Whenever they occur in this Regulation, the following terms shall have the meanings expressed next to them unless the context indicates otherwise:
State: The Kingdom of Saudi Arabia.
Maritime Authority: The Public Transport Authority represented in the Maritime Transport Sector, or one of its branches or representatives. In addition, whoever authorized to perform any work on its behalf.
Organization: International Maritime Organization.
Convention: The International Convention for the Prevention of Pollution from Ships of 1973 and its Amendments.
Regulations: Articles and texts contained in the appendices of the Convention.
International voyage A voyage to any vessel from a port within the borders of the Kingdom to a port located outside or vice versa.
Certificate: International Certificate for the Prevention of Oil Pollution of 1973.
Person: One of the crew or passenger.
Oil: . means petroleum in any form including crude oil, fuel oil, sludge, oil refuse and refined products (other than petrochemicals which are subject to the provisions of Annex II of the present Convention) and, without limiting the generality of the foregoing, includes the substances listed in appendix I to this Annex
Oily mixture: a mixture with any oil content Oily Fuel: Any oil used as fuel in connection with the propulsion and auxiliary machinery of the ship in which such oil is carried
Oil tankers: . A ship constructed or adapted primarily to carry oil in bulk in its cargo spaces and includes combination carriers and any ``chemical tanker'' as defined in Annex II of the present Convention when it is carrying a cargo or part cargo of oil in bulk
Combination carrier: . means a ship designed to carry either oil or solid cargoes in bulk.
The new vessel: Is the ship that the keel of which is laid or which is at a similar stage of construction is made at the time in which the related chapter is enforced or after it or the delivery of which is after three years or more from the date in which the related chapter is enforced
Existing vessel: a ship which is not a new ship Accident: A sudden accident occurring during the work. The accident may lead to damage and harm to the facility or means of production without injuring one of the employees, or may lead to the injury of one or more workers in addition to damage to the establishment and means of production.
The main conversion in accordance with the Convention 73/78: Is the conversion process of an existing ship and include: a. Processes that substantially change the dimensions or load capacity of the vessel.
b. Operations that change the type of ship.
c. Operations intended to be substantially extended the duration of the ships service in the opinion of the maritime authority.
d. Operations resulting in further changes making to the ship so that they are subject to the relevant provisions of the Convention.
From the nearest land in the Kingdom: From the baselines from which the territorial waters of the State were determined according to the maritime areas law issued by the Royal Decree No. (M / 6) dated 18-1-1433H, Corr. 13/12/2011.
Special area: a sea area where for recognized technical reasons in relation to its oceanographical and ecological condition and to the particular character of its traffic the adoption of special mandatory methods for the prevention of sea pollution by oil is required. Special areas shall include those listed in Annexes 1 and 5.
Instantaneous rate of discharge of oil content means the rate of discharge of oil in liters per hour at any instant divided by the speed of the ship in knots at the same instant
Tank: an enclosed space which is formed by the permanent structure of a ship and which is designed for the carriage of liquid in bulk.
Wing Tank: any tank adjacent to the side shell plating
Centre Tank: means any tank inboard of a longitudinal bulkhead
slop Tank: a tank specifically designated for the collection of tank draining , tank washings and other oil mixtures
Storage tank: It’s the tank used to collect and store the sewage waste.
Clean Ballast: means the ballast in a tank which since oil was last carried therein, has been so cleaned that effluent therefrom if it were discharged from a ship which is stationary into clean calm water on a clear day would not produce visible traces of oil on the surface of the water or on adjoining shorelines or cause a sludge or emulsion to be deposited beneath the surface of the water or upon adjoining shorelines. If the ballast is discharged through an oil discharge monitoring and control system approved by the Administration, evidence based on such a system to the effect that the oil content of the effluent did not exceed 15 parts per million shall be determinative that the ballast was clean, notwithstanding the presence of visible traces.
Segregated Ballast: means the ballast water introduced into a tank which is completely separated from the cargo oil and oil fuel system and which is permanently allocated to the carriage of ballast or to the carriage of ballast or cargoes other than oil or noxious substances as variously defined in the Annexes of the present Convention
Length (L): means 96% of the total length on a waterline at 85% of the least moulded depth measured from the top of the keel, or the length from the foreside of the stem to the axis of the rudder stock on that waterline, if that be greater. In ships designed with a rake of keel the waterline on which this length is measured shall be parallel to the designed waterline. The length (L) shall be measured in meters.
The DEADWEIGHT (DW): means the difference in metric tons between the displacement of a ship in water of a specify gravity of 1.025 at the load waterline corresponding to the assigned summer freeboard and the lightweight of the ship
Anniversary: the day and the month of each year which will correspond to the date of expiry of the International Oil Pollution Prevention Certificate, Pollution by Noxious Liquid Substances in Bulk certificate and ' Prevention of Pollution by Sewage from Ship certificate
Harmful substance: any substance which, if introduced into the sea, is liable to create hazards to human health, to harm living resources and marine life, to damage amenities or to interfere with other legitimate uses of the sea.
Contaminated hazardous substances: Those substances defined as marine pollutants in the International Maritime Dangerous Cargo Code, the International Maritime Dangerous Cargo or IMDG Code IMDG Code.
Packaging: Specific containment forms for harmful substances in the IMDG Code.
Harmful liquid substances: Any substance listed in the footer to Annex II of the Convention or temporarily classified under Article (40) of this Regulation as falling under category (X), (Y) or (Z).
Sewage drainage and other wastes from any form of toilets, urinals, and WC scuppers; drainage from medical premises (dispensary, sick bay, etc.) via wash basins, wash tubs and scuppers located in such premises; drainage from spaces containing living animals; or other waste waters when mixed with the drainages defined above
Garbage means all kinds of victual, domestic and operational waste excluding fresh fish and parts thereof, generated during the normal operation of the ship and liable to be disposed of continuously or periodically except those substances which are defined or listed in other Annexes to the present Convention
Emissions: any release of substances, subject to control by this Annex from ships into the atmosphere or sea
Ozone-depleting substances “ODS”: Substances subject to the Control defined in paragraph (4) of Article (1) of the Montreal Protocol on Substances that Deplete the Ozone Layer of 1987.
Shipboard Incineration: . the incineration of wastes or other matter on board a ship, if such wastes or other matter were generated during the normal operation of that ship.
International Code for the Construction and Equipment of Bulk Chemical Tankers: The International Code for the Construction and Equipment of Ships transporting of Bulk Chemical Vessels adopted by the Marine Environment Protection Committee of the Organization by Resolution MEPC.19 (22) and such amendments as may be adopted by the Organization. Provided that such amendments are adopted and entered into force in line with the provisions of Article (16) of the Convention concerning the procedures for amending an appendix to an annex.
Code of Bulk Chemical Tankers: Code for the Construction and Equipment of Ships of Bulk Hazardous Chemicals adopted by the (MEPC) of the Organization by Resolution (MEPC.20 (22) and such amendments as may be adopted by the Organization. Provided that such amendments are adopted and entered into force in accordance with the provisions of Article (16) of the Convention relating to the amendment procedures applicable to the footer of a facility.
Vessels flying the flag of the Kingdom and foreign vessels when they are located within the Kingdom's maritime waters shall be complied with the provisions of the Convention and take the necessary measures in order to prevent the pollution of the marine environment by the discharge of harmful substances or effluents containing such substances in contravention of the Convention.
1. All ships shall be prohibited from violating the requirements of the Convention by discharging contaminated materials in accordance with the provisions of the Convention.
2. Ship's mastersshall report any polluting substances discovered within the State's maritime waters, whether originating from their ship or any other vessel.
3. The relevant authorities shall investigate the maritime incidents relating to the provisions of the Convention. Taking into account the guidelines issued by the Organization and without prejudice to the relevant provisions and rules contained in international codes and relevant domestic texts.
4. Coordination and cooperation between the relevant authorities shall be carried out to collect and maintain the evidence related to the maritime incident and measures shall be taken to limit unjustified detention of vessels.
1. The provisions of these Regulations shall apply to all the vessels flying the Saudi flag wherever they may be and the foreign vessels while they are in the territorial waters of the Kingdom.
2. The provisions of the International Convention for the Prevention of Pollution from Ships of 1973, and its amendments with its six appendices, the relevant codes and the applicable resolutions of the Organization shall be in conformity with the provisions of these Regulations, unless otherwise provided in the provisions of these Regulations.
3. The provisions of these Regulations shall apply to ships flying the flag of a State not party to the Convention and operating within the maritime boundaries of the Kingdom.
4. . The present Convention shall not apply to any warship, naval auxiliary or other ship owned or operated by a State and used, for the time being, only on government non-commercial service
The Maritime Authority may grant the certificates, exemptions, exceptions and the equivalent alternatives from certain requirements in accordance with the provisions of the Convention and its annexes, taking into account the guidelines issued by the Organization and the relevant regulations of the Kingdom.
Regulations (15) and (34) of Annex (I) to the Convention, and paragraph (1.1.1) of the International Code for the Safety of Ships Operating in the Polar Regions of Part (II) -A, do not apply to:
1. Oil or oil mixtures that must be discharged into the sea for the purpose of securing the safety of the ship or saving lives at the seas.
2. Oils or oil mixtures disposed of in the sea as a result of damage to the ship or its equipment, subject to the following:
a. All reasonable precautions have been taken to prevent or mitigate the discharge to the fullest extent possible after the occurrence of the damage or discovery of the discharge.
b. Cases where the owner or master has acted intentionally to cause damage or if one of them fails, knowing that there is a possibility of damage.
3. Discharge of materials containing oils at sea with the consent of the maritime authority when the purpose is to combat specific pollution incidents to minimize pollution damage. Such discharges shall be subject to approval by the relevant parties intending to perform such operations under their control.
1-The maritime authority may allow any fitting, material, appliance, or apparatus to be fitted in a ship as an alternative to that required by this regulation
2-the maritime authority which allows a fitting, material, appliance, or apparatus, according to the previous paragraph shall communicate to the Organization for circulation to the Parties to the Convention particulars thereof, for their information and appropriate action, if any.
1. Oil tankers with a gross cargo of 150 tons and above, and all other vessels with a gross tonnage of 400 tons or more shall be to the following:
a. An initial survey before the ship is put in service or before the Certificate required is issued for the first time, which shall include a complete survey of its structure , equipment , systems , fittings, arrangements and material in so far as the ship is covered by this regulation . This survey shall be such as to ensure that the structure, equipment, systems, fittings, arrangements and material fully comply with the applicable requirements of this regulation
b. Periodical surveys at intervals specified by the maritime authority but not exceeding five years, which shall be such as to ensure that the structure, equipment, systems, fittings, arrangements and material fully comply with the requirements of this annex
c. A minimum of one intermediate survey three months before or after the second anniversary or during before or after the third anniversary of the International Convention for the Prevention of Pollution from Ships certificate , intermediate survey may replace anyone of the annual surveys mentioned in paragraphs(1) of this regulation . The intermediate survey shall be such as to ensure that the equipment and associated pumping systems including oil discharge monitoring and control systems, crude oil washing systems, oily- water separating equipment and oil filtering systems, full y comply with the applicable requirement s of this regulation and are in good working order.
d. An annual survey within 3 months before or after each anniversary of the International Certificate for the Prevention of Oil Pollution, including the general survey of the structure, equipment, systems, supplies, arrangements and materials referred to in paragraph (1/a) of this Article. To ensure compliance by the ship with the requirements of paragraphs (4/1) and (4/2) of regulation (6) of Annex (I) of the Convention and remain in good condition.
e. These surveys shall be recorded on the International Certificate for the Prevention of Oil Pollution.
f. The maritime authority shall establish appropriate measures for ships which are not subject to the provisions of paragraph (1) of this regulation to ensure that they are complied with the provisions of this regulation
2. Surveys of ships as regards the enforcement of the provisions of this regulation shall be carried out by officers of the maritime authorities. The maritime authority may, however, entrust the surveys either to surveyors nominated for the purpose or to organizations recognized by it
3. When a nominated surveyor or recognized organization determines that the condition of the ship or its equipment does correspond substantially with the particulars of the Certificate or is such that the ship is not fit to proceed to sea without presenting an unreasonable threat of harm to the marine environment, such surveyor or organization shall immediately ensure that corrective action is taken and shall in due course notify the maritime authority. If such corrective action is not taken the Certificate should be withdrawn and the maritime authority shall be notified immediately; and if the ship is in a port of another Party, the appropriate authorities of the port State shall also be notified immediately. When an officer of the maritime authority, a nominated surveyor or recognized organization has notified the appropriate authorities of the port State, the Government of the port State concerned shall give such officer, surveyor or organization any necessary assistance to carry out their obligations under this regulation. When applicable, the Government of the port State concerned shall take such steps as will ensure that the ship shall not sail until it can proceed to sea or leave the port for the purpose of proceeding to the nearest appropriate repair yard available without presenting an unreasonable threat of harm to the marine environment.
4. Upon completion of any survey of the vessel under this article, no significant alteration may be made in respect of the structure, equipment, supplies, arrangements or materials covered by the survey without the prior consent of the maritime authority, unless it is for the complete replacement of such equipment or supplies.
