Procedures Regulating Reconciliation in Insurance Disputes

Article 1

Previous Amendments
  • The following words and phrases - wherever they appear in these procedures - shall have the meanings indicated next to each of them unless the context requires otherwise:

    • Bank: Saudi Central Bank (SAMA).
    • General Secretariat: General Secretariat of the Committees for Resolution of Insurance Disputes and Violations.
    • Committees: The primary and appellate committees for resolution of insurance disputes and violations.
    • Center: Settlement Center for Insurance Disputes.
    • Company: The insurance company that is a member of the Center and licensed in the Kingdom.
    • Governor: Governor of the Saudi Central Bank.
    • General Secretary: General Secretary of the Committees for Resolution of Insurance Disputes and Violations.
    • Individuals: Natural persons benefiting from insurance coverage in motor insurance policies.
    • Center Trustee: Trustee of the Settlement Center.
    • Settler: The person who undertakes the settlement work in accordance with the provisions of these procedures.
    • Dispute: Any disagreement arising from an insurance contract between the insured or the beneficiary of the insurance coverage and the company.
    • Settlement: A consensual method undertaken by the settler to resolve the dispute.
    • Settlement Document: The document prepared by the settler after approval of the settlement proposal that ends the dispute, for the purpose of documenting its terms and ratification by the committees.

Article 2

A center or more called the "Settlement Center for Insurance Disputes" shall be established by a decision of the Governor and shall be administratively and financially affiliated with the General Secretariat. It shall be specialized in settling amicably the lawsuits filed by individuals against companies in disputes arising from vehicle insurance contracts for individuals, where the compensation claim value does not exceed (50,000) fifty thousand riyals. The center shall be specialized in compensation claims for non-physical damages. The Governor may, by decision, expand the center’s jurisdiction to include other types of insurance or set higher amounts than that.

Article 3

Companies may join the membership of the center based on a membership agreement concluded with the General Secretariat.

Article 4

The center shall have a Trustee nominated by the General Secretary and appointed by a decision of the Governor.

Article 5

  • The center's secretary shall supervise the center and shall have, in particular, the following responsibilities:

      • Monitoring and supervising the performance of the employees in the center, and working to enhance their productivity efficiency.
      • Supervising the preparation of the center's annual report in preparation for its submission to the governor.

Article 6

A decision shall be made by the governor, based on the nomination of the General Secretary – in accordance with the criteria set by the institution – to appoint three or more Trustees in each center. One Trustee shall handle the settlement for each settlement request, and the center's Trustee may increase the number of Trustees for any request whenever deemed necessary.

Article 7

It is not permissible for anyone working at the center, even after the termination of their employment, to disclose or benefit from what they have accessed as a result of their work at the center, unless there is a legitimate legal or regulatory requirement that necessitates such disclosure.

Article 8

The conciliator is prohibited from initiating a request for conciliation related to his own interests, or those of his wife, or his relatives, or his in-laws up to the fourth degree.

Article 9

The conciliator is prohibited from undertaking a settlement in which he was an arbitrator, or an agent, or a lawyer for one of the parties to the contest, and any dispute related to it, or arising from it.

Article 10

The settlement request shall be submitted to the center by the party who has the status or interest in the dispute, in accordance with the mechanism outlined in these procedures, and according to the approved form and appropriate means determined by the center. When the parties to the dispute authorize others to submit the settlement request or proceed with the settlement procedures, the authorization must explicitly delegate them to accept or reject the settlement to resolve the dispute.
