Internal Regulation of the Administrative Judicial Council

Article 1

  • The following terms are defined as follows:

    • Council: Administrative Judicial Council.

    • Board: Board of Grievances.

    • President: President of the Council.

    • Members: Members of the Council.

    • Member: One of the members of the Council.

    • Trustee: Secretary General of the Council.

    • Secretariat: General Secretariat of the Council.

    • Agenda: Agenda of the hearing.

Article 2

The Council convenes in the diwan, or at a location designated by the President, whenever there is a need for its convening based on an invitation from the President.

Article 3

The member may request to hold a session for the reasons they see fit, and the President must decide on the claim within five working days from the date of its submission.

Article 4

The schedule must include the topics to be presented in the Hearing, as well as the date and location of its convening. After its approval by the President, the Secretariat shall notify the members, provided that the period between the notification and the date of the Hearing is not less than seven days. The Secretariat shall attach to the schedule a summary of each topic and any related decisions, reports, studies, and recommendations, except for those that are confidential, which shall be disclosed to them.

Article 5

In non-emergency cases, a member may not be absent from attending the sessions or any part thereof, except for a reason accepted by the President.

Article 6

The president may, on his own initiative or at the request of a member, permit anyone he deems appropriate to attend the hearing to provide any information or clarifications they may have.

Article 7

Decisions in the hearing shall be made as follows:
A- The president shall present the topic for deliberation, and all discussions shall be directed to him, and interruptions are only permitted from him for the purpose of managing the hearing.
B- The council shall vote on the draft decision after the deliberation has concluded, starting from the least senior or the oldest in service, and abstaining from voting is not allowed.

Article 8

  • The voting on draft regulations and organizational rules and similar matters shall be as follows:

    • 1- The President shall present the project for deliberation and then for voting.

    • 2- The remarks submitted by the members on the project shall be discussed to reach an agreement; if opinions differ without reaching an agreement, a vote shall be taken on the subject of the remark.

    • 3- After completing the discussion of the project, it shall be rephrased according to the majority opinion and voted on in the same hearing or in a subsequent hearing if necessary.

Article 9

The Council's deliberations are confidential, and nothing from them may be disclosed.

Article 10

The President decides to conclude the hearing due to the expiration of its specified duration, or after completing the consideration of the subjects listed on its agenda, or for any matter he deems appropriate.
