When the complaint reaches the competent court, its judge must, on the day the case is submitted to him, set the date of the hearing for the plaintiff, taking into account the order of cases, except for the case of a traveler or a woman in a minor lawsuit, which must be decided as quickly as possible for the execution of the judgment.

If the court schedules a session for the plaintiff to hear his case, the court clerk must obtain his signature on Form No. (1). If the plaintiff is illiterate and does not have a seal, the provisions of Article Six shall apply to him.

The court must notify the defendant to appear at the appointed time to hear the case against him, and the defendant must appear in court at the time specified without delay.

The court shall notify the absent defendant outside the Kingdom of Saudi Arabia with a summary of the lawsuit filed against him and set a time for the hearing through the competent authorities, taking into account the distance for the notice to be sent and the return of the defendant or his agent.

The lawsuit shall only be filed in the country of the defendant if it is within the Kingdom.

If the defendant refuses to sign and is illiterate and does not have a seal, the person responsible for notifying must state this in the original in the presence of two witnesses who will sign the original along with the signature of the person responsible for the notification, and this will suffice.

How to notify the defendant that the court sends him a summons form in two copies, form number (2) with a summary of the lawsuit filed against him, and the judge should not require the plaintiff to submit a written petition or a copy of his claim, but rather record the lawsuit accurately and proceed with it in the legal manner.

The server process must return to the court circuit the notice receipt signed by the defendant indicating receipt of the notice.

Police stations and neighborhood chiefs must assist the court bailiff in performing his duties within the scope of his jurisdiction.

When two adversaries appear before the judge and request to see their case and have it decided due to its simplicity, the judge must hear it immediately if he is not occupied with another case scheduled for that time, or he may order one of his deputies to hear it unless they are also occupied. If the judge and his deputies are all engaged in other cases, the judge must hear the case at the end of the sessions on that day if he or one of his deputies does not find an opportunity to hear it during the sessions.
