Companies and individuals, whether individuals, groups, or institutions, are permitted to open roads at their own expense in accordance with the conditions set forth in this regulation.

If any individual, group, non-profit organization, or company wishes to open or expand a dirt or paved road at their own expense—whether the road serves a private or public interest—they must obtain prior permission from the competent authority, as follows:
1- The owner or (owners) of the claim must submit a plan detailing the route of the road to be opened, its length from start to finish, and its type (dirt or paved), along with an indication of the nearest public road. If the road to be opened falls under the responsibility of the Ministry of Municipal and Rural Affairs, the claim should be submitted to the municipality or the rural community in the area for study regarding its compatibility with the approved streets and road networks in the structural plans of cities and villages. If the road serves agricultural areas, the claim should be submitted to the Ministry of Agriculture and Water or one of its branches; for all other roads, the claim should be submitted to the General Panel for Roads or one of its branches.
2- The submitted claim is studied in the field by the relevant authority, and then referred to the competent governorate to obtain an official admission from the owner or (owners) of the claim that the road to be constructed does not harm others and does not pass through land that is subject to disputes or owned by others. The competent governorate is responsible for verifying the accuracy of the information contained in the admission, according to the prepared form for that purpose. If it is proven otherwise, the owner or (owners) of the claim bear full responsibility before others without claiming any compensation from the state.
3- If the owner or (owners) of the claim complete what is stated in paragraphs (1, 2) above, they must submit the mentioned admission to the General Panel for Roads, the Ministry of Municipal and Rural Affairs, or the Ministry of Agriculture and Water—each concerning their respective matters—along with the following:
A- A copy of the road design plan and its execution specifications from a licensed engineering design office for paved roads only.
B- A statement of the previous experiences of the contractor who will execute the road for paved roads only.
C- An admission from the applicant on a form prepared by the government agency to which the claim is submitted—stating that they will not claim any expenses, costs, or compensations from the state in the future resulting from the opening of the road or its non-completion.
4- The competent authority issues the final approval for the project, authorizes the owner of the claim to commence execution, supervises it, follows up on the progress of its implementation, and receives it from the contractor.
After the completion of the road in accordance with the specifications and conditions under which the final permission was issued, whether the road is paved or unpaved, the competent authority shall take over its acceptance and include it in its road maintenance programs, and it shall become their responsibility, treated like any other roads that fall within their jurisdiction.
If the applicant is unable to complete the execution of the road, the competent authority is not obligated to complete it except according to its priority and within the limits of the programs that organize the execution of roads and the availability of appropriations for that purpose.
After the road is received as paved and complete, according to the approved specifications and designs, the funder shall be granted a certificate of appreciation, and the road may be named after him.
This regulation is published in the official gazette and shall come into effect thirty days after its publication.
