The Council of Ministers
After reviewing the transaction received from the Office of the Presidency of the Council of Ministers under the Royal Order No. (5497/ M B) dated 20/ 4/ 1426 AH, which includes a letter from His Excellency the Minister of Transport No. 01/ 661 dated 25/ 3/ 1426 AH, referring to the Royal Order No. (3/ L/ 13369) dated 5/ 6/ 1402 AH, which stipulates that the General Panel for Roads shall bear the expenses of removing obstacles that hinder the implementation of road projects within the project costs, and what His Excellency clarified regarding the problems and obstacles faced by the Panel in this regard.
And after reviewing the minutes No. (429) dated 16/ 12/ 1426 AH, No. (94) dated 13/ 3/ 1427 AH, No. (191) dated 7/ 5/ 1427 AH, and No. (471) dated 29/ 11/ 1427 AH, prepared by the Bureau of Experts at the Council of Ministers.
And after reviewing the recommendation of the General Committee of the Council of Ministers No. (55) dated 17/ 1/ 1428 AH.
It is decided
to continue applying the Royal Order No. (3/ L/ 13369) dated 5/ 6/ 1402 AH, related to the General Panel for Roads bearing the expenses of removing obstacles that hinder the implementation of road projects, and including them within the project costs, taking into account the following:
1- That an agreement is reached between the Ministry of Finance and the General Panel for Roads regarding the amounts necessary for transfer in the budget of the General Panel for Roads, so as not to affect its projects by transferring from them.
2- That the costs submitted by the service provider are reasonable and logical and at their minimum, and do not include works unrelated to the conflict of service with the road, such as renewing the network at the expense of transfer or expansion works for the network at the expense of transfer.
3- That the service providers determine and estimate the costs of protection or transfer as quickly as possible when requested by the Panel, and that the process of transfer and protection begins immediately upon receiving the Panel's letter requesting that, and that the duration of the transfer is not long enough to affect the progress of work on the projects and hinder them and delay their completion.
