Regulation of National Center for the Prevention & Control of Plants, Pests and Animal Diseases

Article (1)

  • The following expressions and words, whenever included in this Regulation, shall have the meaning shown in front of each of them, unless the context otherwise requires:

  • Center: National Center for the Prevention & Control of Plants, Pests and Animal Diseases

  • Regulation: Center Regulation.

  • Ministry: Ministry of Environment, Water and Agriculture.

  • Minister: Minister of Environment, Water and Agriculture.

  • Board: Center Board of Director.

  • Chairperson: Chairperson of Board of Director.

  • CEO: Chief Executive Officer of Center.

  • Pests: Any species, variants, biotypes of a plant or animal organisms, and any pathogen of plants or animals’ nature.

  • Animal diseases: Epidemic or infectious diseases and their transmitters according the classification of the Animal Research Organization.

  • Service Provider: The entities authorized by the Center for combating pests and animal diseases.

  • License: The official document issued by the Center for practicing the activities of combating pest and animal diseases. 

Article (2)

The Center shall enjoy the artificial personality and financial and administrative dependency. It shall be connected (with the Minister) from regulatory perspective. The headquarters of the Center shall be in Riyadh. By virtue of the resolution of the Board, branches or offices of the Company may established inside KSA.

Article (3)

The Center aims to implement all actions required for achieving the policies of the Ministry approved for combating the pests and animal diseases. This is shall be by taking the protective and treating procedures for ensuring the good health of plants and animals and their sustainability, enhancing the participation of the private sector and integrating the efforts of the governmental and private entities in this field.

Article (4)

  • The Center for achieving its purposes be competent with the following:

  • 1- Placing the strategies, plans, programs, initiatives, procedures and controls required for the objectives of the Center.

  • 2- Developing the rules necessary for qualifying and licensing the service providers.

  • 3- Licensing the service providers and taking the regulator procedures against them upon violating the laws or breaching their obligations.

  • 4- Supervising and controlling the services provided by service providers by periodically assessing them. 

  • 5- Contracting with the service providers according to regulatory procedures needed for providing the protective and treating means for the plants and animals.

  • 6- Rapidly interfering for providing the treatment needed regarding the pests and animal diseases in case the service provider fails to abide by its obligation or in case there is not service provider.

  • 7- Periodically conducting an examination for ensuring the non-spread of the pests and discovering the animal diseases. This shall be in cooperation with the competent entities.

  • 8- Developing and approving the prevention and control techniques.

  • 9- Developing and updating the database about the pests and animal diseases and their spread and working on providing the interested parties with the same according to the certified policies.

  • 10-Organizing and controlling the limitation of the spread of pests and animal diseases in coordination with the relevant parties.

  • 11-Developing the emergency plans relating to the pests and animal diseases and supervising their implementation.

  • 12-Determining and specifying the pests and animal diseases possible and their effect and economic damages and updating and spreading the same in the list of pests and animal diseases.

  • 13-Following up the movements of pests and animal diseases in the neighboring countries and during immigration seasons, taking the measures necessary and issuing early alarms about the same.

  • 14-Obtaining the information and data about its competencies and requirements of conducting its task from the individuals, governmental and non-governmental entities.

  • 15-Providing the technical and consulting services in the field of combating pests and animal diseases.

  • 16-Issuing all periodical and annual reports and statistics about the pests and animal diseases after coordination with the Ministry.

  • 17-Holding the exhibits, conferences, seminars and awareness campaigns concerning the combat of pest and animal diseases. This is in coordination with the concerned entities.

  • 18-Concluding the memorandums of understanding and agreements according to the regulatory procedures adopted with the governmental local authorities and nongovernmental entities, including the companies and corporations for benefiting from the best techniques, systems, researches and studies in the field of combating the pests and diseases.

  • 19-Conducting any other competencies established by the Board relating to the objectives of the Center.

Article (5)

  • First: The Center shall have a board presided by the Minister or its representative and membered by the following:

    • 1- Representatives of the Ministry of Environment, Water and Agriculture.

    • 2- Representative of the Ministry of Interior.

    • 3- Representative of the Ministry of Municipal and Rural Affairs.

    • 4- Representative of the Ministry of Finance.

    • 5- Representative of the Ministry of Health.

    • 6- Representative of the National Center for the Prevention & Control of Plants, Pests and Animal Diseases. 

    • 7- Representative of the General Customs Authority.

    • 8- Representative of the Saudi Food and Drug Authority.

    • 9- Three members of those concerned and having experiences in the field of the work of the Center and of the private sector. They shall be nominated by the Minister and regarding whom a resolution shall be issued by the Board. The term of their membership shall be (three years renewable for one time).

  • Second: The class of the representatives of the governmental entities of the Board shall not be less than the fourteenth grade or its equivalent.

Article (6)

  • The Board shall be the dominating authority responsible for managing the affairs of the Center and its matters and taking all resolutions required for achieving its objectives within the limits included in the provisions of the Regulation. It shall in particular be responsible for the following:

  • 1- Approving the strategies, plans, programs, initiatives, procedures and controls relevant to the objectives of the Center.

  • 2- Approving the organizational structure of the Center.

  • 3- Approving the financial regulations in agreement with the Ministry of Finance.

  • 4- Approving the administrative and technical regulations in agreement with the Ministry of Finance regarding the provisions having financial effect mentioned in such regulations.

  • 5- Determining the financial remuneration against the work of the service providers.

  • 6- Determining the financial remuneration paid to the Center against the services and licenses submitted by it.

  • 7- Agreeing on the annual balance sheet draft as well as the draft of final account statement and auditor’s report and annual report for paving the way for submitting the same to the as per the regulatory procedures adopted.

  • 8- Accepting the gifts, subsidies, grants, endowments and assistances submitted by to the Center.

  • 9- Forming working teams of the Board members and others and determining their competencies.

  • The Board is entitled to delegate any or some of its competencies to any officers seemed appropriate to it at the Center as per the requirements of work progress.

Article (7)

  • 1- The meetings of the Board shall be held at the headquarters of the Center. If needed, the same may be held in another place inside KSA.

  • 2- The Chairperson of the Board may appoint one of its members representing the governmental entities to preside the meetings of the Board in case of his/her absence.

  • 3- The Board shall meet four (4) times per year at least based on an invitation by its Chairperson or his/her representative and whenever the interest of the Board so requires. The Chairperson shall invite the Board to the meeting based on the invitation by four of its members at least. The invitation shall be accompanied by the agenda of the meeting.

  • 4- The meeting shall be attended by the majority of the Board members, including the Chairperson or his/her representative to be valid. The resolutions of the meeting shall be taken by the majority of the votes of the attending members at least. If the votes accepting and rejecting a resolution are equal, then the meeting president shall have a casting vote. A member may not abstain from voting or rather delegate another member for voting on his/her behalf in case of his/her absence.

  • 5- If required, the meeting may be held and voting shall be remotely made regarding the resolutions by using the technical means or passing the same to the members attending at least and signing it upon passing it for indicating that all the members realized the same. The resolutions issued in such way shall not be considered as valid except after passing them to all members of the Board, their vote in favor of the same and acquirement of the majority of their votes at least.

  • 6- The deliberations and decisions of the Board shall be recorded in minutes signed by the meeting president and attending members. The rejecting member shall indicate the nature and causes of such objecting in the minutes of the Board meeting.

  • 7- The Board shall invite for its meetings those from whose information and experiences it intends to benefit and they shall not have the right to vote.

Article (8)

  • The Center shall have CEO appointed and dismissed by the resolution of the Board. The said resolution shall determine CEO remuneration and other financial benefits. CEO shall be responsible for managing the Center. The responsibilities of CEO shall be concentrated within the limits stated in the Regulation and regulations issued by virtue thereof as well as the resolutions of the Board. The Center shall practice the following competencies and powers:

  • 1- Supervising the progress of the work of the Center and its personnel.

  • 2- Preparing and inviting for the meetings of the Board, supervising the preparation of the minutes and resolutions of the Board and following up the enforcement of the same after being approved.

  • 3- Proposing the strategies, plans, programs, initiatives, rules and procedures required for implementing the objectives of the Center, and supervising their enforcement after being approved.

  • 4- Appointing, supervising and ending the service of the affiliates of the Center according to the powers granted to the Center and provisions determined in the regulations of the Center.

  • 5- Using the cadres and capabilities distinguished in the field of the work of the Center.

  • 6- Proposing the organizational structure of the Center as well as its financial, administrative and technical regulations and supervising the enforcement of the same after being approved.

  • 7- Contracting for implementing the works and providing the services and otherwise according to the powers assigned by the Board.

  • 8- Issuing the payment orders according to annual balance sheet of the Center approved and taking all financial procedures according to the financial laws and regulations and within the powers delegated thereto by the Board.

  • 9- Preparing the periodical reports about the works, accomplishments, activities and obstacles encountered by the Center and referring the same to the Board.

  • 10- Supervising the preparation of the draft balance sheet of the Center, its final account and annual report and referring the same to the Board.

  • 11-Providing the Board with the suggestion regarding the issues within its competency.

  • 12-Representing the Center before the justice and by the governmental entities, corporations, authorities and other bodies inside and outside KSA and it may delegate others to carry out the same.

  • 13-Undertaking other competencies assigned to it by the Board.

  • CEO is entitled, after the approval of the Board, to delegate some of its competencies and powers to other affiliates of the Center

Article (9)

  • 1- The Center shall have an independent annual balance sheet issued according to the arrangements of the issue of the public balance sheet of the State.

  • 2- The fiscal year of the Center shall be the fiscal year of the State.

Article 10

Previous Amendments
  • 1- The financial resources of the Center shall consist of the following:

    • a) Financial credits allocated to it in the public balance sheet of the State.

    • b) Financial consideration paid to the Center against providing its services and licenses issued by it.

    • c) Gifts, subsidies, grants, endowments and assistances accepted by the Board. d) Other resources established by the Board without contracting with the laws and instructions.

  • 2- The funds of the Board shall be deposited into the current account of the Ministry of Finance in the Saudi Arabian Monetary Agency

  • 3- The Center shall open an account by SAMA. It may open other accounts by any of the banks authorized to work in KSA. Amounts shall paid from such accounts according to Center balance sheets approved and regulations.
