Regulations on State Ownership of Real Estate

Chapter 1: Definitions and Scope

Article 1

  • The meanings of the following words and phrases - wherever they appear in these regulations - are as defined below, unless the context requires otherwise:

  • The Panel: State Properties General Authority.

  • The Council: Board of Directors of the Panel.

  • The Governor: Governor of the Panel.

  • The Government Agency: Ministries, government agencies, authorities, public interests, public institutions, and entities with independent public legal personality.

  • The Regulations: Regulations for state ownership of real estate.

  • The Claim: Purchase request submitted by the Government Agency according to the prepared form for that purpose.

  • The Real Estate: Land, building, facility, or real estate unit with specific specifications and owned by a title deed.

  • The Technical Standards: Approved standards and specifications for state properties set by the Panel.

  • The Portal: The electronic portal approved by the Panel.

Article 2

  • The provisions of these regulations apply to requests for real estate ownership submitted by government entities within the Kingdom of Saudi Arabia.

Chapter 2: Conditions of Ownership

Article 3

  • The Government Agency may acquire real estate when needed in accordance with the regulations, while adhering to the following conditions:

  • 1- The Government Agency must not have any unused real estate that meets its needs.

  • 2- There must not be any real estate available to the state that meets the needs of the Government Agency wishing to acquire ownership.

  • 3- Approval from the Council for the Government Agency that does not have the legal authority to acquire the real estate.

  • 4- The Government Agency must have the necessary financial appropriation to acquire the real estate.

Article 4

  • The following conditions must be met for the Real Estate intended for Ownership:

  • 1- The Real Estate must be owned with a title deed.

  • 2- It must be free of defects, based on a report issued by an accredited engineering office.

  • 3- The necessary licenses from the relevant authorities must be available.

  • 4- There must be no violations on the Real Estate from any relevant authority, nor should it be subject to a legal dispute regarding its ownership or benefits.

  • 5- The specifications of the Real Estate must match the needs of the Government Agency wishing to acquire it.

  • 6- The Real Estate must meet the technical standards.

Chapter 3: Types of Ownership

Article 5

  • The government entity may acquire Real Estate through one of the following forms of Ownership:

    • 1- Purchase for immediate Price.

    • 2- Purchase for deferred Price, whether the payment of the deferred Price is made in a lump sum or in specified installments.

    • 3- Lease ending in Ownership, in accordance with the provisions of the State Leasing System for Real Estate.

    • 4- Purchase off-plan, in accordance with the provisions of the relevant regulations.

    • 5- Purchase of subdivided Real Estate units, in accordance with the provisions of the relevant regulations.

    • 6- Any other form approved by the Council.

Chapter 4: Ownership Procedures

Article 6

  • 1- The Government Agency wishing to acquire ownership must submit a claim to the Authority, provided that the applicant is authorized by the competent authority within the Government Agency.

  • 2- When submitting the claim, the Government Agency must provide the Authority with all documents and information supporting the ownership claim as determined by the Authority, in addition to filling out the ownership claim form approved by the Authority.
