Statute on Job Search Assistance

  • After reviewing the correspondence received from the Royal Court No. 990 dated 06-01-1442 AH, including the telegram from the National Development Fund No. 60/4200004 dated 01-01-1442 AH, regarding the draft Statute of Job Search Assistance.

  • After reviewing the aforementioned draft Statute.

  • After reviewing theStatute of Job Search Assistanceissued by Council of Ministers Decision No. (353) dated 25-12-1432 AH, and its amendments.

  • After reviewing theStatute of Financial Allocation for Difficulty in Obtaining Employmentissued by Council of Ministers Decision No. (44) dated 29-01-1435 AH.

  • After reviewing Server Process No. (400) dated 26-06-1442 AH, and Memorandum No. (1523) dated 03-09-1442 AH, prepared by the Bureau of Experts at the Council of Ministers.

  • After reviewing the recommendation prepared by the Council of Economic and Development Affairs No. (16-28/42/D) dated 13-07-1442 AH.

  • After reviewing the recommendation of the General Committee of the Council of Ministers No. (6322) dated 10-09-1442 AH.

  • It is decided as follows:
     

  • First:

  • Approval of the Statute of Job Search Assistance, in the attached form.

  •  

  • Second:

  • By way of exception to what is stated in item (First) of this decision, the Human Resources Development Fund shall continue disbursing to the current beneficiaries of the (Statute of Job Search Assistance) issued by Council of Ministers Decision No. (353) dated 25-12-1432 AH, and the (Statute of Financial Allocation for Difficulty in Obtaining Employment) issued by Council of Ministers Decision No. (44) dated 29-01-1435 AH, until the expiration of the period specified for them to benefit from the assistance or financial allocation.

Article 1

  • The following words and phrases - wherever they appear in this regulation - shall have the meanings specified next to them, unless the context requires otherwise:

    • 1- The Fund: Human Resources Development Fund.

    • 2- The Council: Board of Directors of the Fund.

    • 3- The Regulation: Regulation for Job Search Assistance.

    • 4- The Implementing Regulation: The implementing regulation of the regulation.

    • 5- The Assistance: Job Search Assistance.

    • 6- The Applicant: The person who has submitted a claim to benefit from the assistance.

    • 7- The Qualified: The applicant who meets the eligibility requirements and has not yet started to benefit from the assistance.

    • 8- The Beneficiary: The qualified individual who has received the assistance.

    • 9- The Family: A group of individuals - residing in a single dwelling - consisting of a husband and wife (or more) and their children or some members of this group.

    • 10- The Pension: An amount paid monthly to the applicant as the direct entitled person based on the Civil Retirement Law, Military Retirement Law, or Social Insurance Law.

    • 11- The Monthly Income: The total financial amounts received by the applicant and their family during the month preceding the claim for assistance, from salaries, commercial returns, or others, as determined by the regulation.

    • 12- The Wealth: The assets or funds of the applicant and their family that can be evaluated, as determined by the regulation.

    • 13- The Authorized Representative of the Fund: Any governmental or private entity authorized by the Fund to perform some tasks and responsibilities assigned to it for implementing the provisions of the regulation or the implementing regulation.

    • 14- Education: Education in any public or higher education institutions, as determined by the regulation.

    • 15- Training: Technical or vocational training that lasts more than three months.

    • 16- On-the-Job Training: The tasks or work requested by the Fund or its authorized representative from the qualified or beneficiary to perform, aimed at developing their skills and increasing their chances of obtaining employment.

    • 17- The Electronic Platform: A website or electronic application created by the Fund in accordance with the regulation, or any other website or electronic application specified by the Fund.

    • 18- E-Training: The tasks or work requested by the Fund or its authorized representative from the qualified or beneficiary to perform through the electronic platform or other modern technological means, aimed at developing their skills and increasing their chances of obtaining employment.

Article 2

  • The regulation aims to achieve the following:

    • 1- Organizing the disbursement of assistance and determining the individuals entitled to receive it.

    • 2- Working to support job seekers and assist them in obtaining employment.

    • 3- Encouraging job seekers to enter the labor market.

    • 4- Defining the rights of the parties involved (the fund and job seekers) as well as their responsibilities and obligations.

Article 3

  • The disbursement of the aid amount shall be for a duration of (fifteen) months, as follows:

    • 1- (Two thousand) Riyals monthly for a duration of (four) months, starting from the date of commencement of the aid disbursement.

    • 2- (One thousand five hundred) Riyals monthly for a duration of (four) months, starting from the date of completion of the period specified in paragraph (1) of this article.

    • 3- (One thousand) Riyals monthly for a duration of (four) months, starting from the date of completion of the period specified in paragraph (2) of this article.

    • 4- (Seven hundred fifty) Riyals monthly for a duration of (three) months, starting from the date of completion of the period specified in paragraph (3) of this article.

Article 4

The funding for the assistance shall be from the revenues of the financial compensation established based on item (Second) of the Council of Ministers Resolution No. (353) dated 25/12/1432 AH, and the Ministry of Finance shall finance any deficit that the fund may face in covering the expenses of the assistance.

Article 5

  • The applicant shall be eligible for assistance if the following conditions are met:

    • 1- He must be a Saudi national.

    • 2- He must be a permanent resident in the Kingdom of Saudi Arabia. The regulation specifies the conditions for permanent residency.

    • 3- He must be capable of working and serious in seeking employment. The regulation specifies the criteria for capability and seriousness.

    • 4- He must be at least (twenty) years old and not more than (forty) years old.

    • 5- He must not be an employee or worker in the public or private sector.

    • 6- He must not be receiving a retirement pension.

    • 7- He must not be receiving any allowance or compensation for unemployment.

    • 8- He must not be receiving a pension from social security.

    • 9- He must not be a student or trainee at any stage of education or training.

    • 10- He must not have a commercial activity, as defined by the regulation.

    • 11- His monthly income or wealth must not exceed the threshold that prevents him from receiving assistance, as defined by the regulation.

    • 12- He must not have previously benefited from job search assistance or from the financial allocation for difficulty in obtaining work. However, an exception may be made to accept the application of an applicant who has previously benefited, provided that the total duration of previous and subsequent payments does not exceed the duration of assistance stipulated in Article (3) of the regulation, and the regulation specifies the mechanism for calculating the durations.

Article 6

  • 1- The submission of the Claim to the Fund or its authorized representative shall be made through the electronic platform or any other means specified by the Fund.

  • 2- The Claim shall be submitted considering one of the following two periods:

    • A- Within (twenty-four) months from the date of completion of study or Training in any stage of education or Training.

    • B- After (twenty-four) months from the date of termination of the employment or labor relationship if the applicant has previously worked in the public or private sector, taking into account what is stated in paragraph (7) of Article (5) of the Regulation.

    • The Council may amend these two periods in agreement with the National Development Fund.

  • 3- The applicant is obliged to do the following:

    • A- Attend at the time specified by the Fund or its authorized representative to evaluate his Claim, in accordance with what is specified in the Regulation.

    • B- Provide the Fund or its authorized representative with all the documents requested in the manner specified.

    • C- Follow the instructions issued by the Fund during the study of his Claim, in accordance with what is specified in the Regulation.

  • 4- The Fund shall study the Claim to verify the availability of the eligibility conditions, and the applicant shall be notified of the decision made regarding his Claim within a period not exceeding two months from the date of completing the Claim. In the event that the Fund's decision is to reject the Claim, the rejection must be justified.

Article 7

Article 8

  • 1- The disbursement of the aid to the beneficiary shall be suspended -immediately- in any of the following cases:

    • A- Upon the expiration of the aid disbursement period.

    • B- If a request is made to suspend the disbursement of the aid.

    • C- If the beneficiary passes away.

    • D- If any condition for entitlement specified in Article (5) of the Regulation is no longer met.

  • 2- If the disbursement of the aid to the beneficiary is suspended based on subparagraph (A) of paragraph (1) of this Article, he shall not be entitled to submit a new application for aid.

  • 3- Without prejudice to the provisions of Article (7) of the Regulation, if the disbursement of the aid to the beneficiary is suspended based on subparagraph (B) or (D) of paragraph (1) of this Article, the fund may accept his request to resume the disbursement of the aid, in accordance with what is determined by the Regulation, provided that the total duration of the aid disbursement -whether continuous or intermittent- does not exceed (fifteen) months, taking into account what applies to the amount of aid according to Article (3) of the Regulation.

  • 4- The aid shall be reduced by an amount of (two hundred) Riyals monthly, and the reduction shall continue until the expiration of the period specified in Article (3) of the Regulation, if the beneficiary does not comply with any of his obligations specified in Article (7) of the Regulation, in accordance with what is determined by the Regulation.

  • 5- The value of monthly income and wealth shall be deducted from the aid, in accordance with what is determined by the Regulation.

  • 6- The fund may temporarily suspend the disbursement of the aid to the beneficiary for a period not exceeding (six) months, and the Regulation shall specify the cases in which the disbursement of the aid may be suspended.

Article 9

1- The beneficiary - who intentionally provided false data or information for the purpose of obtaining assistance - must repay the full amount of the assistance that was disbursed to him.
2- The fund has the right to refer anyone who provides false data or information for the purpose of obtaining assistance to the relevant authorities to take legal action against him.
3- The fund or its authorized representative may take all necessary measures to recover the amounts of assistance that were disbursed to the beneficiary and for which he has been found ineligible.
