An independent authority called the (Control and Investigation Authority) shall be established under this Law, directly linked to the Prime Minister. It shall be composed of a chairman whose rank shall not be less than the fifteenth rank, two or more deputies each of whom shall not be less than the thirteenth rank, and a sufficient number of specialized members. The authority shall be supported by a sufficient number of administrative staff and employees.
The Chairman of the Authority is appointed and his service is terminated by a Royal Decree, and the deputies are appointed and their service is terminated by a Royal Decree based on the proposal of the Chairman of the Authority.
The Authority includes the following bodies:
- The Oversight Body.
- The Investigation Body.
Each body consists of departments whose number, jurisdiction, and procedures are determined by a decision of the Council of Ministers based on the proposal of the Chairman of the Authority.
The internal regulation of the authority shall be issued by a decision from the Prime Minister based on the proposal of the Chairman of the Authority.
Without prejudice to the authority of the concerned Administrative Agency in supervision, examining complaints, and investigation, this Authority is competent within the limits of the rules stipulated in this Law to the following:
1- Conduct the necessary supervision to detect administrative violations.
2- Examine complaints referred to it by the competent ministers or any official entity regarding financial and administrative violations.
3- Conduct audits on financial and administrative violations revealed by supervision and those referred to it by the competent ministers or any specialized official entity.
4- Follow up on the case referred according to this Law to the Disciplinary Board.
All control procedures and the results they yield are documented in special minutes prepared for this purpose and submitted to the Chairman of the Authority to determine the appropriate procedure.
If the head of the authority deems that there are matters requiring investigation, he shall appoint from among the investigators he sees fit to conduct it, and the administrative agency to which the employee belongs must be notified of the investigation before it commences.
