Implementing Regulation for the Activity of Vehicle Transportation and Vehicle Towing

  • Based on the powers granted to it by the law
  • After reviewing the Land Transport Law issued by Royal Decree No. (M/188) dated 24/8/1446 AH.
  • After reviewing the Regulation of the Transport General Authority issued by the Council of Ministers Decision No. (323) dated 14/9/1434 AH, and its amendments.
  • After deliberation, the Board decided by circulation as follows:
  • First: Approving the Implementing Regulation for the activity of vehicle transport and vehicle towing according to the attached form.
  • Second: Approving the mechanism for amending the status of land transport establishments in accordance with the provisions of the Land Transport Law and the Implementing Regulation for the activity of vehicle transport and vehicle towing according to the attached form.
  • Third: The provisions of the regulation and the mechanism referred to in items (First) and (Second) of this decision shall apply from the date of their publication in the Official Gazette.
  • And Allah is the Grantor of success.

Chapter 1: Preliminary Provisions

Article 1

  • The terms and expressions used in this Regulation shall have the meanings assigned to them in the Law and this Regulation, unless the context requires otherwise:

    • 1- Law: The Land Transport Law on Roads, issued by Royal Decree No. (M/188) dated 24/8/1446 AH.
    • 2- Regulation: The Implementing Regulation for the Activity of Car Transport and Vehicle Towing.
    • 3- Activity: The activity of car transport and vehicle towing for commercial purposes.
    • 4- Car Transport and Vehicle Towing for Commercial Purposes: Transporting cars and towing vehicles by an establishment or individual for commercial purposes, considered a sub-activity of the commercial goods transport activity.
    • 5- Establishment: Any legal entity enjoying full legal capacity.
    • 6- Individual: Any natural person enjoying full legal capacity.
    • 7- Vehicle: A land transport means prepared to transport passengers and their belongings or goods on roads, powered or towed by mechanical force.
    • 8- Car: A mechanically powered vehicle prepared to transport passengers and their belongings, with a capacity not exceeding (8) passengers.
    • 9- Transport Vehicle: A mechanically powered vehicle technically equipped to transport cars, with a maximum capacity of transporting two cars.
    • 10- Towing Vehicle: A mechanically powered vehicle technically equipped to tow only one vehicle.
    • 11- License: An official document issued by the Authority permitting the person to practice the activity in accordance with the provisions of this Regulation.
    • 12- Service Provider: The person licensed to practice the activity.
    • 13- Sender: The person contracting with the service provider to transport cars or tow vehicles to the recipient.
    • 14- Recipient: The person to whom the transported cars or towed vehicle are sent.
    • 15- Center: The place through which the establishment practices the activity of car transport and vehicle towing for commercial purposes in accordance with the provisions of this Regulation.
    • 16- Driver: Anyone who drives the transport vehicle or the towing vehicle.
    • 17- Driver Card: A document issued by the Authority to the driver according to the conditions and requirements specified in the Regulation.
    • 18- Operation Card: A document issued by the Authority for the transport vehicle or towing vehicle to the service provider to practice the activity according to the conditions and requirements specified in the Regulation.
    • 19- Periodic Technical Inspection Document: A document issued by the competent authorities to prove that the transport vehicle or towing vehicle has passed the periodic technical inspection requirements.
    • 20- Transport Document: A document issued under the transport contract and considered proof of the service provider’s receipt of the car subject to transport or the vehicle subject to towing in the condition stated therein, to deliver it by land to the recipient in the same condition.
    • 21- Saudi Standard Specifications: The specifications issued by the Saudi Standards, Metrology and Quality Organization.
    • 22- Inspector: The person authorized to inspect, monitor, and record violations of the Law or Regulation, appointed by a decision from the President.
    • 23- Authority’s Electronic Platform: The electronic platform approved by the Authority, which enables it to access data of the establishment, vehicles, and drivers.
    • 24- Financial Consideration: The amount determined by the Authority in return for any of the licenses, documents, services, and works it provides under the provisions of the Law or Regulation.
    • 25- Financial Penalties: The amount of money the violator is obligated to pay to the Authority as a result of violating any of the provisions of the Law or the Violations and Penalties Schedule.
    • 26- Committee: The committee formed by a decision of the President in accordance with the provisions of the Law.

Article 2

  • First: The regulation aims to organize the activity of car transportation and vehicle towing for commercial purposes, develop its services, advance it, and encourage investment in it - in coordination with the concerned authorities - in a manner consistent with the economic and social development goals in the Kingdom, while taking into account environmental aspects and security and safety requirements.

  • Second: Without prejudice to the relevant systems, their equivalents, and the international agreements to which the Kingdom is a party:

    • 1- The provisions of this regulation apply to practitioners of car transportation and vehicle towing carried out within the territory of the Kingdom.
    • 2- The provisions of this regulation apply to transport vehicles and towing vehicles, with a maximum of transporting (2) cars on the transport vehicle, and towing (1) car only on the towing vehicle. It is permissible to transport vehicles of the (pickup) type on the transport vehicle with a maximum of (2) vehicles, and they are treated as transported cars in accordance with the provisions of this regulation.
    • 3- The provisions of this regulation apply to service providers (establishments - individuals).

Chapter 2: License

Chapter 1: Licensing the Practice of Vehicle Transportation and Vehicle Towing Activities for Commercial Purposes - Establishments

Article 3

  • First: It is a condition for the establishment to obtain a license to practice the activity of car transport and vehicle towing for commercial purposes to submit an application through the approved authority channels and fulfill the following requirements:

    • 1- A valid commercial register for the establishment that includes the activity of car transport and vehicle towing for commercial purposes.
    • 2- A valid social insurance certificate.
    • 3- A valid Zakat and income certificate (if more than one fiscal year has passed since the commercial register).
    • 4- Providing a center to practice the activity of car transport and vehicle towing for commercial purposes in the city of the license according to the technical specifications and requirements issued by the relevant competent authorities.
    • 5- Providing at least one transport vehicle or one towing vehicle at the level of the Kingdom’s cities, governorates, and their affiliated administrative centers, provided that its registration type is (public transport) according to the Traffic Law and its executive regulations, and it is owned directly by the establishment or through financial leasing, provided that the establishment is the actual user.
    • 6- Linking to the authority’s electronic platform.
    • 7- Providing a means of communication for beneficiary service.
    • 8- Payment of the financial fee - if any -.
    • 9- Payment of financial fines - if any -.
  • Second: It is prohibited for any person to practice the activity except after obtaining the necessary license from the authority, or to continue practicing the activity after the license expires, is canceled, or during its suspension period. The prohibition includes all preparatory work for any person to practice the activity without a license.

  • Third: It is prohibited for non-Saudi transport and towing vehicles to practice internal transport within the Kingdom.

Article 4

  • First: A restricted license is issued to the establishment upon submitting the license application after fulfilling paragraph (1) of item (First) of Article (Three) for a period of (60) days, to enable the establishment to complete fulfilling all the conditions for issuing the license stated in item (First) of Article (Three), provided that the establishment does not practice the activity through the restricted license, and the restricted license is canceled after its duration expires.
  • Second: The license is issued in the name of the establishment and is valid for a period of (3) years.

Article 5

  • 1- The licensing conditions stated in paragraphs (6, 5, 4, 1) of clause (First) of Article (Three) of this Regulation are mandatory for its validity, and in the event of a breach of any of these conditions; penalties shall be imposed in accordance with the Law and the approved schedule of violations and penalties.
  • 2- If there is a shortage in the minimum number of transport vehicles or towing vehicles due to accidents or disasters beyond the control of the service provider, and the shortage is not completed within (180) days from the date of the shortage; penalties shall be imposed in accordance with the Law and the approved schedule of violations and penalties.

Article 6

  • Subject to paragraph (First) of Article (Three) of this Regulation, the license shall be renewed upon the service provider's request for a similar period, in accordance with the following regulations:

    • 1- Submitting the renewal request and fulfilling all its conditions within the period preceding the license expiration date by (180) days; otherwise, the request shall be considered void.
    • 2- Valid operational age of the transport vehicles or towing vehicles.
    • 3- Submission of a valid Saudization certificate.
    • 4- Payment of the financial fee - if any -.
    • 5- Payment of financial penalties - if any -.
  • It is permitted to submit the renewal request and fulfill all its conditions within (30) days from the license expiration date, provided that the activity is not practiced during that period, without prejudice to the Authority's right to impose the prescribed penalties for delay in renewing the license.
