Conditions and Requirements for Qualifying Engineering Consulting Entities for Projects Involving the Sale or Lease of Off-Plan Real Estate Units

Article (1)

  • These terms and requirements apply to engineering consulting entities that have experience in supervising buildings and supervising infrastructure, either one or both for a period of no less than three years, according to their classification degree as stated in Article (5), as well as the availability of qualified engineering staff to practice the activity of engineering supervision for off-plan sale projects.

Article 2

  • The purpose of these terms and requirements is to:

    • 1- Enhance the quality of engineering supervision for projects involving the sale or lease of real estate units off-plan.

    • 2- Increase confidence in projects for the sale or lease of real estate units off-plan.

Article 3

  • The engineering supervision of sale or lease projects on the map may not be exercised except after obtaining a qualification certificate from the Committee.

Article 4

  • 1-  An engineering qualification claim is submitted to the Committee for the Sale or Lease of Real Estate Units on the Map after payment of the financial fee, according to the prepared form either in paper or electronically, accompanied by the following:

    • A- Commercial Register certificate.

    • B- Classification certificate for city service providers, which must include (Construction Project Management - Engineering and Architectural Consultations - Engineering Consultations for Urban Planning).

    • C- A statement of the executed projects that the engineering consulting entities have supervised.

    • D- At least (10%) or (5) of the engineers from the engineering consulting entities must have passed the training program approved by the committee, whichever is less, provided that the project manager licensed by the Committee for the Sale or Lease on the Map has passed the training program.

    • E- A certificate of social insurance accompanied by a list of the names of the active participants.

  • 2- The Committee, in the event that any of the required documents and papers for studying the qualification claim are not available, may take any of the following actions:

    • A- Request additional information, or require the applicant to attend the Committee's headquarters to answer any inquiries.

    • B- Notify the qualification applicant of the observations on the claim to be completed within (60) days.

    • C- Visit the engineering consulting entity requesting qualification to verify the qualification data and information.

  • 3- The claim is considered void after (60) days from the date of the request for additional information or the submission of observations without completing or amending the noted observations on the claim.

  • These terms and requirements are published in the Official Gazette and shall take effect from the date of their publication.
