The terms and phrases mentioned below - wherever they appear in this Regulation - shall have the meanings specified next to each of them, unless the context requires otherwise.
1- Law: The Law of Associations and Non-Profit Institutions, issued by Royal Decree No. (M/8) dated 19/2/1437 AH, and its amendments.
2- Regulation: The Implementing Regulation of the Law.
3- Center: The National Center for Non-Profit Sector Development.
4- Council: The Board of Directors of the Center.
5- Association: The non-profit association referred to in paragraph (1) of Article (3) of the Law of Associations and Non-Profit Institutions.
6- Institution: The non-profit institution referred to in paragraph (2) of Article (3) of the Law of Associations and Non-Profit Institutions.
7- Electronic System: The electronic system approved by the Center.
8- Competent Authority: The authority or authorities specified under item (Second) of the Council of Ministers Resolution No. (61) dated 18/2/1437 AH, as amended by Council of Ministers Resolution No. (367) dated 29/6/1443 AH, and any amendments thereto.
9- Supervisory Authority: The government agency that the activities of the association or institution fall within its jurisdiction.
10- Administrative Unit: The unit established by each supervisory authority based on the Royal Order No. (55190) dated 28/11/1438 AH, and Council of Ministers Resolution No. (52) dated 16/1/1443 AH, and other relevant regulatory documents.
11- Technical Violation: Any violation of the technical instructions specific to the supervisory authority.
The Regulation aims to organize the relationship between the center and the supervising authority in overseeing associations and institutions, enabling them to achieve the objectives for which they were established efficiently and effectively, in relation to the following:
1- Approval of the establishment of associations and institutions.
2- Approval, supervision, and oversight of the activities carried out by associations and institutions.
3- Working on the development and empowerment of associations and institutions.
The supervising authority is responsible for issuing the preliminary approval for the establishment of the association or institution, monitoring it, providing technical supervision, and contributing to its development.
Each supervising entity must establish the administrative unit and link it organizationally to the authorized person or their delegate; to facilitate and expedite the establishment of associations and institutions whose main activities fall within its competencies.
The Administrative Unit - in relation to the establishment of associations and institutions that the supervising authority is responsible for overseeing - shall undertake the following tasks and responsibilities:
1- Reviewing the applications for the establishment of associations and institutions referred to the supervising authority from the center, and proposing what it deems appropriate regarding them.
2- Assisting applicants for the establishment of associations and institutions in directing their requests in a manner that ensures and maximizes the benefit to the community.
3- Monitoring the stages of the applications for the establishment of associations and institutions until the necessary procedures are completed regarding them.
