Regulation on the Voluntary Registration of Copyright Works

Article 1

Previous Amendments

The following terms and phrases, wherever mentioned in this regulation, shall have the meanings indicated opposite each of them unless the context requires otherwise:
Law: Copyright Law issued by Royal Decree No. M/41 dated 2 Rajab 1424 AH, and amended by Council of Ministers decision No. 536 dated 14/9/1439 AH.
Authority: Saudi Authority for Intellectual Property.
Council: Board of Directors of the Authority.
Regulation: Optional Registration Regulation for Copyright Works.
Work: Copyright works eligible for protection under the provisions of the law and its executive regulation.
Applicant for Registration:The author or any of the rights holders or their representatives, in accordance with the provisions of the law.
Registration: Entry of the work with the Authority.
Register: A database in which the data of the work is documented, including the rights and actions that occur to it.
Work: Copyright works eligible for protection under the provisions of the law and its executive regulation.
Applicant for Registration: The author or any of the rights holders or their representatives, in accordance with the provisions of the law.

Article 2

  • The purpose of this Regulation is to:

    • 1- Establish the rules and procedures governing the services provided by the Authority under this Regulation.

    • 2- Document the works and grant them a registration certificate, thereby enhancing trust in the transactions and actions related to them.

    • 3- Create an electronic database for registering works with the Authority.

Article 3

Previous Amendments

The Authority provides a registration service for the classifications specified by a decision from the President of the Authority.

Article 4

  • A register shall be established in the Authority to document the data of registered works, their authors, the year of their creation, their publication status, any registered amendments, any transactions related to them, and other data determined by the Authority.

Article 5

The applicant for registration or their representative may submit a request to the Authority for the registration of a work, or for the amendment of a registered work, or for the registration of a transaction related to a registered work.

Article 6

Previous Amendments
  • The registration application must meet the following conditions:

    • 1- The work or any of its contents must not be contrary to the provisions of Sharia, the laws of the Kingdom, or public morals.

    • 2- Completion of the required data and attachments for registration.

    • 3- The registration application must be limited to one work, taking into account the nature of the works, and the authority may allow the registration of multiple works in one application according to the regulations and conditions issued by the CEO of the authority.

    • 4- The work must not be one of the works excluded from protection under the law.

    • 5- The work must be in its final form and not a draft or preparatory work for its preparation.

    • 6- Payment of the approved financial fee in accordance with the provisions of this regulation.

    • 7- Any additional regulations, conditions, or requirements issued by a decision of the CEO of the authority.

  • These conditions apply in accordance with the nature of the registration.

Article 7

  • The registration application shall be submitted to the authority electronically and must include the following information:

    • 1- The name of the applicant for registration, their nationality, status, address, and a copy of the power of attorney (if available).

    • 2- The name of the author, the pseudonym, and the stage name (if available), their nationality, address, and date of death (in case of the author's death).

    • 3- The name of the entity that commissioned the work (if available), its address, and the document that proves the relationship between it and the author.

    • 4- The title of the work, its type, description, and language.

    • 5- The name of the publisher, their address, the date and place of first publication, and the international number (if available).

    • 6- The name of the assignee, their nationality, address, type of action, duration, geographical scope, and the document that proves the occurrence of the action from the author or the rights holder.

Article 8

  • The registration application shall be accompanied by the following:

    • 1- A copy of the national identity, or passport (for foreigners), or the commercial register (for legal entities), or other supporting documents for other entities.

    • 2- A copy of the work according to the nature of the work.

    • 3- A declaration of the accuracy of the data contained in the application, the ownership of the right subject to registration, and the applicant's responsibility for any infringement of the rights of others or any violation that may result from his application.

    • 4- Any other attachments required by the authority.

Article 9

Previous Amendments
  • The registration applicant is provided with a serial number indicating the receipt of their application, and they must pay the examination fee within thirty days from the date of submitting the registration application, through the payment channels approved by the Authority. If payment is not made within the specified period, the application is considered null and void.

Article 10

The authority shall examine the claim and verify the fulfillment of the data, documents, and conditions necessary for registration. The authority shall issue its decision regarding the registration claim within sixty days from the date of payment of the examination fee or from the date of fulfilling the additional requirements.
