Statute of the General Housing Authority

Article 1

  • The words and phrases listed below – wherever they appear in this regulation – shall have the meanings specified next to them, unless the context requires otherwise:

    • Authority: General Housing Authority.

    • Regulation: Authority Regulation.

    • Council: Board of Directors of the Authority.

    • President: President of the Council.

    • Member: Member of the Council.

    • Governor: Governor of the Authority.

Article 2

The authority enjoys public legal personality and financial and administrative independence, with its main headquarters located in the city of Riyadh. It has the right to establish branches within the Kingdom as needed.

The authority alone has the right to act on the lands allocated to it by the state for public housing projects.

Article 6

  • 1- The Authority shall have a Board of Directors as follows:

    • A- Minister of Economy and Planning as President

    • B- Minister of Finance (Chairman of the Real Estate Development Fund Management Committee) as a Member

    • C- Minister of Social Affairs as a Member

    • D- One of the Undersecretaries of the Ministry of Municipal and Rural Affairs (appointed by the Minister) as a Member

    • E- The Governor as a Member

    • F- Four members who are specialists and have experience in the field of the Authority's work, appointed by a decision of the Council of Ministers, based on a proposal from the President.

  • 2- The term of membership for the members referred to in paragraphs (D/1 and F/1) of this article shall be three years, renewable once.

  • 3- The attendance allowances for the sessions of the Council for the President and members shall be determined by a decision of the Council of Ministers.

Article 7

  • The Council is the authority responsible for managing the affairs of the Authority and conducting its matters, and it makes all necessary decisions to achieve its purposes within the provisions of this Law. It has, in particular, the following powers:

    • 1- Approving the organizational structure of the Authority and its internal regulations.

    • 2- Approving the financial and administrative regulations of the Authority after coordination with the Ministry of Civil Service and the Ministry of Finance.

    • 3- Approving the Implementing Regulation of the Law.

    • 4- Preparing a draft Law for granting lands designated for housing in light of the regulatory arrangements approved for the housing sector, and submitting that according to the legal procedures.

    • 5- Approving the technical regulations, procedures, rules, and environmental, operational, and procedural standards related to housing activities.

    • 6- Approving the work plan of the Authority and its operational plans within the framework of the general state plan.

    • 7- Approving the draft budget of the Authority, its final account, the auditor's report, and the annual report in preparation for submitting that according to the legal requirements.

    • 8- Establishing the rules related to licenses, permits, services, and activities within the Authority's jurisdiction, and determining the financial fees for them.

    • 9- Approving the purchase, sale, leasing, and renting of real estate in a manner that achieves the Authority's objectives.

    • 10- Accepting donations, gifts, legacies, and assistance offered to the Authority.

    • 11- Forming committees and granting them the necessary powers to accomplish the tasks assigned to them.

  • The Council may delegate some of these tasks to any of the officials in the Authority as deemed necessary for the workflow therein.

Article 8

1- The meetings of the Council shall be held at the headquarters of the Authority, and may, when necessary, be held at another location within the Kingdom.
2- The Council shall meet at least four times a year at the invitation of its President, and whenever the interest requires it, the invitation must be accompanied by an agenda for the meeting. The President shall call the Council to meet whenever at least four of its members request it. The validity of the meeting requires the presence of the majority of the members, including the President or his representative, and decisions shall be made by a majority of the votes of those present. In the event of a tie, the side that the President of the meeting voted for shall prevail. An objecting member has the right to record his objection and the reasons for it in the minutes of the Council meeting.
3- The deliberations and decisions of the Council shall be documented in minutes signed by the President of the meeting and the attending members, and the Authority shall communicate these decisions to the relevant parties directly and in an appropriate manner.
4- A member may not abstain from voting or delegate another member to vote on his behalf in his absence.
5- A member may not disclose any information he has obtained regarding the secrets of the Authority.
6- The Council may invite individuals whose information and expertise it deems beneficial to attend its sessions without granting them the right to vote.

Article 9

The Authority shall have a Governor at the excellent rank, who is the executive responsible for managing the Authority. His responsibilities are concentrated within the limits of this organization, and he exercises the following competencies:
1- Supervising the Authority's staff according to the powers granted to him and as determined by the regulations.
2- Issuing orders for the Authority's expenditures based on the approved annual Budget.
3- Proposing the financial and administrative regulations for the Authority, presenting them to the Council, and supervising their implementation after approval.
4- Following up on the implementation of the decisions issued by the Council.
5- Providing periodic Reports to the Council on the Authority's activities, achievements, and operations.
6- Proposing the Authority's plans and programs, presenting them to the Council, and following up on their implementation after the Council's approval.
7- Submitting Recommendations to the Council regarding matters within his jurisdiction.
8- Supervising the preparation of the Authority's draft Budget, annual report, and final accounts, and presenting them to the Council.
9- Representing the Authority before judicial, administrative, and other entities.
10- Issuing the necessary Decisions to implement the provisions of the organization and its executive regulations, as well as the approved rules and Procedures, according to the powers delegated to him.
11- Carrying out the responsibilities conferred upon him by the Council's Decisions and the regulations and rules specific to the Authority. The Governor may delegate some of his powers and tasks to other officials of the Authority.

Article 10

The authority shall have an independent annual budget, issued by royal decree, in accordance with the arrangements for the issuance of the state's general budget.
