1- The terms and expressions used herein shall have the meanings assigned thereto in Article (1) of the Bankruptcy Law, issued by virtue of Royal Decree No. (M/50), dated 28/5/1439 A.H., and Article (1) of the Bankruptcy Law and its Implementing Regulations, issued by virtue of the Council of Ministers' Resolution No. (622), dated 24/12/1439 A.H.
2- The word Inspector hereof shall mean whoever carries out the works of inspection, verification and control out of the employees of the General Secretariat of the Bankruptcy Commission or whomever used by the Commission and a designation resolution in this respect is issued.
The provisions hereof shall apply to the procedures pertaining to the works of inspection, verification and control with regard to any of the following:
a-Bankruptcy procedures commenced according to the provisions of the Law.
b-The work of the officeholders and experts.
The rules herein aim to enhance confidence in bankruptcy procedures, improve the quality of the work of officeholders and experts, and govern the performance of the inspector's duties.
Article 4: The Bankruptcy Commission shall exercise its competence stipulated in paragraph (2 / E) of Article (9) of the Law through the following:
a- Periodic inspection to monitor the quality of performance.
b- Inspection based on a complaint, notification, or based on the results of periodic inspection.
The Inspector shall:
a-Exercise due diligence when performing his duties, and perform it impartially, honestly and confidentially.
b-Adhere to the provisions of the Law, rules, Regulations, and instructions issued by the Bankruptcy Commission, and all relevant laws, rules and Regulations in force.
c-Disclose any of the inspector's relation with the under-inspection or any conflict of interest, if any.
d-Present his I.D. while performing his duties.
rticle 6: 1- The inspector performs his duties through electronic means or other means, during the official working hours or thereafter, according to the work requirements, and based on a prior notification to the under-inspection or without it.
2- An inspector may be instructed, if necessary, to complete the duties of another inspector.
The inspector shall write the violations control report, record the date, time, venue of the report, the name of the inspector, the name of the under-inspection, his data, the legal grounds for inspection, an accurate description of the seized assets, description of the incident in question, the data of the incident subject to the seizure, the information and documents he finds, the actions taken thereby, hearing the statements signed by the concerned persons, and closing the report by signing it.
