Regulations for Inspection and Control of Violations of the Law of Antiquities, Museums, and Urban Heritage and Their Consideration

Chapter 1: Definitions

Article 1

The following words and phrases – wherever they appear in this Regulation – shall have the meanings specified next to each, unless the context requires a different meaning:
The Panel: The General Panel for Tourism and National Heritage.
The President: The President of the Panel.
The Law: The Law of Antiquities, Museums, and Urban Heritage.
The Committee: The Committee for examining violations of the provisions of the Law and imposing the penalties contained therein.

Chapter 2: Inspection and Seizure

Article 2

1- The employees of the Authority – who are appointed by a decision from the President – shall monitor sites, archaeological buildings, heritage sites, museums, and the activities being practiced; in accordance with the provisions of the Law and its regulations, and to control any violations of the provisions of the Law.
2- The Authority, in agreement with other entities, may utilize the employees of those entities who are authorized by their respective authorities; to carry out the tasks stipulated in paragraph (1) of this article.
3- The employees mentioned in paragraphs (1) and (2) of this article – while performing their duties, and within the scope of their jurisdiction – are considered as criminal enforcement officers.
4- The Authority shall issue the enforcement officer a card bearing his photo, and sealed with the official seal of the Authority, to verify his official capacity when performing inspection and enforcement tasks, and he must return this card upon leaving his position in inspection and enforcement.

Article 3

The enforcement officer shall carry out his duties during official working hours or outside of them, according to pre-approved schedules by the relevant administration to which the officer belongs. The schedules take into account the number and size of the sites and buildings subject to inspection within the jurisdiction of the relevant administration. In exceptional cases, and based on work requirements, inspections may be conducted without adhering to the schedules.

Article 4

In consideration of the relevant laws, the enforcement officer – in the course of performing his duties – is authorized to do the following:
1- Enter sites, archaeological buildings, heritage sites, museums, and other places where any activities subject to the provisions of the law and its regulations are conducted, after presenting his identification card to the person responsible for the site or building, or their representative, at the time of the visit. If none of them are present, the officer shall introduce himself to the person present at the site or building at the time of the visit.
2- Review documents, records, licenses, approvals, and any other relevant documents.
3- Inspect the site or building and its facilities, and question the person responsible for the site or building – or their representative – and any of the employees; to verify the availability of the conditions and requirements necessary according to the provisions of the law and its regulations, and to record this – if necessary – in the enforcement report.
4- Hear the statements of the complainants, verify them, and confront the accused with the complaints.

Article 5

1- Without prejudice to the provisions of the relevant laws, the owners of sites, historical and heritage buildings, those licensed, and those who have obtained approvals from the authority, as well as the manager responsible for the site or building – or their representative – and the employees working therein, shall enable the enforcement officers to enter, carry out their duties, and provide them with any requested records and documents; this is for the purpose of reviewing and verifying compliance with the provisions of the law and its regulations.
2- If any of the individuals mentioned in paragraph (1) of this article obstructs the work of the enforcement officer, the officer shall record that in the enforcement report.

Article 6

The enforcement officer must exercise caution, integrity, and precision in carrying out his duties. In particular, he must base his observations on what he personally witnesses and must completely refrain from making any remarks about matters he does not sufficiently understand.

Article 7

1- The enforcement officer shall prepare a report on the violations detected, using the form approved by the authority, indicating the type of violation, the date it was detected, and the statement from the manager responsible for the site or building, or their representative.
2- The enforcement officer shall sign the report and request the signature of the manager responsible for the site or building, or their representative. In the event that any of them refuse to sign, this shall be recorded in the report – and a copy shall be delivered to the manager responsible for the site or building – or their representative.
3- If the enforcement officer discovers during the inspection the existence of violations or crimes punishable under other laws, they must notify the relevant administration, which shall take the necessary actions to refer them to the concerned authorities.
4- The enforcement officer shall submit the report to the relevant administration, in preparation for completing the necessary procedures regarding the violation, and then refer it to the committee specified in paragraph (1) of Article (8) of this regulation, or refer it to the Public Prosecution and Investigation Authority if it involves violations specified in Articles (71, 72, and 73) of the law.
