The foundations and principles to be guided by when concluding cultural agreements

A-

  • A- Approval of the foundations and general principles to be followed when concluding cultural agreements in the following form:-

First: The Preamble

  • When concluding cultural agreements with Arab, Islamic, and friendly countries, the following general principles and foundations should be adhered to:

  • 1- The importance of relations between the two countries and the mutual desire to affirm and develop them.

  • 2- Working to provide opportunities for constructive cooperation in cultural fields (education, culture, sciences, arts, and media).

  • 3- Organizing programs and types of activities within the framework of the objectives defined by the cultural agreement.

Secondly: The areas of cooperation from which one can choose according to the nature of relations with other countries and the purpose to be achieved from the Agreement.

  • When concluding cultural agreements, the areas of cooperation may include provisions similar to the following:

  • 1- Cooperation in the fields of education, culture, sciences, arts, and media between the relevant institutions, and the exchange of research, studies, and applications of technological innovations in these fields.

  • 2- Exchange of visits by official delegations, experts, researchers, university professors, and specialists in various cultural fields.

  • 3- Encouraging the exchange of publishing outstanding works in cultural fields while ensuring equal protection for the authors from both parties regarding copyright in accordance with local regulations and international agreements signed by both parties.

  • 4- Encouraging and facilitating the exchange of specialized scientific and artistic exhibitions and cultural weeks.

  • 5- Exchange of programs, publications, and official bulletins related to the areas of the agreement in both contracting states, within the limits of applicable regulations.

  • 6- Working to include educational curricula in both countries with informative content that provides a true picture of the other country's civilization and heritage.

  • 7- Striving to exchange information in the field of equivalency of academic certificates and degrees, both academic and practical.

  • 8- Working to exchange scholarships and training opportunities at various levels in educational and training fields, and providing opportunities for training and specialization.

  • 9- Exchange of experiences in the fields of technical education and vocational training, and the exchange of scholarships and training between relevant and specialized institutes and rehabilitation centers.

  • 10- Exchange of information and technical and scientific experiences in the field of rehabilitating the disabled and methods of their education.

  • 11- Exchange of information and experiences in the field of literacy and adult education and related programs.

  • 12- Cooperation between the bodies concerned with youth and sports and sports federations through the exchange of visits and organizing types of youth, student, and scouting activities with a cultural and educational format.

  • 13- Coordinating efforts - when necessary - in cultural fields with Arab, Islamic, and international organizations.

  • 14- Facilitating the exchange of access to rare manuscripts, historical archives, museums, and archaeological libraries, which helps both parties to learn about each other's heritage.

  • 15- Coordination in the field of publishing and teaching the Arabic language to non-native speakers.

  • 16- Coordination (specific to Arab countries) in the field of curricula and educational programs at various educational stages.

Third: Supervision of the Implementation of the Agreement

  • In the field of supervising the Agreement, one of the following two methods shall be followed:

  • 1- Establishing a permanent joint Committee comprising representatives from each Party, which shall meet alternately in each of the two countries (either it is stipulated that its meetings shall be held periodically every year or two years, or it is stipulated that it shall meet as necessary by mutual agreement of the Parties, or it is stipulated that it shall meet at the request of either Party).

  • The Committee's task shall be to supervise the follow-up and implementation of the Agreement, to establish any arrangements and specific measures required for implementation, to overcome any obstacles that may arise during implementation, and to develop relations and opportunities for cooperation between the two countries in various fields.

Fourth: Effectiveness of the Agreement, Duration of Validity, Renewal or Termination

  • In the context of the enforcement of the Agreement, the following may be stipulated:

  • 1- The Agreement shall come into effect from the date of the exchange of the ratified documents or after a certain period from the exchange of the documents, or from the date on which each Party notifies the other Party (whichever comes later) that it has taken the necessary procedures to implement the Agreement, or from a specific date agreed upon in advance in the Agreement.

  • 2- The Agreement shall be effective for a period of (      ) years, automatically renewing for similar periods unless one Party notifies the other Party in writing of its desire to terminate it at least (       ) months prior to the expiration of its term.

  • 3- In the event of the termination of the Agreement, its provisions shall remain in effect for the programs or projects that were undertaken under it and have not been completed at the time of the termination of the Agreement, until the completion of those programs or projects.

Fifth: Documentation of the Agreement

  • 1- It is stipulated in the area of documenting the Agreement that it shall be prepared in four copies, two in Arabic and two in the other language of the state (if it is English or French), or two additional copies in the state language shall be added alongside English or French.

  • 2- It is stipulated that all copies are identical, and the copies that are to be relied upon (in cases of multiple languages) shall be specified in instances of differing interpretations.

B-

  • When there is a need to conclude agreements with another country, coordination shall take place - during the preparation of the draft agreement and before presenting it to the other party - between the Ministry of Foreign Affairs, the Ministry of Higher Education, the Ministry of Education, the Ministry of Media, the Ministry of Labor and Social Affairs, and the General Presidency for Youth Welfare, instead of the committee stipulated in paragraph (Third) of the Council of Ministers Resolution No. 67 dated 16/11/1404 AH.
