Housing Support Statute

  • After reviewing the transaction received from the Royal Court numbered 38043 dated 14/10/1434H, which includes a letter from His Excellency the Minister of Housing No. 213 dated 14/9/1434H, accompanied by a draft regulation for housing support. 

  • And after reviewing Article (19) and paragraph (2) of Article (24) of the Council of Ministers System, issued by Royal Order No. (A/13) dated 3/3/1414H.

  • And after reviewing the Real Estate Development Fund System, issued by Royal Decree No. (M/23) dated 11/6/1394H.

  • And after reviewing the State Revenues System, issued by Royal Decree No. (M/68) dated 18/11/1431H.

  • And after reviewing the minutes numbered (709) dated 26/12/1434H and numbered (96) dated 2/2/1435H, prepared by the Bureau of Experts at the Council of Ministers. 

  • And after reviewing the recommendation of the General Committee of the Council of Ministers No. (155) dated 9/2/1435H. 

  • It is decided as follows:

    • First: Approval of the regulation for housing support, in the accompanying form. 

    • Second: Applications for housing support (housing unit – residential land – housing loan – land and housing loans together) shall be received through the electronic portal of the Ministry of Housing. 

    • Third: 1- The provisions of this regulation shall apply to all applications for housing loans submitted to the Real Estate Development Fund.

    • 2- Notwithstanding paragraph (1) above, the Real Estate Development Fund shall process all applications submitted to it that have numbers prior to 23/7/1432H in accordance with the rules and procedures established by the Fund's Board of Directors in coordination with the Ministry of Housing, guided by the provisions of this regulation, taking into account the waiting period of the applicants.

    • 3- Applicants referred to in paragraph (2) above - who meet the conditions set forth in this regulation - shall be allowed to amend their applications to benefit from housing support in accordance with its provisions.

    • Fourth: The Ministry of Housing shall handle applications previously submitted to the Ministry of Municipal and Rural Affairs for obtaining a residential land plot in accordance with the provisions of this regulation. 

    • Fifth: The financial installment referred to in this regulation shall be according to the following sections: Item (Fifth) has been deleted by Decision of the Council of Ministers No. (74) dated 30/1/1438H.

      • Section One: Amounts not exceeding (75), (100), and (150) thousand Riyals for residential land with an area of (350), (375), and (400) square meters or more, respectively. 

      • Section Two: Amounts not exceeding (100) and (125) thousand Riyals for residential land with an area of (400) and (500) square meters or more, respectively. 

      • Section Three: An amount not exceeding (50) thousand Riyals for residential land with an area of (500) square meters or more.

      • An additional amount of (500) thousand Riyals shall be added if it is an independent housing unit. 

      • The Board of Directors of the Real Estate Development Fund shall determine those amounts and specify the cities, governorates, and centers included in each section mentioned in this item, as well as determine the financial installment for other units and areas. 

    • Sixth: A committee shall be formed from the Ministry of Housing, the Ministry of Finance, and the Ministry of Social Affairs to study the situation of the categories sponsored by the Ministry of Social Affairs, and propose appropriate mechanisms for repaying the housing support installments due on them, with the Minister of Housing submitting to the Council of Ministers what is reached within a period not exceeding (ninety) days from the date of issuance of this decision. 

    • Seventh: The implementing regulation of the Real Estate Development Fund System shall be amended in accordance with the provisions contained in this regulation.

Chapter 1: General Provisions

Article 1

  • The following terms and phrases - wherever they appear in this statute - have the meanings indicated in front of each:

    • Ministry: Ministry of Municipalities and Housing.

    • Minister:Minister of Municipalities and Housing.

    • Fund:Real Estate Development Fund.

    • Regulation: Implementing Regulation of this statute.

    • Housing Support: What the state provides in terms of a housing unit, residential land, financing, credit, or other forms of support.

    • Family: It is the Saudi family, meaning any group referred to in Article (four) of this statute.

    • Applicant: The one who applies on behalf of the family to obtain housing support.

    • Beneficiary: The one who has received housing support from the applicants who met the conditions for housing support.

    • Siblings: Males and females.

    • Financial Installment: What the beneficiary pays under this statute and its regulation.

Article 3

Previous Amendments

The Ministry is responsible for implementing this regulation, and it has the authority to coordinate with the Fund and other entities in the public, private, or non-profit sectors to perform any tasks related to it.

Chapter 2: Benefiting from Housing Support

Article 4

Taking into account the conditions stated in Articles (5) and (6) of this regulation, housing support is limited to families that are any of the following groups:
1 - A husband and wife.
2 - A husband and wife with one or more of their children (unmarried males who have not exceeded the age of (25) years, or unmarried females).
3 - A father and one or more of his children (unmarried males who have not exceeded the age of (25) years, or unmarried females).
4 - A mother and one or more of her children (unmarried males who have not exceeded the age of (25) years, or unmarried females).
5 - Two or more siblings in the event of the parents' death, provided that the male is unmarried and has not exceeded the age of (25) years and that the female is unmarried.
6 - One or more siblings in the event that the mother is not Saudi and the father is deceased, or if she is the sole provider for her Saudi children, provided that the male is unmarried and has not exceeded the age of (25) years and the female is unmarried.
A person is not considered a member of the family if they have the right, under the provisions of this regulation, to apply for housing support for an independent family.
The regulation shall specify who is considered part of the family - for the purposes of applying this regulation - among those not included in the groups mentioned in this article.

Article 5

Previous Amendments
  • The husband or father submits the application for housing support for the family. The wife or mother submits it if she is divorced and a period specified by the regulation has passed since her divorce, or the mother if her husband is deceased.

  • The application is submitted by the siblings - referred to in paragraphs (5) and (6) of Article (Fourth) of this statute - collectively.

  • The regulation specifies the periods, regulations, and procedures necessary for that.

Article 7

Previous Amendments

The application for housing support shall be submitted in the manner specified by the Ministry, and the applicant is obliged to provide the Ministry with all the information and documents it requests. The Ministry has the right to coordinate with governmental and private entities to obtain any information or documents related to the applicant or their family members or to verify their accuracy. It also has the authority to coordinate with governmental entities to ensure the continuous provision of any updates regarding that information and those documents to the Ministry.
