Regulations on the Work Procedures of the Council of Senior Scholars

The Council of Senior Scholars convenes every six months at the headquarters of the (Presidency of Scientific Research, Ifta, Call and Guidance) in Riyadh. In exceptional cases, it may be held in another location. The Council may also convene in extraordinary sessions to discuss urgent matters that cannot be delayed. The head of the (Presidency of Scientific Research, Ifta, Call and Guidance), after consulting with the General Secretary of the Council, determines the time for the general session and the extraordinary session. The Presidency of Scientific Research, Ifta, Call and Guidance, within its approved budget, is responsible for preparing the venue and necessary supplies for the session, as well as securing travel and accommodation for members of the Council who reside outside the session's location.

Previous Amendments

The Grand Mufti or his appointed representative shall be the President of the sessions, and the President shall open the sessions, manage them, organize the discussions, and adjourn them.

The assembly is validly convened with the presence of two-thirds of its members, and the assembly makes its decisions and recommendations by an absolute majority of those present. In the event of a tie, the President's vote shall be decisive. It is beneficial for dissenting members to document the nature of their dissent, along with its reasons and evidence, while also mentioning an alternative to the opinion they opposed.

A reward of five thousand riyals is decided for each member of the authority for each session of the authority, and it will be disbursed from the budget of the Presidency of Scientific Research, Fatwa, Da'wah, and Guidance Departments.

The Research and Fatwa Administration, in addition to administrative and clerical functions, consists of the Permanent Committee that is a subsidiary of the Authority. This Administration, through the Committee, prepares research and organizes it for presentation to the Authority, and drafts fatwas in response to inquiries from the questioners regarding beliefs, acts of worship, and personal transactions.

The General Secretary of the Authority prepares the agenda for the sessions, and no topic may be discussed unless it is included in the agenda. This is to ensure that the Authority has the opportunity to study and review what is to be discussed. For this purpose, the General Secretary sends the agenda to each member of the Authority at least fifteen days prior to the session, along with the research that has been prepared and studied by the Committee subordinate to the Authority, which recommended that the research be referred to the Authority.

Taking into consideration what the guardian requests to be examined and expressed an opinion on, the research that is being prepared for presentation to the Authority is selected either based on a recommendation from it, or from its Secretary-General, or from the Head of the Departments of Scientific Research, Fatwa, Da'wah, and Guidance, or from the Standing Committee derived from the Authority.

Fatwas are issued by the Permanent Committee only if approved by an absolute majority of its members, provided that the number of those reviewing the fatwa is not less than three members. In the event of a tie in votes, the President's vote shall be decisive.

The Chairman of the Permanent Committee and its members shall be appointed by our order upon the nomination of the Head of the Research Departments.

In examining issues related to economic and social affairs, and general regulations including banking, commercial, and labor matters, the authority must involve one or more specialists in those fields in the research, without granting them voting rights. The specialists are to be selected and summoned by the General Secretary and the Head of the Research Department together.
