Rules for Reporting Unknown and Extinct Waqfs

Definitions and General Provisions

Article (1): Definitions


For the purpose of applying the provisions of these rules, the words and phrases mentioned below shall have the meanings indicated next to them, unless the context requires otherwise:
The Authority: General Authority for Awqaf.
The Law: The Authority's Law.
The Board of Directors: The Board of Directors of the Authority.
The Governor: The Governor of the Authority.
The Committee: The Committee for Unknown Endowments.
The Rules: Rules for Reporting Unknown Endowments.
The Unknown Endowment: The endowment whose revenues have ceased and for which there is no known supervisor.
Proving the Endowment: The procedures that result in the establishment of ownership of the asset and its endowment status legally and judicially.
The Supervisor: A natural or legal person who supervises the endowment in a lawful manner.
The Supervision: The actions taken to achieve the benefit and interest of the endowment asset and its revenues, including its preservation, leasing, development, repair, litigation, and distribution of its proceeds, in accordance with the conditions set by the endower.
Reporting: What the Authority receives as a report about an unknown endowment according to the mechanism defined by these rules.
The Reporter: One or more persons - natural or legal - who submit a report about an unknown endowment in accordance with the conditions stated in these rules.
The Reward: A monetary amount paid to the reporter in accordance with the provisions of these rules.
The Processing: The adoption of all procedural methods stipulated by these rules in dealing with the report and the recommendations made in this regard.

Article (2): The Objective of the Rules

The purpose of these rules is as follows:
1- To establish a regulatory framework for the reporting of unknown endowments and their management.
2- To revive endowments and achieve the objectives of the founders by preserving, developing, and growing them, as well as registering, documenting, and spending their proceeds in their legitimate purposes.
3- To encourage the public to report unknown endowments.

Article (3): Scope of Application

The provisions of these rules apply to:
1- Reports on public and private (capacity) endowments and joint endowments within the Kingdom of Saudi Arabia.
2- Existing reports for which no decisions have been issued by the authority prior to the enforcement of these rules.

Provisions of Notification

Article 4: Conditions for Accepting Reports

The following conditions must be met for the notification to be accepted:
1- The notification must be regarding an Endowment that does not have a real or judicial supervisor.
2- The Endowment being reported must fall within the scope of application referred to in Article Three of these regulations.
3- The Endowment must not be known to the authority.
4- The notification about the Endowment must reveal the disruption of its revenues due to its extinction or the disappearance of its endowment status.
5- The notification must be supported by valid means of proof that substantiate its accuracy.
6- There must not be an ongoing lawsuit regarding the supervision, proof, or entitlement to the Endowment in the Judiciary, or a final judgment that has become conclusive issued within the last five years.
7- The notification must be submitted through the authority's official website.

Article 5: Multiple Reporters

1- If there are multiple reporters regarding the same unknown Endowment; the one who reports first is entitled to the Reward, unless the authority sees otherwise for a valid reason.
2- Those who have submitted reports to the authorities supervising the Endowments previously, which have not been acted upon by the authority; must submit their reports through the authority's website, within ninety days from the date these rules come into effect, after which the priority will expire.

Article 7: Reporting Processing

1- The authority shall commence the processing of the report, and it may delegate the reporter or others to carry out the procedures for processing the report, establishing the Endowment, addressing any Trespassing that may have occurred, appointing a supervisor over it, and handing it over to the supervisor free of encumbrances in accordance with the established procedures.
2- The procedures for processing and closing the report shall be in accordance with the provisions of these rules and their procedural guide.

Article 8: Whistleblower Reward

1- The authority shall determine the reward for the informant after accepting and evaluating the report - in accordance with the provisions of these rules - in an amount not exceeding (5%) of the value of the endowment, and not exceeding one million Riyals.
2- The value of the reward shall be determined according to criteria specified in the procedural guide for these rules.
3- The reward for reporting shall be due after the endowment is fully established, the supervisor is appointed, and it is received free of encumbrances in accordance with the established procedures.
4- The authority shall specify items for disbursing rewards and the necessary financial costs for processing reports or creating new items that serve the interests of unknown endowments, and shall determine the mechanism for disbursing them.
5- It is prohibited for the authority's employees, or their relatives up to the fourth degree, to receive the rewards stipulated in these rules, and any action contrary to this shall be deemed void.
