import, or trade of any type of fertilizers and agricultural soil enhancers, either permanently or temporarily, whenever the public interest so requires.

Article 10

Official employees who have the status of judicial officers are entitled to enter places where the activities fall under the provisions of this law (system), for the purpose of ensuring compliance with its provisions and monitoring cases of violations of its provisions or similar provisions.
